Description
This is a sole source, combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, and the test program outlined in FAR 13.6 as well as supplemental information provided herein. This non-competitive action will be processed in accordance with FAR 6.301-1 (Only one responsible source and no other supplies or services will satisfy agency requirements). The Patent and Trademark Office plans to issue a modification to Contract 50-PAPT-0-00085 to extend engineering consulting services with Open Text Inc., Bannockburn, IL. Open Text procured the proprietary rights of the BRS software from Dataware, Inc. BRS software is a critical tool utilized in daily operations at the U. S. Patent and Trademark Office. The technical services are required in order to support the BRS software products utilized by the Patent and Trademark Office. As a result of the proprietary ownership of the BRS software, the services to be procured can only be performed by Open Text. USPTO plans to extend the existing contract by one additional year with two option periods thereafter. The contract modification will be issued to establish an extension to the period of the contract with new labor rates on a fixed price, IDIQ basis. This modification will establish a maximum ordering ceiling to allow for the issuance of orders up to the maximum of $2M for the base period and $1.5 for each of the option periods thereafter. This announcement constitutes the RFP and is the only solicitation that will be issued. A sole source proposal is being requested pursuant to this announcement. This solicitation incorporates all of the applicable provisions and clauses in effect through FAC 01-04 as if stated in full text, as well as the terms and conditions of FAR 52.212-1, 52.212-2; 52.212-3, 52.212-4; 52-216-18, 52.216-22, and 52.217-5. A proposal shall be delivered to the Patent and Trademark Office, Office of Procurement, 2011 Crystal Drive, CPK 1, Suite 810, Arlington, VA 22202, Attention: Ms. Joan Hanicak, no later than 2:00 PM (EST), March 07, 2002.
