Spares Pre-Solicitation Notice Description: 1650 00 600 9224; P/N: 50-6247-9 Quantity: Range 13-25 each 26-39 each Solicitation Number: F34601-02-Q-0253 Sources: Rights Guard Certification Required (see below), Qualification Requirements Apply (see solicitation when issued for further details regarding Qualification Requirements) Destination: FB2039, Tinker AFB Required delivery date(s): on or before 30 Apr 2003 Approximate date solicitation will be released: 05 Sep 2002 Note: Solicitation requests can be submitted to the buyer, Karen Stevens, Tinker AFB, OK, phone (405) 734-4622, fax (405) 739-4417, e-mail Karen.stevens@tinker.af.mil. The proposed contract action is for supplies and services for which the Government intends to conduct a competitive procurement. Interested parties may identify their interest and capability to respond to the requirement or submit proposals. Only written of faxed requests received directly from the requestor are acceptable. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Award will be made only if the offeror, the product/service, or the manufacturer meets qualification requirements at the time of award in accordance with FAR clause 52.209-1. The solicitation identifies the office where additional information can be obtained concerning qualification requirements as sited in each individual solicitation. It is suggested that small business firms or others interested in subcontracting opportunities in connection with the described procurement make contact with the firms listed. Specifications, plans, or drawings relating to the procurement described are incomplete or not available and cannot be furnished by the Government. Based on market research, the Government is not using the policies contained in Part 12, Acquisition of Commercial Items, in its solicitation for the described supplies or services. However, interested persons may identify to the contracting officer their interest and capability to satisfy the Government?s requirement with a commercial item within 15 days of this notice. THIS IS A "RIGHTS GUARD" REQUIREMENT (JUL 1992) Restrictions on Use of Proprietary Data. 1. Technical data furnished herewith (hereinafter ?Rights Guard technical data?) is proprietary to The Boeing Company which has licensed the Government to use same for the procurement of replenishment spare parts for U.S. Government owned aircraft. 2. The Bidders/offerors/contractors hereunder are prohibited from (a) reproducing in whole or in part, Rights Guard technical data; (b) incorporating any information contained in such data into other documentation; or (c) otherwise utilizing such data except for responding to this solicitation or performing any resulting contract. Each bidder/offeror/contractor will include the FAR-authorized limited rights legend, identifying The Boeing Company as the owner on all Rights Guard technical data that is incorporated, in whole or in part, into any technical data delivered by such bidder/offeror/contractor to the Government in response to this solicitation or as part of the performance of any resulting contract. 3. Upon award of a contract, each successful bidder/offeror shall return to the government or destroy all Rights Guard technical data relating to this solicitation and shall provide to the Government a certification to that effect. Upon completion of contract performance, each contractor shall return to the Government or destroy all Rights Guard technical data relating to such contract and shall provide to the Government a certification to the effect. Mylars are not to be returned, but certification that they have been destroyed will be furnished at completion of this contract. (OCALC H800) NOTE: An Ombudsman has been appointed to hear concerns from offerors or potential offerors during the proposal development phase of this acquisition. The purpose of the Ombudsman is not to diminish the authority of the program director or contracting officer, but to communicate contractor concerns, issues, disagreements, and recommendations to the appropriate government personnel. When requested, the Ombudsman will maintain strict confidentiality as to source of the concern. The Ombudsman does not participate in the evaluation of proposals or in the source selection process.
