Description: NA This is a sole source contract to extend the existing Otero County Electric Cooperative distribution line, close to RITA Site, approximately 10 miles northeast to Deadhorse Site, following WSMR Range Road 9. The contractor shall supply three phase, 60 Hz, alternating current at 24.9-kV. The Contractor shall follow the WSMR Environmental Office approved route staking plan (reference modification P00013 to Otero County Electric Cooperative contract DAAD07-69-C-0124) and as a part of the proposal submit rapt or-safe designs for the new structures in accordance with ?Suggested Practices for Raptor Protection on Power Lines: The State of the Art in 1996?, published by the Edison Electric Institute. The Government-connected load does not exceed 29-kVA at 208 vA C, three phase (100 amp service). The Contractor shall purchase and install a three phase transformer bank, fuses, switches, etc. to supply the TSN facility, 100-amp service, load. The Government will be responsible for connecting the low side of the tra nsformers. In accordance with Federal Acquisition Regulation 41.201(d)(1), Section 8093 of the Department of Defense Appropriations Act of 1988, P.L. 100-202, provides that none of the funds appropriated by the Act or any other Act with respect to any fisc al year by any department, agency, or instrumentality of the United States, may be used for the purchase of electricity by the Government in any manner that is inconsistent with state law governing the providing of electric utility service, including state utility com mission rulings and electric utility franchises or service territories established pursuant to state statute, state regulation, or state-approved territorial agreements. In New Mexico, the New Mexico Public Regulation Commission is constitutio nally created and is charged by the Legislature with regulating public utilities, telecommunications companies, and insurance companies to the extent necessary to provide just and reasonable rates and to assure reasonable, adequate and efficient service fo r the public. The commission issues Certification of Public Convenience and Necessity for construction and operation of public utility plant or system. Otero County Electric Cooperative (OCEC) has the franchise rights and authority to provide electric util ity services in Otero and Lincoln Counties. These facility assets have accumulated under a number of contracts going back to 1952. The New Mexico Public Regulation Commission regulates rates and service of electric utilities and rural electric cooperatives , including OCEC. The commission has issued Certificates of Public Convenience and Necessity to OCEC, and only to OCEC, to provide electric utility service in Otero and Lincoln County, New Mexico. Otero County Electric Cooperative (OCEC) owns and services existing primary electrical power lines and equipment in this area. Therefore OCEC is the only organization capable of, and permitted to provide the required utility services in this area. See Note 22.
