- Naval Medical Logistics Command intends to award a contract to the offeror that provides the best value to the government from this combined synopsis/solicitation for commercial services prepared in accordance with FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; offers are being requested and a written solicitation will NOT be issued. The document number for this Request for Proposals is N62645-02-T-0007 and proposals are due by NOON, 7 MAY 2002. Responses must contain sufficient documentation to establish a bonafide capability to fulfill the requirements. This solicitation and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 97-26. NAISC 621111. The government contemplates award of a firm fixed price contract for the following requirement. This requirement is for interpretation of echocardiograms for the Naval Ambulatory Care Clinic (NACC) Newport, RI. The total contract is for one base year plus three option years to cover FY 02, FY 03, FY 04, and FY 05. SCOPE OF WORK: 1.1 The Contractor shall provide interpretation of echocardiograms for the Naval Ambulatory Care Clinic (NACC) Newport, RI, (hereafter referred to as "the MTF" (Military Treatment Facility)). 1.2 The Government will courier to the Contractor facility approximately 20 to 25 echocardiograms per month. The courier service will be once per week on the same mutually agreed day, subject to change due to holidays or emergencies. On each run, the courier will drop off new echocardiograms for interpretation and pick up echocardiograms and interpretations from the previous week. 1.3 The Contractor shall interpret each echocardiogram and provide a complete written medical evaluation of findings using a Government-provided form. The written evaluation of each echocardiogram shall be completed for courier pickup not later than the next courier run, following delivery of the echocardiograms. 1.4. The Contractor shall furnish a sufficient number of fully-trained physicians as specified in Section 2.0. to ensure that one qualified individual provides services on a regular basis as specified herein. 2. QUALIFICATIONS. Contractor physicians shall possess the following minimum qualifications: 2.1 Graduation from a medical school approved by the Liaison Committee on Medical Education of the American Medical Association or the American Osteopathic Association or permanent certification by the Educational Commission for Foreign Medical Graduates (ECFMG). 2.2. Board certification in Internal Medicine. 2.3 Subspecialty certification in Cardiology Disease. 2.3 Possess a current, unrestricted license to practice medicine in any one of the fifty States, the District of Columbia, the Commonwealth of Puerto Rico, Guam or the U.S. Virgin Islands. 2.4 A minimum of 12 months experience within the last 36 months as a cardiologist interpreting echocardiograms. 3. INDEPENDENT CONTRACTOR. The services rendered by the Contractor are rendered in the capacity of an independent Contractor. The Government will evaluate the quality of both professional and administrative services for purposes of contract inspection and acceptance. The Government retains no direct control over professional assessments and/or recommendations. The Contractor shall be solely responsible for any and all liability caused by the acts or omissions of its agents or employees. The Contractor shall not in any manner represent or infer that it is an instrumentality or agent of the United States Government. The Contractor shall recognize that the Commanding Officer of the MTF maintains administrative and operational responsibility for all activities within the command and may take such actions as necessary to preserve and maintain the integrity of the command, subject to the limitations prescribed by law and U.S. Navy Regulations. 4. INSURANCE. 4.1 The Contractor shall maintain during the term of this contract medical liability insurance issued by a responsible insurance carrier of not less than the following amount(s) per specialty per occurrence: $1,000,000. 4.2 Liability insurance may be on either an occurrences basis or on a claims-made basis. If the policy is on a claims-made basis, an extended reporting endorsement (tail) for a period of not less than 3 years after the end of the contract term must also be provided. 4.3 Evidence of insurance documenting the required coverage for each health care provider who will perform under this contract shall be provided to the Contracting Officer prior to the commencement of services under this contract. If the insurance is on a claims-made basis and evidence of an extended reporting endorsement is not provided prior to the commencement of services, evidence of such endorsement shall be provided to the Contracting Officer prior to the expiration of this contract. Final payment under this contract shall be withheld until evidence of the extended reporting endorsement is provided to the Contracting Officer. 4.4 The policies evidencing required insurance shall also contain an endorsement to the effect that any cancellation or material change adversely affecting the Government's interest shall not be effective until 30 days after the insurer or the Contractor gives written notice to the Contracting Officer. If, during the performance period of the contract the Contractor changes insurance providers, the Contractor must provide evidence that the Government will be indemnified to the limits specified in paragraph 4.1, for the entire period of the contract, either under the new policy, or a combination of old and new policies. 5. RECORDS. 5.1 All records produced in the performance of this contract and all evaluations of patients are the property of, and subject to the exclusive control of, the Government. The Contractor may retain a copy of all such records or evaluations, but may not provide further copies or disclose the information from such records or evaluations to third parties. All requests from other treatment facilities or other individuals for patient records shall be handled in accordance with procedures specified by applicable MTF instructions. 5.2 Confidentiality Of Information. Unless otherwise specified, all financial, statistical, personnel and/or technical data which is furnished, produced or otherwise available to the Contractor during the performance of this contract are considered confidential business information and shall not be used for purposes other than performance of work under this contract nor be released by the Contractor without prior written consent of the Commanding Officer of the MTF. Any presentation of any statistical or analytical materials, or any reports based on information obtained from the studies covered by this contract, will be subject to review and approval by the Commanding Officer of the MTF before publication or dissemination. 5.3 If a subpoena or court order is received for the production of a medical record, the Contractor shall refer the subpoena or court order to the Contracting Officer for action. 5.4 Neither the Contractor nor Contractor employees shall make any disclosure regarding the contract, the MTF, or MTF patients, employees, or staff members without prior approval of the Commanding Officer. All inquiries from the media shall be forwarded to the Contracting Officer. 6.CONTRACTOR EMPLOYEES. 6.1 The Contractor shall not employ persons convicted of violations of criminal statutes, felonies, or misdemeanors involving crimes against persons or moral turpitude. At his own expense, the Contractor shall conduct such background checks of prospective employees as may be necessary to ensure compliance with this paragraph. 6.2 The Contractor shall not employ any alien in the performance of the contract in violation of the Immigration Laws of the United States. 6.3 The Contractor shall not hire any employee for performance under this contract whose employment would result in a conflict with Government or Department of Defense Standards of Conduct. 6.4 The Contractor shall be responsible for payment of all wages and salaries, taxes, withholding payments, penalties, fees, fringe benefits, professional liability insurance premiums, contributions to insurance and pension or other deferred compensation plans including, but not limited to, Workers' Compensation and Social Security obligations, licensing fees, etc., and the filing of all necessary documents, forms and returns pertinent to all of the foregoing. The Contractor shall indemnify and hold the Government harmless from and against any and all claims by Contractor employees for the payment or filing of any of the foregoing compensation. The Contractor agrees to pay all applicable federal, State, and local income taxes, including any and all other Governmental fees, taxes, or expenses levied against it. 7. INVOICING. 7.1 The Contractor shall submit a monthly invoice for echocardiograms interpreted using form DD 250, available at http://web1.whs.osd.mil/icdhome/DD-0999.htm. The invoices will be paid via government credit card. 7.2 The Contractor shall not bill patients for services rendered under this contract. 8. OTHER PROVISIONS. 8.1 The Contractor shall not, while performing services under this contract, advise, recommend, or suggest to persons eligible to receive medical care at Government expense that such persons should receive care from the Contractor or Contractor employees at any place other than at the MTF. 8.2 The Contractor and Contractor employees shall make no use of any Government facilities or other Government property in connection with services other than those required under this contract. PLACE OF PERFORMANCE: Contractor will perform 100% of the time at the contractor?s place of business. INSTRUCTIONS FOR PROPOSAL SUBMISSION: Offeror's shall provide a copy of separate technical and cost proposals via email or FAX (301) 619-6793. No pricing information shall be contained in the technical proposal. TECHNICAL PROPOSALS: The offerors shall describe their recent (within the past five years) past performance on not more than five (5) contracts or affirmatively state that they possess no relevant, directly related or similar past performance. The Government will give greater consideration to the experience which is most relevant to provision of services similar to those identified in the solicitation. The offeror's past performance information must include the Contract Number; date(s) and location of performance (Facility Name, City/State); verifiable point of contact at Government or Commercial Facility (Name/Phone/Email address); brief description of services performed and amount of interpretations; subcontractor(s) used, or state if you performed services as a subcontractor; and, state any problems and corrective actions taken. Additionally, offerors may include an explanation demonstrating the relevance of past performance to the requirements of this solicitation. The offeror shall provide a brief narrative (not to exceed ten (10) pages) to include offeror?s record of providing timely, effective and complete performance of services; offeror?s record of providing fully-qualified personnel in accordance with terms of the contract; identification of any quality problems which precluded successful performance of services and any remedies implemented and effectiveness of remedies; and the offeror?s experience interacting with the military community. The offeror may also include any innovative or noteworthy accomplishments or achievements that occurred during performance of services in any of the examples. The Navy will not restrict its past performance evaluation to information submitted by offerors but will also consider any other relevant information in its possession. The Navy reserves the right to contact the points of contact identified in the offeror?s proposal for the purpose of verifying the offeror?s record of past performance. It is the responsibility of the offeror to ensure that names and phone numbers for points of contact are verified and accurate. COST PROPOSAL shall include a complete price for the requirement in CLIN 0001 with priced option years and a completed Representations and Certifications for Commercial Items. EVALUATION & AWARD: Award will be made to the offeror whose proposal meets the government's minimum requirements and whose price and technical performance risk represents the best value to the government. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). Technical and performance risk are significantly more important than price. The following technical evaluation criteria will be used: FACTOR 1: MINIMUM REQUIREMENTS. The offeror has successfully demonstrated compliance with all of the minimum performance requirements contained in the solicitation. This factor will be evaluated on an ACCEPTABLE/UNACCEPTABLE basis. An offeror may be rated UNACCEPTABLE AS SUBMITTED if the proposal has not demonstrated compliance with all minimum requirements but has the potential to do so if amended during discussions. Offerors are cautioned that the Government intends to award without discussions, so proposals deemed UNACCEPTABLE AS SUBMITTED may not be considered for award. Proposals deemed UNACCEPTABLE will not be evaluated for Factor 2. FACTOR 2: PERFORMANCE RISK ASSESSMENT. The extent to which the offeror's proposal reflects an appropriate apportionment of performance risk will be evaluated in this factor. Performance risk considerations are defined as those characteristics of the offeror that give indication of the likelihood of the offeror's successful performance of the current requirement. Their proposed delivery schedule, record of on-time delivery for same services and product, quality of workmanship displayed in same services and product, reliability of same class services and product, business relations exhibited during previous contracts, range and depth of support provided for same class services and product.
