- Description
- This is a combined synopsis/solicitation for commercial items prepared in accordance with (IAW) the format in the Federal Acquisition Regulation (FAR), Subpart 12.6, as supplemented with additional information included in this notice. Simplified procedures as described in FAR 13.5 will be used for acquisition of these commercial items. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. The Government intends to solicit and negotiate on a firm fixed price basis with Gentex Corporation, 324 Main Street, Simpson, PA 18407 a five (5) year Indefinite Quantity Indefinite Delivery (IDIQ) contract, consisting of five (5) twelve-month Ordering Periods, for the part numbers listed below. During the course of the contract the Government guarantees it will place orders totaling a minimum of $100,000. These items will be procured on a sole source basis under the authority of FAR Part 6.302-1, Only One Responsible Source and no other supplies will satisfy the Governments requirements. Gentex helmets and associated accessories are the only helmets that meet all of the following minimum Government requirements: 1) provide a minimum of 1400psi cranial ballistic protection; 2) include integrated helmet with internal speakers and mounted waterproof dynamic microphone; 3) provide static noise protection at a minimum of 82db at 4000 Hz; 4) provide "wet pluggable" and waterproof cables and connectors used in marine applications; 5) have automatic Advanced Noise Reduction capability; 6) adaptable to a one size fits all using internal sizing adjustments; and 7) have adequate mounting plates, straps, surfaces for night vision or ballistic goggles. Additionally, only the identified Gentex helmets will provide identical form, fit, function, and interface to previously procured Gentex helmets purchased under IDIQ Contract N00421-96-D-1411. Solicitation Number N00421-02-R-0016 is being released using commercial acquisition procedures as described in FAR Part 12. The incorporated document and provisions and clauses are those in effect through FAC 2001-07 and DCN 20020531 Edition. This action is not set aside for small business. NAICS is 334220 with a size standard of 750 employees. The contract line item (CLIN) numbers, descriptions, and estimated quantities by period of performance of the items to be procured are available on the NAVAIR Homepage website described below. The total estimated quantities over the entire five-year period by part number (P/N) are as follows: P/N 94D8963-2 RIB Boat Helmet, 700 each; P/N 94B8953 Lower Cord Assembly, 1,150 each; P/N 94A8791-1 Ballistic Goggle Assembly with Clear Lens, 1,000 each; P/N 93D8466-8 CVC Ballistic Shell, Large, 75 each; P/N 72B2477 Chin Pad, 150 each; P/N 94D8782-2 Waterproof Bonnet, Medium/Large, 150 each; P/N 93A8445-2 Helmet Bag, 300 each; P/N 94B8790 Communications Kit w/ PTT In-Line, 150 each; P/N 94D8950 Communications Kit (sub assembly), 150 each; P/N 93A8440 Windscreen, 685 each; P/N 78A3901 "O" Ring, 685 each; P/N 72A2505 Foam Filler, 300 each; P/N 72A2506 Foam Filler, 3/8", 300 each; P/N 71B2388-1 Swivel Assy, 400 each; P/N 94B8792-2 Upper Cord Assy, w/leads and hardware, 685 each; P/N 98C10311-1 Earseal Assy, 300 each; P/N 01C11217-02EAO Flex boom Assembly 2 1/2?, Pigtail U-172, 300 each; P/N 78A4135 M-138 150 ohm Mic, 300 each; P/N 73B2619 19 ohm Receivers, 300 each; P/N 84C6829-2 Earcup tension spring assy, 25 each; and P/N 93A8429-8 Inner helmet assy w/pads medium/large, 25 each. The proposal along with completed representations and certifications is due by 1 July 2002 and shall have a minimum acceptance period of 30 days. A copy of the complete list of CLINs and associated estimated quantities, by year, for the Base Year and subsequent four Ordering Periods covered by this Request for Proposal (RFQ) and the representations and certifications (52.212-3 & 252.212-7000) may be found on the NAVAIR Homepage at www.navair.navy.mil/business/ecommerce/index.cfm. Award is anticipated by 25 July 2002. FOB Destination to Receiving Officer, NAWCAD, Building 8115, Villa Road, St. Inigoes, MD 20684-0010, M/F: to be cited in each delivery order. Inspection and acceptance shall be made at destination. Delivery shall be within 120 days of date of each delivery order. The contractor shall extend to the Government full coverage of any standard commercial warranty normally offered in a similar commercial sale. Acceptance of the warranty does not waive the Government's rights under the Inspection clause, nor does it limit the Government's rights with regard to the other terms and conditions of this contract. In the event of a conflict the terms and conditions of the contract shall take precedence over the warranty. The warranty period shall begin upon final acceptance of the applicable deliverable listed in the schedule. The following clauses are incorporated by reference and apply to this acquisition: (1) 52.212-1 Instructions to Offerors -- Commercial Items (Oct 2000); (2) 52.212-4 Contract Terms and Conditions -- Commercial Items (Feb 2002); (3) 52.216-18 Ordering (Oct 1995) - fill-in: Paragraph (a) - Such orders may be issued from date of award through 60 months thereafter if all options are exercised.; (4) 52.216-19 Order Limitations (Oct 1995) - fill-ins: Paragraph (a) ...1 each of any identified CLIN..., Paragraph (b)(1) - ...the total estimated quantity of any identified CLIN, Paragraph (b)(2) ...the total estimated quantity of all CLINs in a given period of performance, Paragraph (b)(3) - ...thirty (30) days...; (5) 52.216-22 Indefinite Quantity (Oct 1995) ...fill-in: Paragraph (d) - ...120 days after the last day of the contracts final period of performance.; and (6) 252.204-7004 Required Central Contractor Registration (Nov 2001). The provision at 52.212-2 EVALUATION-COMMERCIAL ITEMS (JAN 1999) does not apply to this acquisition. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforms to the solicitation and is considered to be most advantageous to the Government, price only considered. The following factors shall be used to evaluate offers: (1) Price. Offeror shall include a completed copy of the provision at FAR 52.212-3, Offeror Representations and Certifications - Commercial Items (May 2002) with Atlernate I (Apr 2002) and DFAR 252.212-7000, Offeror Representations and Certifications - Commercial Items (Nov 1995) with its quote. The following addendum is added: 5252.246-9503, Year 2000 Compliance (Mar 1999) (NAVAIR) (a) All information technology to be provided to the government under this contract, and which is required to perform date/time processing involving dates subsequent to December 31, 1999, shall be Year 2000 compliant. (b) "Year 2000 compliant" means that the information technology to be provided under this contract, functioning alone or in combination with other supplies to be provided under this contract, accurately processes date/time data (including but not limited to, calculating, comparing and sequencing) from, into, and between the twentieth and twenty-first centuries, and the years 1999 and 2000 and leap year calculations. (c) Failures resulting from Government Furnished equipment that is not Year 2000 compliant are not covered under this clause. **End of clause** FAR 52.212-5 CONTRACT TERMS AND CONDITIONS REQUIRED TO IMPLEMENT STATUTES OR EXECUTIVE ORDERS--COMMERCIAL ITEMS (MAY 2002) applies to this acquisition. (e) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c) or (d) of this clause, the Contractor is not required to include any FAR clause, other than those listed below (and as may be required by an addenda to this paragraph to establish the reasonableness of prices under Part 15), in a subcontract for commercial items or commercial components-(1) 52.222-26, Equal Opportunity; (2) 52.222-35, Equal Opportunity for Special Disabled Veterans, Veterans of the Vietnam Era and Other Eligible Veterans; (3) 52.222-36, Affirmative Action for Workers with Disabilities; and (4) 52.247-64, Preference for Privately Owned U.S.-Flag Commercial Vessels (flow down not required for subcontracts awarded beginning May 1, 1996); and (5) 52.222-41, Service Contract Act of 1965, As Amended. **End of clause** DFARS 252.212-7001 CONTRACT TERMS AND CONDITIONS REQUIRED TO IMPLEMENT STATUTES OR EXECUTIVE ORDERS APPLICABLE TO DEFENSE ACQUISITIONS OF COMMERCIAL ITEMS (MAY 2002) applies to this acquisition. (a) The Contractor agrees to comply with the following Federal Acquisition Regulation (FAR) clause which, if checked, is included in this contract by reference to implement a provision of law applicable to acquisitions of commercial items or components. 52.203-3, Gratuities. (b) The contractor agrees to comply with any clauses that is checked on the following list of Defense FAR Supplement clauses which, if checked, is included in this contract by reference to implement provisions of law or Executive orders applicable to acquisitions of commercial items or components. 252.205-7000, Provision of Information to Cooperative Agreement Holders, 252.219-7003, Small, Small Disadvantaged and Women-Owned Small Business Subcontracting Plan (DoD Contracts), 252.225-7007, Buy American Act ? (c) In addition to the clauses listed in paragraph (e) of the Contract Terms and Conditions Required to Implement Statutes or Executive Orders--Commercial Items clause of this contract (Federal Acquisition Regulation 52.212-5), the Contractor shall include the terms of the following clause, if applicable, in subcontracts for commercial items or commercial components, awarded at any tier under this contract: 252.225-7014, Preference for Domestic Specialty Metals, Alternate I, 252.247-7023, Transportation of Supplies by Sea, and 252.247-7024, Notification of Transportation of Supplies by Sea. **End of Clause** Interested persons may identify their interest and capability to respond to the requirement or submit proposals. This procurement is being contracted on the basis of "other than full and open competition? pursuant to the authority of FAR 6.302-1 (only one responsible source and no other goods or services will satisfy agency requirements). THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. However, the Government will consider all proposals received by 1 July 2002. The Government will not pay for any information received. A determination by the Government not to compete this procurement action based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. Responsible interested parties may submit information in which they identify their interest and capability.
