- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR 12.6 as supplemented with additional information contained in this notice. This procurement is being conducted under Simplified Acquisition Procedures in accordance with FAR Part 13. This solicitation document and incorporated provisions and clauses are those in effect through the September 2001 Federal Acquisition Regulation revision, which includes the consolidation of all Federal Acquisition Circulars through 2001-08. This acquisition is 100% small business set-aside and the NAICS code is 541611 with a small business size standard of $6.0 million. It is the intent of the National Institutes of Health (NIH) to purchase professional acquisition support service for the Center for Information Technology (CIT), NIH from Dennis E. Black, Ph.D., 3 Locust Drive, Thurmont, Maryland 21788. The specific tasks will be included in the Request for Quote (RFQ). The service will be for a Base Year with a two (2) year option. Specifically, CIT requires the specialized services of an individual with an expert knowledge and understanding of CIT's unique and complex IT contracted activities who can successfully accomplish the following tasks: (1) prepare draft documents to process acquisitions, (2) gather information and prepare reports on CIT's acquisition responsibilities, (3) conduct studies and analyses in monitoring CIT's contracted programs and projects, (4) review and edit intellectual property transactions to ensure compliance with the Federal Acquisition Regulation (FAR) and other Federal law, (5) provide instruction and training to CIT program staff in reviewing terms and conditions under license agreements for software and other information products, and (6) perform other acquisition and related business support tasks as required by the Project Officer. CIT has determined that Dr. Black possesses the unique combination of knowledge, skills, and understanding of CIT's unique and complex IT contracted activities that are necessary to accomplish the specified tasks. He has provided specialized IT acquisition expertise during the past 24 years to various NIH I/Cs, including CIT, and the Department of Health and Human Services (HHS). He has a total of 31 years experience in Federal acquisitions, of which the past 21 years have been in positions of leadership, management, and supervision that have supported CIT's contracted IT requirements, including the IT systems that CIT develops, administers, and manages for NIH and HHS. He served as the Contracting Officer on the NIH Computer Center's main-frame acquisitions during the 1970s-1980s. He served as the Contracting Officer for the multiple-award, HHS-wide telecommunications contracts that served CIT and other components within the Department during the 1970s-1980s. He served as the Contracting Officer who was responsible for the negotiation and award of a contract to Statistical Abstract Services (SAS) that licensed SAS statistical software capabilities to the entire NIH research community. Since January 1996, he has served as the manager of an NIH service center that is responsible for providing specialized IT acquisition support to CIT. Most recently, he has been involved in acquiring technical IT services for various components within CIT. Since November 1999, he has served as the acquisitions manager responsible for the award and administration of a group of complex IT contracts that support the development of the NIH Business and Research Support System (NBRSS) whose software platform will be managed and operated on CIT's facility - the NIH Computer Center. Since July 2001, he has served as the Contracting Officer on several complex IT requirements for HHS for which CIT is directly affected, including the HHS Unified Financial Management System and an acquisition mechanism that allows HHS to consolidate its purchases for Oracle software in order to maximize its buying power. Both projects have a direct impact upon CIT. In addition, Dr. Black has participated at NIH and HHS in developing and implementing policy on acquiring highly complex Information Technology (IT) resources under licenses, including licenses for software, electronic journals, and other copyrighted intellectual property. He has reviewed and edited license agreements for a wide variety of intellectual property transactions. He has developed and presented training sessions to NIH program and acquisition staffs on reviewing license agreements for the acquisition of software and other intellectual property. He has developed and implemented innovative approaches to obtain biomedical R&D to bring new flexibility in response to changing complexities in industry, academia, and government from new kinds of partnerships. He has managed and supervised an acquisitions program involving the processing, award, and administration of a wide variety of acquisitions for highly complex biomedical R&D and non-R&D requirements, and supplies and services. He has provided leadership in successfully accomplishing several agency re-invention initiatives to streamline the Federal acquisition process; e.g., designation as a "Re-invention Laboratory" and an "Acquisition Service Center". He has employed a variety of cost-reimbursement and fixed-price acquisition instruments involving complex features such as broad agency announcements, incremental funding, fixed-price options, task-ordering, level-of-effort, and incentives. He has conducted a number of management reviews and analyses of acquisition support services. He has conducted reviews of inter and intra-agency agreements, and has processed and maintained registered copyrights and trademarks. CIT has determined that based upon his previous experience and expertise, Dr. Black will not require orientation to CIT's contracted activities, and is the only source with the unique qualifications who can successfully accomplish the specified tasks. This notice of intent is not a request for competitive proposals however, all responses received, within 15 days from the date of publication of this synopsis will be considered by NIH. A determination by the Government not to compete this proposed acquisition is based upon responses to this notice and is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. The contractor shall comply with all applicable Federal, State, and local laws, executive orders, rules and regulations applicable to its performance under this order.
