- CBD COMBINED/SYNOPSIS SOLICITATION - (1) This is a combined synopsis/solicitation for commercial services prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This proposed action is for services for which the Government intends to SOLICIT AND NEGOTIATE WITH ONE SOURCE - Princeton Financial Systems, Inc. under authority of FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. (2) This Solicitation PBGC01-RP-02-0024 is a follow-on contract to Princeton Financial Systems, Inc. to obtain annual license, software maintenance and help desk support pertaining to PBGC's use of the Portfolio and Account Management (PAM) computer application. PAM is a copyrighted software product owned and operated by Princeton Financial Systems, Inc. They do not license other firms to market the application nor provide software maintenance. Likewise, the intended contractor is the only firm with knowledge of the product sufficient to provide these services. PBGC believes that it would be in our best interest for the current provider to continue performing these services. SOW - The contractor shall grant PBGC license rights to operate and use the PAM for PBGC business purposes. The contractor shall grant PBGC license rights to operate separate installations of PAM for training, testing, application change control and disaster recovery purposes. The contractor shall promptly provide all modifications, updates and enhancements to the PAM Application, which the contractor makes available at no costs to its licensees. Additionally, the contractor shall provide written system documentation (user guides, technical guides, installation guides, etc.) as aids in the implementation of such application changes. Contractor shall correct at no extra charge documented errors or defects identified by PBGC in the latest unmodified release of the application within 30 days of release, or, if agreed to by PBGC a period greater than 30 days. The contractor shall provide telephone help desk support during the hours of 9:00 A.M. to 5:00 P.M. EST. The help desk will respond to PBGC calls within one business day to assist FOD PAM users and PBGC's Information Resources Management Department technical support personnel in understanding and trouble shooting the functional and technical operations of the application. The period of performance for this service is five years (one year base period with four - 12 month renewal option periods. The base year period of performance is October 1, 2002 to September 30, 2003. (3) The following provision is being added as an Addendum: FAR 52-214-31 Facsimile Bids/Quotes. (4) The following provision applies to this acquisition: Federal Acquisition Regulation (FAR) 52.212-1 entitled Instructions to Offerors - Commercial. The following provision does not apply to this acquisition: FAR 52.212-2 entitled Evaluation -- Commercial Items. Award will be based on the best value to the Government . Offers are to include a completed copy of provision FAR 52-212-3 entitled Offeror Representations and Certifications --Commercial Items. The following provisions apply to this acquisition (a) FAR 52-212-4 entitled Contract Terms and Conditions--Commercial Items (b) FAR 52-212-5 entitled Contract Terms and Conditions Required To Implement Statutes or Executive Orders--Commercial Items (5) The following FAR clauses are applicable: 52-222-21, 52-222-26, 52-222-35, 52-222-36, 52-222-37, 52-225-16, 52-232-33, 52-222-41, 52-222-42, and 52-222-43, 52-252-5, 52-217-8, 52.217-9, 52.232-19. THIS IS A NOTICE OF INTENT TO AWARD A SOLE SOURCE CONTRACT AND IS NOTA REQUEST FOR PROPOSALS.
