Description
(i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. (ii)DCA200-02-R-5015. This solicitation is a Request For Proposal(RFP). (iii) The RFP document and incorporated provisions and clauses are those in effect through FAC 2001-07 and DCN 2002-0531. (iv) The resultant contract will not be set aside for small business. NAICS: 513390, Small Business Size Standard: $11 million. (v) Provide a purchase price for each of the following items. Requirement description is set forth in para (vi) below. (vi) This is a sole source requirement. The following items can only be supplied by Spirent Communications-ADTECH Division, 3465 Waialae Avenue, Suite 200, Honolulu, Hawaii, 96816; CLIN 0001, 16 EA, Portable Chassis, Mfg: Adtech, P/N 400620; CLIN 0002, 16 EA, Portable GPS ENET Controller, Mfg: Adtech, P/N 401432; CLIN 0003, 16 EA, 1G Max G/A, Mfg: Adtech, P/N: 401400H; CLIN 0004, 16 EA, L2 Max 622M ATM License, Mfg: Adtech, P/N: 401313; CLIN 0005, 16 EA, 622M ATM SVC Emulation, Mfg: Adtech, P/N: 401510; CLIN 0006, 16 EA, ATM OC-3C MM I/F, Mfg: Adtech, P/N: 400305; CLIN 0007, 16 EA, AX 4000 SW/FW 1 YR Maintenance, Mfg: Adtech, P/N: 400710; CLIN 0008, 8 EA, Portable Chassis Hard Case, Mfg: Adtech, P/N: 400608. (vii) Required delivery date is 30 days after receipt of order (ARO) or sooner. FOB: Destination. (ix) FAR 52.212-2 applies to this acquisition. Evaluation factors to this solicitation are technical and price. Technical is the most important factor, then price. (x) Proposals shall include a completed copy of the provisions at FAR 52.212-3 and DFARS 252.212-7000 and 252.247-7022. (xi) FAR 52.212-4 applies to this acquisition. (xii) FAR 52.212-5 applies to this acquisition: 52.212-5 CONTRACT TERMS AND CONDITIONS REQUIRED TO IMPLEMENT STATUTES OR EXECUTIVE ORDERS--COMMERCIAL ITEMS (APR 2001) (DEVIATION) (a) Comptroller General Examination of Record. The Contractor agrees to comply with the provisions of this paragraph (a) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records-Negotiation. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to the right to examine any of the Contractor's directly pertinent records involving transactions related to this contract. (2) The Contractor shall make available at its offices at all reasonable times, the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved. (3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law. (b) The Contractor is not required to include any FAR clause, other than those listed below (and as may be required by an addenda to this paragraph to establish the reasonableness of prices under Part 15), in a subcontract for commercial items or commercial components-(1) 52.222-26, Equal Opportunity (E.O. 11246); (2) 52.222-35, Equal Opportunity for Special Disabled Veterans, Veterans of the Vietnam Era and Other Eligible Veterans (38 U.S.C. 4212); (3) 52.222-36, Affirmative Action for Workers with Disabilities (29 U.S.C. 793); (4) 52.247-64, Preference for Privately-Owned U.S.- Flag Commercial Vessels (46 U.S.C. 1241)(flow down not required for subcontracts awarded beginning May 1, 1996)., and(5) 52.222-41, Service Contract Act of 1965, As Amended (41 U.S.C. 351, et seq.). Subcontracts for certain commercial services may be exempt from coverage if they meet the criteria in FAR 22.1103-4(c) or (d) (see DoD class deviation number 2000-O0006).) (xiii) Additional requirements: (1) The following FAR clauses apply to this acquisition: 52.215-20, 52.232-33, and 52.252-2 (access to clauses can be made via www.far.npr.gov); (2) DFARS 252.212-7001 applies to this acquisition: 252.212-7001 CONTRACT TERMS AND CONDITIONS REQUIRED TO IMPLEMENT STATUTES OR EXECUTIVE ORDERS APPLICABLE TO DEFENSE ACQUISITIONS OF COMMERCIAL ITEMS (APR 2001) (DEVIATION) In addition to the clauses listed in paragraph (b) of the Contract Terms and Conditions Required to Implement Statutes or Executive Order-Commercial Items (DEVIATION) clause of this contract (FAR 52.212-5), the Contractor shall include the terms of the following clauses, if applicable in subcontracts for commercial items or commercial components, awarded at any tier under this contract: 252.225-7014, Preference for Domestic Specialty Metals, Alternate I (MAR 1998) (10 U.S.C. 2533a). 252.247-7023, Transportation of Supplies by Sea (MAR 2000) (10 U.S.C. 2631). 252.247-7024, Notification of Transportation of Supplies by Sea (MAR 2000) (10 U.S.C. 2631). The following DFARS clauses apply to this acquisition: 252.204-7004 and 252.225-7012. (3) The contract type will be a firm fixed price. All unit prices are firm fixed; The following additional clause is applicable to this procurement: YEAR 2000 COMPLIANCE - INFORMATION TECHNOLOGY (MAR 1998) a. All information technology provided under, or in support of, this contract by the contractor and all subcontractors will be Year 2000 compliant. "Year 2000 compliant" means, with respect to information technology, that the information technology accurately processes date/time data (including, but not limited to, calculating, comparing, and sequencing) from, into, and between the twentieth and twenty-first centuries, and the years 1999 and 2000 and leap year calculations, to the extent that other information technology, used in combination with the information technology being acquired, properly exchanges date/time data with it. b. To ensure Year 2000 compliance, the contractor shall, at a minimum, test a representative sampling of the information technology, or the same type of information technology, that will be provided under the contract. Year 2000 Compliance testing will be accomplished and documented in accordance with generally accepted commercial standards/practices. If requested, the contractor shall provide the Government with a copy of such Year 2000 compliance test documentation at no additional cost to the Government.
