Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. Request for Quotation (RFQ) 921772 is assigned and shall be referenced on any quotation. All incorporated provisions and clauses are those in effect through Federal Acquisition Circular 01-04. The Standard Industrial Code is 5045, (NAICS code is 421430) with a business standard of 100 employees. The solicitation will be distributed solely through the General Services Administration's Federal Business Opportunities web site http://fedbizopps.gov/. The site provides downloading instructions. All future information about this acquisition including solicitation amendments, will also be distributed solely through this site. Interested parties are responsible for monitoring this site to ensure that they have the most up-to-date information about this acquisition. This contract action will result in a Firm Fixed Price - One Time Buy contract. The government intends to purchase on a sole source all or none basis the following hardware and software upgrades from the manufacture Empirix, formerly known as Hammer Technology of Waltham, MA., Two (2) OPT-SS7 SS7 card w/MTP protocol ISUP Software License, One (1) SWPI HTB ISUP Hammer Test Builder SS7 ISUP plug-in, One (1) CHS UPGM 01 Chassis upgrade from prolog to IBUS, Four (4) OIT 2T 2 span T1 w/48 port license for IT (1 PCI board set, Two (2) OIT 4PR T 4 ports prompt recognition w/1 T1 span, Eight (8) OIT 4PR Port Prompt Recognition, additional ports. The proposed contract action is for hardware and software upgrades for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302. Interested persons may identify their interest and capability to respond to the requirement. The Standard Commercial Warranty is one year. FOB Destination, FBI, ERF Bldg., Quantico, VA 22135, All responsible sources may submit a quote which shall be considered. All quotes shall be submitted to the address listed below no later than 4:00 PM, EST, April 16, 2002, quote clearly marked with RFQ 921772. Fax quotes will be accepted and, in fact, are encouraged at (202)324-5722. No hand carried proposal will be accepted. All potential bidders are hereby notified that due to security requirements, Federal Express, D.H.L., UPS, ETC, deliveries for the FBI Headquarters facility are now received at an off-site location. Therefore, the normal response time of 15 days has been extended to 25 days. The FBI has allowed ten (10) extra days from the release of the Fedbizopps synopsis/solicitation for receipt of a quote. Bidders are hereby notified that if your quote is not received by the date/time and at the location specified in this announcement, it will not be considered. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. The following clauses and provisions are incorporated by reference and apply to this acquisition. FAR Clause 52.212-1, INSTRUCTIONS TO OFFERORS (OCT 2000) and addendum is incorporated into this solicitation. ADDENDUM to 52.212-1, Modify: (b) Submission from offer(s) is to read as follows: "Submit signed and dated offer(s) to the attention of Ms. Mabel Comfort, Contracting Officer, RFQ-921772, FBI, 935 Pennsylvania Ave., N.W., Room 6888, Washington, D.C. 20535-0001. The quote may be sent via facsimile to (202) 324-5722. The contractor shall provide three names, addresses, telephone and facsimile numbers of previous contracts, either Government or Commercial, from similar type contracts, for the purpose of evaluating Past Performance." Add: 52.202-1--DEFINITIONS (DEC 2001); 52.204-4--PRINTED OR COPIES DOUBLE-SIDED ON RECYCLED PAPER (AUG 2000); 52.215-5--FACSIMILE PROPOSALS (OCT 1997). All quotes are due by 4:00 PM, EST, April 16, 2002. Incorporated by reference are the FAR clauses 52.212-4, CONTRACT TERMS AND CONDITIONS--COMMERCIAL (DEC 2001) and addendum. ADDENDUM 52.212-4(g) Add: (9) Vendor invoice number, account number, and/or any other identifying number agreed to by the contract; (10) Taxpayer Identifying Number (TIN); and, (11) Banking information necessary to facilitate and Electronic Funds Transfer (EFT) payment. If the information requested is not provided on all invoices submitted it will be considered an improper invoice and returned. PROTEST AFTER AWARD (AUG 1996). The Department of Justice (DOJ), Justice Acquisition Regulation Clauses, 2852.233-70--PROTESTS FILED DIRECTLY WITH THE DEPARTMENT OF JUSTICE (JAN 1998); and, 2852.201-70--CONTRACTING OFFICER'S TECHNICAL REPRESENTATIVE (COTR) (JAN 1985). Clause 52.212-5, CONTRACT TERMS AND CONDITIONS REQUIRED TO IMPLEMENT STATUTES or EXECUTIVE ORDERS - COMMERCIAL ITEMS (DEC 2001), Subsection (a), (b), (d) and (e) apply. Clause 52.212-3, OFFEROR REPRESENTATIONS AND CERTIFICATIONS - COMMERCIAL ITEMS (DEC 2001) apply. Each offer shall include a completed copy of 52.212-3 with their quote. Offeror must acquaint themselves with the new regulations concerning Commercial Item acquisitions contained in FAR Subpart 12, and must ensure that all Representations and Certifications (located on the Internet) are executed and returned as required in this synopsis/solicitation.
