- 1. The Air Force Research Laboratory's Directed Energy (DE) and Space Vehicles (VS) Directorates have contracted for various business and staff support services, some of which may require the contractor (Leader Communications, Inc.; major subcontractor: DataCom Sciences, Inc.) to access, for administrative purposes only, proprietary information submitted by other contractors. The required access does not involve the review, reading, or comprehension of the content of the information and will be granted to non-technical professionals assigned to accomplish these administrative tasks. Examples of the administrative tasks include: a. Assembling and organizing information for R&D case files b. Accessing library files for use by government personnel in the DE and VS Directorates c. Handling and administration of Small Business Innovation Research proposals, contracts, contract funding and queries 2. In view of the limited types of administrative access Leader Communications will be granted, DE and VS have obtained a waiver from the regulatory requirement for contractors to execute company-to-company agreements for protection of proprietary information. 3. Instead, Leader Communications, Inc. will be contractually bound to protect this information and will be further required to protect this information by entering into non-disclosure agreements with its subcontractors and all personnel employed under the contract, as well as with the Government. Copies of the non-disclosure agreements will be provided to the contracting officer. Future R&D solicitations and contracts issued for DE and VS will include provisions similar to this notice, advising offerors that Leader Communications will require administrative access to proprietary data and that non-disclosure agreements will be executed. Contractors with open DE and VS contracts will be individually notified and asked to provide written consent for Leader Communications to obtain administrative access to any proprietary data delivered under their contracts.
