Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The Naval Surface Warfare Center, Dahlgren Division (NSWCDD) intends to purchase on a sole-source basis from the manufacturer, Airboss of America Corporation, 130 Adelaide Street W., Toronto, Ontario, Canada, M5H 3P5 the following items, which will be used to ensure protection of Navy reserve personnel from chemical agent attack. 10,000 Pairs ALO/MK5, Acton NBC Lightweight Overboots This acquisition will be a Firm Fixed-Price contract. All items shall be delivered, inspected, and accepted FOB destination to NAVRESFOR SSSF, FXFC, WHSE 4-2, Attn: Battelle F ort Worth Operations, 501 Felix Street, Fort Worth, Texas 76115. The solicitation number is N00178-02-R-3103; it is issued as a request for proposal (RFP). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2001-07, dated 30 April 2002 and DFARS Change Notice dated 31 May 2002. The North American Industry Classification System (NAICS) Code is 316211 with a size standard of 500 employees. The offeror shall provide a copy of any warranty applicable to the items contained in this solicitation. FAR 52.212-1, "Instructions to Offerors - Commercial Items," applies to this solicitation and is hereby incorporated by reference. In accordance with FAR 52.212-2, "Evaluation - Commercial Items (Jan 1999)," applies (a) The Government will award a contract resulting from this solicitation to the responsible off eror whose offer conforming to the solicitation will be the most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: Technical capability of the item offered to meet the Government's requirements, price, and past performance. Technical capability and past performance, when combined, are approximately three times more important than the proposed price. (b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. Offerors shall include a completed copy of the provisions at FAR 52.212-3, "Offeror Representations and Certifications - Commercial Items," with their offer. The following provisions apply to this acquisition: FAR 52.212-4, "Contract Terms and Conditions - Commercial Items," FAR 52.212-5, "Contract Terms and Conditions Required to Implement Statutes or Executive Orders - Commercial Items," subparagraphs (a), (b) 1, 5, 11, 12, 13, 14, 15, 16, 18, 19, 24 (d), and (e); DFAR 252.212-7000, "Offeror Representations and Certifications - Commercial Items," applies with the requirement that offeror's provide a completed copy with their offer, DFAR 252.212-7001, "Contract Terms and Conditions Required to Implement Statutes or Executive Orders Applicable to Defense Acquisitions of Commercial Items," with the following provisions of subparagraph (b) thereof indicated as applicab le: 252.225-7007, 252.225-7009, 252.225-7012, 252.243-7002, 252.247-7023, and 252.247-7024. The following additional DFARS provisions and/or clauses apply to this acquisition: 252.204-7004, Required Central Contractor Registration. This procurement is rated DO-A90. All responsible sources may submit an offer which shall be considered. The closing date for receipt of proposals is 2:00 p.m. (Eastern time), 28 June 2002.
