- THIS IS A SOURCES SOUGHT FOR THE OPERATION OF A FAST FOOD SNACK BAR LOCATED AT ONIZUKA AIR STATIONTO DETERMINE IF THERE ARE INTERESTED PARTIES AND TO PROVIDE COMMENTS ON THE STATEMENT OF WORK (SOW). A CONCESSIONAIRE CONTRACT WILL BE NEGOTIATED TO INCLUDE A MONTHLY FEE TO BE PAID BY THE CONTRACTOR TO THE NONAPPROPRIATED FUND INSTRUMENTALITY (NAFI). THE SNACK BAR IS TO BE OPERATED IN THE EXISTING SNACK BAR FACILITY ON ONIZUKA AIR STATION. RECOMMENDED HOURS OF OPERATION ARE MONDAY THROUGH FRIDAY, 6:00 AM TO 2:00 PM. HOWEVER, WITH PRIOR NOTICE, THE CONTRACTOR MAY ADJUST HOURS TO COINCIDE WITH CUSTOMER DEMAND. THE CONTRACTOR WOULD NOT BE REQUIRED TO OPERATE THE SNACK BAR ON FEDERAL HOLIDAYS. IF THE CONTRACTOR CHOOSES TO OPERATE ON FEDERAL HOLIDAYS, HE/SHE MUST NOTIFY THE CONTRACTING OFFICER IN WRITING TWO WEEKS IN ADVANCE OF THE APPLICABLE HOLIDAY. AFTER IT HAS BEEN DETERMINED THAT THERE ARE ENOUGH CONTRACTOR INTERESTED IN THIS REQUIREMENT, A SYNOPSIS WILL BE POSTED FOR PROPOSAL. THIS IS A NONAPPROPRIATED FUND REQUIREMENT AND IT DOES NOT OBLIGATE APPROPRIATED FUNDS OF THE UNITED STATES GOVERNMENT. NONAPPROPRIATED FUNDS ARE GENERATED BY THE MILITARY COMMUNITY THROUGH THE SALE OF GOODS AND SERVICES AND THE COLLECTION OF FEES AND CHARGES FOR PARTICIPATION IN MILITARY COMMUNITY PROGRAMS. THIS PURCHASE DOES NOT INVOLVE FEDERAL TAX DOLLARS. STATEMENT OF WORK (SOW): 1. SCOPE OF WORK. The contractor shall provide all personnel, supervision, training, equipment, tools, materials, supplies, resale products and other items and services necessary to operate a fast food restaurant on Onizuka Air Force Station (OAFS) in the existing Space Place snack bar facility. The contractor shall perform to the standards in this contract and SOW. 2. THE GOVERNMENT/NAFI SHALL PROVIDE: 2.1. The Building. This restaurant shall be located/operated in the Space Place (Building 1006) on OAFS, CA. It will occupy the area presently called the "Onizuka Snack Bar," hereinafter referred to as "Snack Bar". 2.2. Equipment. All equipment (reference attached inventory) presently located in the Snack Bar. The contractor may use some or all of the offered equipment. NAFI retains ownership of the equipment provided to the contractor. 2.3. As needed, NAFI will remove and dispose of the equipment it owns. 3. CONTRACTOR SHALL PROVIDE: 3.1. Personnel. An experienced full-time facility manager capable of and responsible for operation of the Snack Bar, and ample workers to conduct business of product and payment. The name of this person and alternate(s) who shall act for the contractor when the manager is absent shall be designated in writing to the Contracting Officer (CO) within ten days after contract award. The contractor shall provide to the CO, within ten days after contract award, telephone numbers of the facility manager and alternate(s), so these persons may be contacted outside of normal duty hours, if necessary. This information shall be kept updated as changes occur. 3.1.1. The facility manager or alternate(s) shall have full authority to act on behalf of and/or for the contractor on all matters relating to the daily operations of this contract on OAFS. 3.1.2. The facility manager or alternate shall be available within two (2) hours to meet on OAFS with NAFI personnel designated by the CO to discuss emergencies/problem areas if needed. 3.1.3. The facility manager or alternate shall be on-site during the hours the restaurant is open for business. 3.1.4. The contractor shall not employ persons for work on this contract if such individual/s is/are identified to the contractor by the CO as a potential threat to the health, safety, security, general well being, or operational mission of the installation and its population. 3.1.5. Contractor personnel shall present a neat, professional appearance, maintain a high degree of personal cleanliness, conform to hygienic practices, and be easily recognized as contractor employees. All contractor personnel must be able to speak and understand English fluently. 3.1.6. Contractor employees shall meet all medical and health requirements specified by the Military Public Health at Travis Air Force Base in accordance with the FDA Food Code and Air Force Instruction (AFI) 48-116, Food Safety Program. 3.1.7. The contractor shall not employ any person who is an employee of the United States Government if the employment of that person would create a conflict of interest. The contractor shall not employ any person who is an employee of the Department of the Air Force, either military or civilian, unless such person seeks and receives approval according to the DoD 5500.7-R, Joint Ethics Regulations (JER) and any other prescribing directives. In addition, the contractor shall not employ any person who is an employee of the Department of the Air Force if such employment would be contrary to the policies contained in AFI 64-106, Air Force Industrial Labor Relations Activities. 3.1.8. The contractor is cautioned that off-duty active military personnel hired under this contract may be subject to permanent change of station, change in duty hours, or deployment. Military reservists and National Guard members may be subject to recall to active duty and the abrupt absence of these personnel could adversely affect the contractor's ability to perform. Their absence at any time shall not constitute an excuse for nonperformance under this contract. The contractor will ensure enough on-call employees are available to meet these and other contingencies. 3.1.9. Control of Contractor Employees. The selection, assignment, reassignment, transfer, supervision, management, and control of contractor employees in performance of this work statement shall be the responsibility and prerogative of the contractor. However, the contractor shall comply with the requirements set forth in DoD, Air Force, and OAFS regulations concerning conduct of employees as referenced herein. 3.1.10. Contractor personnel shall comply with directives pertaining to operation of privately owned vehicles on OAFS per AFI 31-204, Motor Vehicle Traffic Supervision. 3.2. Employee Training. The contractor shall ensure that their employees are trained and proficient in the operation of a Snack Bar. The contractor will provide this training at no additional cost to NAFI or the Government. 3.2.1 The contractor shall ensure the contract facility managers receive food handlers training from the Military Public Health personnel from Travis AFB. This training class is approximately 2 hours in length and will be conducted semiannually. All non-supervisory employees shall be trained in food handling techniques by contract facility managers that have attended the food handlers training course. All contractor personnel shall also attend at least 2 hours per year of fire prevention training provided by the Government. 3.3. Health and Sanitation Requirements. The contractor shall operate the facility in full compliance with appropriate health and sanitation guidelines as directed by the Travis Air Force Base Military Public Health Flight and 60th Air Base Wing. The contractor will ensure that stove/grill hoods are cleaned on a quarterly basis and meet safety and Fire Department requirements. A copy of these requirements shall be provided by the NAFI and shall be maintained onsite at all times. The contractor will be responsible for all costs for hood cleaning service. 3.3.1. Contractor shall clean and sanitize dishes, pots, pans, kitchen, and kitchen equipment in accordance with the FDA Food Code. Clean floors following each meal period so that no visible dirt or dust remains on floors, floor mats or runners, in corners, behind doors or under equipment. Spot clean floors as necessary to remove food spills and debris that may cause a safety hazard. Due to the high safety hazard of a kitchen floor, this floor will be kept clean at all times. The floors shall have no visible stains and floors must be stripped periodically. 3.4. Utilities. The contractor shall reimburse the NAFI for electricity, water, gas utilities usage at rates set by the installation commander and agreed upon by both parties. Contractor may transfer the existing phone through the local phone company to be billed directly to the contractor. 3.5. Equipment Security. The contractor shall be responsible for safeguarding all NAFI furnished equipment. At the close of each work period, NAFI facilities, property, and materials shall be secured. The contractor shall conform to the provisions of AFI 31-101, The Air Force Installation Security Program, for safeguarding the NAFI-furnished facilities and material contained therein. 3.5.1. Key Control. The contractor shall establish and implement methods of ensuring that all keys issued to the contractor are not lost or misplaced and are not used by unauthorized persons. No keys issued to the contractor by the NAFI shall be duplicated. Such procedures shall include turn-in of any issued keys by personnel who no longer require access to locked areas. 3.5.2. The contractor will immediately report the occurrences of lost or duplication of keys to the CO. The CO will notify the Director of Services (21 SOPS/SV) and request the contractor (at contractor's expense) to have locks re-keyed and provide at least 2 copies of the new keys to the Director of Services. 3.5.3. The contractor shall prohibit the use of NAFI issued keys by any persons other than the contractor's employees. The contractor shall prohibit the opening of locked areas by contractor employees to permit entrance of persons other than contractor's employees engaged in the performance of assigned work in those areas, or personnel authorized entrance by the CO. 3.6. Equipment. The contractor shall provide any and all equipment needed to operate in addition to the equipment provided by the NAFI. 3.6.1. The contractor retains ownership of all equipment purchased by the contractor. 3.7. Suggested Hours of Operation. It is recommended the contractor operate the restaurant Monday through Friday 6:00 a. m. to 2 p. m, however, with prior written notification to the CO and Director of Services, the contractor may adjust hours to coincide with customer demand. With prior written notification to the CO and Director of Services, the contractor may work extended hours to ensure timely completion of work at no cost to the NAFI. 3.7.1. Holidays. The contractor is not required to but may choose to operate the restaurant on any or all of the following holidays: New Year's Day, Martin Luther King, Jr. Day, President's Day, Memorial Day, Independence Day, Labor Day, Columbus Day, Veteran's Day, Thanksgiving Day, and Christmas Day. If the contractor chooses to open the restaurant on any of these days, the CO must be notified in writing at least two weeks in advance of the holiday. 4. Recording Sales. The contractor's staff shall record all sales on a Cash Register System to be provided by the contractor. When each sale is made, the customer must be given a cash register receipt. 4.1. Once a week, Contractor shall provide NAFI a copy of the cash register tapes for each day of the previous week. This shall occur each Monday morning except federal holidays when the weekday shall be moved to Tuesday. Contractor shall deliver these cash register tapes to the Director of Services? office. Settlement Report AF 2555 shall be completed at the end of each month. 4.2. The contractor will post signs at each cash register concerning cash register receipts. A drop box may be installed and the contractor may offer weekly prizes to patrons. 5. Insurance. Obtain insurance for all non-Government property and merchandise used by the Concessionaire in the operation of the concession against theft, fire, storm, flood, and damage, or destruction through any other force of nature; or in lieu thereof, to relieve the NAFI from any liability arising from such theft, loss, damage, or destruction. The Concessionaire must have liability insurance commensurate with the risks involved, and furnish proof of such to the Contracting Officer. 6. Fee Schedule. The contractor shall pay the Director of Services a fee of $500.00 per month or 10% of net profit, whichever is the lower. 6.1. Payments. Checks shall be made payable to the "Onizuka MWR Fund". Checks shall be hand delivered to the Director of Services? office or mailed to ensure delivery at the following address not later than the ninth (9th) day of each month for the preceding month's sales: 21 SOPS/SV, 1080 Lockheed Martin Way Box 122, Sunnyvale CA 94089-1233 7. Sale of Alcoholic Beverages. Contractor may offer beer and wine for sale to patrons provided it is purchased and consumed along with a meal in the restaurant. Contractor must not offer beer and wine to be taken off the premises for consumption. This facility is a restaurant and is not to be operated as a "bar". Contractor is responsible for any and all required licenses, permits, etc. 8. Orientation/Set Up Period. The contractor will be given 30 days from date of contract award for start-up orientation during which time no monthly fee shall be due. 9. Waste Management. The contractor shall comply with base recycle programs. This may require segregating reusable/recyclable waste materials. All non-reusable waste materials (trash and garbage) shall be placed in contractor furnished trash bags and placed in dumpsters. No loose trash or garbage is to be placed in Government furnished dumpsters. All hazardous materials (HAZMAT) brought on base must go through the HAZMAT Pharmacy. The contractor shall comply with AFI 32-7086, Hazardous Materials Management, Chapter 2, and AFI 32-7080, Pollution Prevention Program. 10. Base Access. All personnel employed by the contractor in the performance of this contract, or any representative of the contractor entering the Government installation, shall abide by all security regulations of the installation, and shall be subject to such checks as the Government deems necessary. The contractor shall obtain personal identification passes for all employees and vehicle passes for all contractor and personal vehicles requiring entry onto OAFS. 11. Advertising/Marketing Support. NAFI shall provide advertising support through the Onizuka Orbitor and Base Bulletin. All contractor initiated advertising, signage, promotional materials, etc. shall be at the contractor's expense and must be submitted to the Director of Services (21 SOPS/SV) for approval before publication, distribution, and/or posting of advertising, signage, and promotional materials.
