- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. This solicitation is issued as a Request for Quotation (RFQ) and incorporated clauses and provisions in effect through Federal Acquisition Circular 2001-08. The North American Industry Classification System (NAICS) is 513310 and the Size Standard is 500 people. If two or more qualified small businesses respond to the synopsis/solicitation, this acquisition will be set aside exclusively for small business. SERVICE NON PERSONAL: Provide ISDN PRI rated T-1 facility with eleven (11) two way trunks for a period of 12 months. Qualified suppliers believing they can provide the service described above are encouraged to identify themselves. Suppliers must provide a quote. The government must receive all responses within fifteen (15) days after the date of this publication, and will consider all quotes received within fifteen (15) days after the date of this publication. The government will consider responses it receives more than fifteen (15) days after the date of this publication nonresponsive and not consider the same. Interested, qualified offerors should mail responses to DISA, AQN4 so as to arrive not later than fifteen (15) days from the date of this publication. The government will evaluate offers on whether the offered products meet the government's specifications as described above, the offered price, and the past performance of the offeror. Required service date for the service sought by this acquisition is from the effective date of award through 30 Sep 03. Delivery and acceptance is at Kirtland AFB, NM, FOB destination. FAR provision 52.212-1, Instructions to Offerors-Commercial, applies to this acquisition. Offerors shall include a completed copy of the provisions at FAR 52.212-3 with offers. FAR clause 52.212-4 Contract Terms and Conditions-Commercial Items, applies to this acquisition, including the following addendum thereto: Paragraph (c) is tailored as follows: (c) Changes. Changes in the terms and conditions of the contract may be made only by written agreement of the parties with the exception of administrative changes such as changes in paying office, appropriations data, adding additional fund citations, etc., which may be made unilaterally by the contracting officer. CONTRACTING OFFICER: The contracting officer is the only person authorized to approve changes, in writing, to any requirement under this contract. No oral statement of any person whomsoever shall, in any manner or degree, modify or otherwise affect the terms of this contract. In the event the contractor effects any such change at the direction of any person other than the contracting officer, the government shall consider the change to have been made without authority and no adjustment shall be made in the contract price to cover any increase in costs incurred as a result thereof. CONTRACTING OFFICER REPRESENTATIVE (COR): Authorized government point of contact and the COR for this contract shall not, however, have authority to make any change in the contract. FAR clause 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items, applies to this acquisition. The clauses contained therein the contracting officer determined applicable to this action are: 52.219-14, Limitations on Subcontracting; 52.222-21, Prohibition of Segregated Facilities; 52.222-26, Equal Opportunity; 52.222-35, Equal Opportunity for Special Disabled Veterans, Veterans of the Vietnam Era, and Other Eligible Veterans; 52.222-36, Affirmative Action for Workers with Disabilities; 52.222-37, Employment Reports on Special Disabled Veterans, Veterans of the Vietnam Era, and Other Eligible Veterans; and 52.232-34 - Payment by Electronic funds Transfer-Other than Central Contractor Registration (31 U.S.C. 3332); Additional FAR clauses: 52.232-8 Discounts for Prompt Payment (Feb 2002), 52.232-11-Extras (Apr 1984), 52.243-1 Changes-Fixed Price - Alternate I (Apr 1984), 52.247.34 F.O.B. Destination (Nov 1991). DFARS clause 252.212-7001, Contract Terms and Conditions Required to Implement Statutes or Executive Orders Applicable to Defense Acquisitions of Commercial Items, applies to this acquisition. The clauses contained in paragraph b thereof which the contracting officer determined applicable to this action are: 252.247-7023, Transportation of Supplies by Sea. The Government does not currently know if two or more qualified small businesses are capable of meeting this requirement. Therefore, if two or more qualified small businesses respond to the synopsis/solicitation, this acquisition will be set aside exclusively for small business.
