Description
Fleet & Industrial Supply Center Puget Sound (FISCPS) intends to procure "Tube Lox" Scaffolding in support of Puget Sound Naval Shipyard on a sole source basis from Patent Construction Systems, Harsco Corporation, 1 Mack Centre Dr, Paramus NJ 07652. This procurement is sole source based on the requirement for the materials to be used with the extensive current inventory of Patent's "Tube Lox" scaffolding equipment. Introduction of alternate scaffold products would be incompatible with the existing scaffolding. Due to the unique nature of each manufacturer's scaffolding, intermixing different manufacturer's products poses a serious safety hazard. In fact, CFR 1926.451(b)(10) states, "Scaffold components manufactured by different manufacturers shall not be intermixed unless the components fit together without force and the scaffold's structural integrity is maintained by the user. Scaffold components manufactured by different manufacturers shall not be modified in order to intermix them unless a competent person determines the resulting scaffold is structurally sound." In the past, the Government has used MIL-S-29180B "Scaffolding Components, Steel, Tube and Coupler" to procure tube and clamp scaffolding. The products received by PSNS when ordered to this Mil-Spec do not consistently intermix properly with the existing scaffolding equipment. PSNS has submitted recommended changes to the Mil-Spec to NAVSEA for review, testing and approval, with the desire to provide for future competitive procurements. The resulting contract will be a firm fixed price indefinite delivery indefinite quantity supply type contract. The period of performance is from date of award through one year thereafter. FOB Destination at PSNS Bremerton WA. The proposed contract action is for supplies for which the Government intends to solicit and negotiate with only one source under authority of FAR 6.302. This notice of intent is not a request for competitive proposals. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. No telephone requests will be accepted.
