- This is a combined synopsis/solicitation for commercial items, prepared in accordance with the format in FAR subpart 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation, quotations are being requested and a written solicitation will not be issued. The solicitation number, N00259-02 -T- 0084(RFQ) is issued for reference. Clin 0001: Non-personal service contract for a Optometrist for the period 24 Sep 2002 to 23 Sep 2003. Qty: 1920; Unit of issue: Hours. The billing method will be bi-weekly in arrears based on the actual hours rendered. The duties to be performed shall be in accordance with the statement of work. The statement of work reads. Note 1: The use of Commander throughout this section means: Commander, Naval Medical Center San Diego, CA or designated, e.g. Technical Liaison, Department Note 2: The term physician refers to the individual providing services under this contract. Within the context of this contract, the terms physician and healthcare worker are used interchangeably. C.1. Statement Of Work: C.1.1. The physician shall perform comprehensive Optometry services. These comprehensive services shall be performed at the Naval Medical Center San Diego, Ca, or at the other Branch Medical Clinics within the San Diego are under the cognizance of the commander, Naval Medical Center. C.1.2. During the term of this contract the physician agrees to provide, on the behalf of the Government, the services of an Optometrist, for treatment of active duty military personnel, their family members, eligible Navy civilian employees and, other beneficiaries in accordance with the terms and conditions of this contract. C.1.3. While on duty, the physician shall not advice, recommended or suggest to individuals authorized to receive services at Government expense that such individuals shall receive services from the physician when he or she is not on duty, or from a partner or group associated in practice with the physician, except with the express written consent of the Commander. The physician shall not bill individuals entitled to services rendered pursuant to this contract. C.1.4. The physician shall be neat, clean, well groomed and, in appropriate clothing when in-patient care and public areas. All clothing shall be free of visible dirt and stains and, shall fit correctly. Fingernails shall be clean and free from dirt and hair shall be neatly trimmed and combed. The physician shall display an identification badge, furnished by the Government, on the right breast of his or her outer clothing, which includes the physician?s full name and professional status. C.1.5. The physician shall be physically capable of standing for extended periods of time and capable of normal ambulation. C.1.6. The physician shall comply with Executive Order 12731 of 17 Oct 1990, (55 Fed. Reg. 42547), ?Principles of Ethical Conduct for Government Officers and Employees? and, shall also comply with Department Of Defense (DOD) and Department of the Navy (DON) regulations implementing this Executive Order. C.1.7. The physician as a Non-Personal Service Contractor. C.1.7.1. The physician providing services under this contract shall be rendering non- personal services for the Navy. The contract under which the personnel rendering the services are not subject, either by the contract terms or by the manner of its administration, to the supervision and control usually prevailing in relationships between the Government and its employees. He/She is performing an agency function by providing direct medical care that would have to be provided by the Navy to its health care beneficiaries. C.1.7.2. Accordingly, personal injury claims alleging negligence by the physician within the scope of his or her performance of this contract shall be processed as claims alleging negligence by the contractor. The physician IS required to maintain medical liability insurance. C.1.7.3. Physicians, not currently in possession of a medical license (license to practice Optometry with ?Therapeutic? certification) from the State of California must acquire and maintain a valid license, at no cost to the Government, within 120 days following contract award. C.1.8. The physician shall read, write, speak and understand the English language fluently. C.1.9. The physician is not prohibited, by reason of employment under this contract, from conducting a private practice or other employment so long as there is no conflict with the performance of duties under this contract. However, such private practice or other such employment shall be conducted during this working hours in which the physician is required to render services under this contract. The physician shall make no use of Government facilities or property in connection with such other employment. (See Attachment 001 NAVMED P-117). C.2. Duty Hours. C.2.1. The physician shall be on duty in the assigned clinical areas at Naval Medical Center San Diego, CA for 40 hours per week. The physician shall normally provide services for 8.5-hour period, (to include an uncompensated .5 hour for lunch). Specific work hours will be scheduled by the Refractive Surgery Program Director. The physician shall arrive for each scheduled shift in a well-rested condition and shall have had at least six hours of rest from all other duties. C.2.2. When required to ensure completion of services that extend beyond the normal close of business, the physician shall remain on duty in excess of the scheduled shift. The physician will be given an equal amount of compensatory time to be scheduled upon mutual agreement of the physician and the Refractive Surgery Program Director. C.2.3. Services of the physician shall not be required on the following federally established holidays: New Year?s Day, Martin Luther King?s Birthday, President?s Day, Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans Day, Thanksgiving Day, and Christmas Day. C.3. Absences and leave C.3.1. A physician requiring emergency medical care will be provided medical care until the condition is stabilized. The physician shall reimburse the Government for all medical services provided. C.3.2. Only the Commander or the technical liaison may authorize absences to the physician in accordance with the Naval Medical Center?s policies and regulations. C.3.3. Documented military leave for military reservists will be allowed, not to exceed 15 calendar days per calendar year. C.3.4. The physician will not be compensated by the Government for services not rendered during a Government furlough. In the event of a Government furlough, the Commander will determine which contact employees are considered critical and therefore must report to work. Contract employees deemed critical will be compensated for services rendered during a furlough. All other contract employees will be furloughed until the Government shutdown ends or they are notified by the Technical Liaison designated in the contract that they have become critical employees. C.4. Duties. C.4.1. The physician shall perform a full range of optometric primary and specialty care, using Government furnished facilities, equipment and supplies. Caseload includes scheduled and unscheduled requirements for care. C.4.2. Routine workload is scheduled by the treatment facility. Primary workload is a result of appointments scheduled through the MTF?s central appointment system. Secondary workload is the result of consultation requests submitted to the specialty clinic by other staff physicians. The physician is responsible for a full range of diagnostic examinations, the development of comprehensive treatment plans were indicated, delivery of treatment within the personnel and equipment capabilities of the medical treatment facility, provision of mandated medical surveillance and preventive services and the quality and timeliness of treatment records and reports required to document procedures performed and care provided. The physician shall refer patients to staff specialists for consultation of care and shall see the patients of other staff healthcare providers who have been referred for consultation and treatment. C.4.3. Watch Standing: There is no watch standing requirements for an optometrist under this contract. C.4.4. Actual physician clinical activity will be a function of the Commander?s credentialing process and the overall demand for optometrist services. Physician productivity is expected to be comparable to that of other optometrists assigned to the same facility and authorized the same scope of practice. C.4.4.1 The physician shall provide special knowledge, skills and professional capabilities in optometry practice, clinical research and vision care practice management. These include: C.4.4.1.1. All aspects of comprehensive primary care optometry. C. 4.4.1.2. Coordinate with other department of the medical center staff to provide complete care to patients. C.4.4.1.2. Provide and document medical advice to patients by telephone as appropriate and in accordance with MTF protocols. C.4.4.1.3. Attend periodic meetings of department staff to review and evaluate the care and treatment provided to patients. Review compliance with the MTF quality control program and the standard operating procedures of the MTF. C.4.4.1.4. Provide clinical education and instruction to optometry students, residents and visiting clinicians. C.4.5. Upon contract award, the physician shall obtain clinical privileges from the Commander prior to performing services under this contract. 30 days prior to performances of services, the physician shall submit to the technical liaison the credential documents identified in Appendices B and J of BUMEDINST 6320.66A. C.5. Failure and/or Inability To Perform. C.5.1. The contract may be found void at the option of the Government if the physician fails to provide the physical certification requested in Section H or privileges are not granted to the physician by the Commander. C.5.2. Should the physician be unable to perform duties under this contract due to medical or physician disability for more than 13 consecutive days, performance under this contract may be suspended by the Contracting Officer until such medical or physical disability is resolved. If performance under this contract is so suspended, no reimbursement or other compensation will be made. C.5.3. If clinical privileges have been summarily suspended pending an investigation into questions of professional ethics or conduct, performance under this contract may be suspended until clinical privileges are reinstated. No reimbursement or compensation will be made. The denial, suspension, limitation, or revocation of clinical privileges based upon practitioner impairment or misconduct will be resorted to the appropriate licensing authorities of the state in which the license is held. C.5.4. Any physician(s) demonstrating impaired judgment, will be removed from providing healthcare services. The Government reserves the right to remove any employee or contract employee who, in the judgment of a licensed physician, is impaired by drugs or alcohol. C.5.4.1. Physician(s) with alcohol or drug abuse problems may be allowed to return to work under the terms of this contract only with prior Government approval. Minimum Qualifications: Section H: H.1.1. Must be proof of current Basic Life Support Level C certification. Training and certification will be provided by the Navy during normal working hours. H.1.2. Must possess a Doctorate Degree in Optometry from an accredited college approved by solicitation document and incorporated provisions and clauses are those in effect through FAC 2001-08. The following clauses and provisions are applicable and will be incorporated into the solicitation by reference, and will be available in full text upon request. Past performance and personnel qualifications based on SOW when combined have more importance that cost or price. Prior to Contract Award, the government reserves the right to review the resumes of contractor employees performing under the contract solely for the purpose of ascertaining their qualifications relative to the personnel qualifications terms of the contract. Accordingly, the contractor shall furnish such resumes and all professional requirements as stated in the Statement of Work ( SOW) to the Purchasing Agent along with their quotes.
