- This is a combined synopsis/request for quotation (RFQ) for the solicitation of commercial items prepared in accordance with the format in the Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation. A written solicitation will not be issued. The solicitation number is IBM03Q0006. Provisions and clauses in effect through FAC 2001-09 are incorporated and made part of this RFQ. The applicable North American Industry Classification System (NAICS) code is 811212, Computer and Office Machine Repair and Maintenance; the small business size standard is $21.0 million. The acquisition is for a firm fixed price requirements contract for the purchase of the following commercial items: Item No. 0001. Supplies/Services-Service Call. Provide on-site maintenance and repairs on a per call routine basis, to include parts and labor, in accordance with the attached Statement of Work (SOW) for IBWC computer equipment located at IBWC Headquarters and various field offices in different geographical locations for the period November 01, 2002 through October 30, 2003. Unit of Issue-Each. Quantity-25; Item No. 0002. Supplies/Services-Service Call. Provide on-site maintenance and repairs on a per call routine basis, to include parts and labor, in accordance with the attached Statement of Work (SOW) for IBWC computer equipment located at IBWC Headquarters and various field offices in different geographical locations for Option Year 1 for the period November 01, 2003 through October 31, 2004 Unit of Issue-Each. Quantity-25; Item No. 0003. Supplies/Services-Service Call. Provide on-site maintenance and repairs on a per call routine basis, to include parts and labor, in accordance with the attached Statement of Work (SOW) for IBWC computer equipment located at IBWC Headquarters and various field offices in different geographical locations for Option Year 2 for the period November 01, 2004 through October 31, 2005. Unit of Issue-Each. Quantity-25. The list of IBWC computer equipment (28 pages) is available upon request by interested individuals. Oral, facsimile and electronic commerce-type delivery orders for Service Calls are authorized in the Schedule. No drawings or schematics are available from this agency. The number of on-site non-emergency calls for on-site repairs for Fiscal Year 2002 (Oct 1, 2001 through Sep 30, 2002) was 22 service calls. The number of routine service calls for on-site maintenance and repairs for Fiscal Year 2001 (Oct 1, 2000 through Sep 30, 2001) was 81 service calls. Fiscal Year 2001 service calls were high in number due in part to aged equipment as compared to Fiscal Year 2002 service calls which were low in number due in part to new equipment. IBWC estimates it will replace agency IT equipment at a rate of 25% per fiscal year, and has budgeted for this 25% rate of replacement. The Government estimates a minimum of 25 service calls will be made to the contractor per fiscal year for the base year and each of the two option years. This estimate is not a representation to offerors that the estimated quantity of 25 service calls for the base year and each of the options years will be required or ordered, or that conditions affecting requirements will be stable or normal. Failure of the Government to order the estimated quantity of 25 service calls per base year and each of two option years will not entitle the contractor to any equitable adjustment in price. The following FAR clauses and provisions apply to this RFQ. FAR Clause 52.212-4, Contract Terms and Conditions-Commercial Items (Feb 2002), and 52.216-21, Requirements (Oct 1995), and are incorporated by reference. Far Clause 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items (DEC 2001) applies to this RFQ and the following clauses cited in the clause apply: 52.222-21, Prohibition of Segregated Facilities (Feb 1999); 52.222-26, Equal Opportunity (E.O. 11246); 52.222-35, Equal Opportunity for Special Disabled Veterans, Veterans of the Vietnam Era, and Other Eligible Veterans; 52-222-36, Affirmative Action for Workers with Disabilities (29 U.S.C. 793); 52.222-37, Employment Reports on Special Disabled Veterans, Veterans, of the Vietnam Era, and Other Eligible Veterans (38 U.S.C. 4212); 52-225-13, Restrictions on certain Foreign Purchases (E.O. 12722, 12724, 13059, 13067, 13121, and 13129); 52.232-34, Payment by Electronic Funds Transfer-Other than Central Contractor Registration (31 U.S.C. 3332). FAR Provision 52.212-1, Instructions to Offerors-Commercial (Oct 2000), is incorporated by reference. FAR Clause 52.216-18, Ordering (Oct 1995) is incorporated in this RFQ by full text as follows: ORDERING (Oct 1995) (a) Any supplies and services to be furnished under this contract shall be ordered by issuance of delivery orders or task orders by the individuals or activities designated in the Schedule. Such orders may be issued from Nov 1, 2002 through Sep 30, 2003. (b) All delivery orders or task orders are subject to the terms and conditions of this contract. In the event of conflict between a delivery order or task order under this contract, the contract shall control. (c) If mailed, a delivery order or task order is considered ?issued? when the Government deposits the order in the mail. Orders may be issued orally, by facsimile, or by electronic commerce methods only if authorized in the Schedule. (End of clause) FAR Clause 52.216-19, Order Limitation (Oct 1995) is incorporated in this RFQ by full text as follows: ORDER LIMITATIONS (OCT 1995) (a) Minimum order. When the Government requires supplies or services covered by this contract in an amount estimated at less than $10.00, the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract. (b) Maximum order. The contractor is not obligated to honor- (1) Any order for a single item estimated in excess of $10,000.00; (2) Any order for a combination of items estimated in excess of $20,000.00; or (3) A series of orders from the same ordering office within three days that together call for quantities exceeding the limitation in paragraph (b)(1) or (2) of this section. (c) If this is a requirements contract (i.e., includes the requirements clause at subsection 52.216-21 of the Federal Acquisition Regulation (FAR), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) of this section. (d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within 1 day after issuance , with written notice stating the Contractor's intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the government may acquire the supplies or services from another source. (End of clause) FAR Clause 52.217-19, Option to Extend the Term of the Contract (Mar 2000) is incorporated in this RFQ by full text as follows: OPTION TO EXTEND THE TERM OF THE CONTRACT (Mar 2000) (a) The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided, that the Government shall give the Contractor a preliminary written notice of its intent to extend the at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension. (b) If the Government exercises this option, the extended contract shall be considered to include this option clause. (c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 36 months. (End of clause) Special Contract Requirement, IBWC 228-72, Compensation and Liability Insurance is incorporated in this RFQ by full text as follows: COMPENSATION AND LIABILITY INSURANCE IBWC (April 2002) The Contractor shall within fifteen (15) calendar days after award of contract provide and maintain minimum insurance as follows: (a) General Liability Insurance for bodily injury and property damage with minimum limits $500,000 each occurrence with an aggregate of $1,000,000. (b) Automobile Liability for bodily injury and property damage with minimum of $250,000 for injury to or death of any one (1) person, $500,000 each accident or occurrence for bodily injury, and $100,000 for each accident or occurrence for property damage liability. (c) Worker's Compensation Insurance for all labor employed on the project who may come within the protection of workers' compensation laws and Employers General Liability with minimum limits of $100,000 each accident, bodily injury by disease $100,000 each employee, $500,000 aggregate. In every case the insurance coverage shall amount to at least the limits stated above. However, where the Financial Responsibility Compulsory Insurance Law of the State in which the project is located requires higher limits, the Automobile Liability Insurance Policy shall provide coverage of at least those limits required by State law. The insurance obtained by the Contractor must (1) be effective for the term of the contract and (2) must name the United States of America by and through the United States Section of the International Boundary and Water Commission, United States and Mexico as an additional insured. The requirement for naming the United States of America as an additional insured does not apply to Worker's Compensation Insurance. Before commencing work under this contract, the Contractor shall certify to the Contracting Officer in writing that the required insurance has been obtained. The policies evidencing required insurance shall contain an endorsement to the effect that any cancellation or any material change adversely affecting the Government's interest shall not be effective (1) for such period as the laws of the State in which this contract is to be performed prescribe or (2) until 30 days after the insurer or the Contractor gives written notice to the Contracting Officer, whichever period is longer. The Contractor's written certification shall be accompanied by either a Certificate issued by the insurer or photocopies of the insurance policies which reflect that the cancellation/change provisions of this contract have been met. The Contractor shall insert the substance of this clause including this paragraph in subparagraphs under this contract and shall require subcontractors to provide and maintain the same limits. At least five days prior to each such subcontractor's personnel commencing work on this project, the Contractor shall furnish (or ensure that there has been furnished) to the Contracting Officer a current Certificate of Insurance meeting the requirements as stated above. (End of Special Contract Requirement) Offerors are instructed to include a completed copy of FAR Provision 52.212-3, Offeror Representations and Certifications-Commercial Items (Apr 2002), and FAR Clause 52.222-48, Exemption from Application of Service Contract Act Provisions for Contracts for Maintenance, Calibration, and/or Repair of Certain Information Technology, Scientific and Medical and/or Office and Business Equipment-Contractor Certification (Aug 1996) with their proposal. A copy of FAR 52.212-3 and 52.222-48 will be provided upon request. The closing date for receipt of quotations is October 28, 2002; 3:00 PM Mountain Standard Time. Interested persons may identify their interest and capability to respond to the requirement or submit quotations. All proposals received by the closing date will be considered by the Government. Offerors must submit the following to be considered for award: 1) A completed copy of FAR Clauses 52.212-3 and 52.222-48; and 2) Unit prices for each contract line item, Items 0001 through 0003. Copies of FAR clauses/provisions may be accessed via the Internet at www.arnet.gov. See Note 1. STATEMENT OF WORK 1. OBJECTIVE The contractor shall provide hardware maintenance for IBWC?s computer equipment located in Texas, New Mexico, Arizona, California, and Washington D.C.. See Attachment A for a complete list of equipment and the location of each. Requirements. The contractor shall: 1) Provide comprehensive ON-CALL/ON-SITE maintenance and spares for all equipment listed. 2) Provide an electronic mail address to coordinate and dispatch all calls, and a local or toll-free help desk as backup in the event of an e-mail failure. 3) Provide ON-SITE repairs with 8-hour response time, (NON-EMERGENCY) Monday thru Friday between 8:00 am and 5:00 pm for each location, exclusive of Government holidays. 4) Provide loaner/replacement equipment equal to or better than that being repaired, for any item not repaired in 48 hours. 5) Provide all necessary parts, labor, supplies, and transportation to accomplish the work. 6) Provide a monthly status report as identified below. 7) Contact manufacturer on the agency?s behalf for warranty items requiring service. 8) Provide authorized, certified technicians to work on equipment. NOTE: Contractor shall provide documentation that technicians are qualified to accomplish the repairs/maintenance described herein. 2. BACKGROUND IBWC has computer equipment located at the headquarters, in El Paso, TX and eleven (11) field office locations. The equipment to be covered includes monitors, CPUs, printers, keyboards, mice, plotters, scanners, cables, modems, etc. See Attachment A for a complete list. 3. DELIVERABLES Upon award of contract: 1) Contractor shall make an inspection of all equipment to ensure equipment in good working order. Any discrepancies shall be presented in writing to the Contracting Officer Representative. 2) Contractor shall provide documentation that their technicians assigned to accomplish the repair/maintenance described herein are qualified to do so. Monthly: Contractor shall provide a summary report listing all calls, items serviced, dates of service, and the details of each call to the Contracting Officer Representative by the 10th of each month. 4. PROGRESS AND COMPLIANCE 1) The required services shall be performed at the various locations indicated on Attachment A. Required tasks shall be performed by the Contractor from time of award to September 30, 2003. ON-CALL/ON-SITE maintenance is defined as maintenance that is performed as often as needed to keep equipment operational, 8 HOURS PER DAY, 5 DAYS PER WEEK, EXCLUSIVE OF GOVERNMENT HOLIDAYS, AT THE GOVERNMENT'S SITE. 2) For items under warranty, (warranty expiration date is greater than October 1, 2003) vendor will place a telephone call to responsible company who carries the warranty ONLY. Contractor's responsibility is limited to the telephone call only. Contractor may NOT, under any circumstances, obligate the Government for any funds. 3) Loan/Replacement Equipment: When the Contractor cannot complete repairs on an item of equipment within 48 hours of notification of normal repairs, the Contractor shall provide, at no additional cost, a replacement system of the same make, model configuration, quality, capabilities, and design specifications. This replacement system can be either a loan or permanent replacement of equipment. Government must be notified in the event of a permanent replacement. 4) The Contractor will work with Government personnel to transfer all data to the loaner equipment and will assure the loaned/replaced equipment duplicates the Government?s equipment in every aspect of operation with exception of the failure. 5) The Government will contact Contractor when equipment malfunctions occur. Contractor personnel shall notify service personnel who will respond to outages with the required time frames. The Contractor shall be responsible for all costs associated with transportation of replacement/loaner/repair equipment to and from a site. The Contractor is also responsible for the equipment from the time it leaves the government site until it is returned in good working condition. 6) All data contained on Government equipment will be safeguarded and may be accessible only to those representative of the IBWC and authorized representatives of the U.S. Government. Some data may be subject to the Privacy Act and, under no circumstances, may be revealed to other than those authorized representatives of the IBWC and authorized representatives of the U.S. Government. 7) When maintenance/repair is required, maintenance/repair shall be performed by Contractor only on identified equipment. The Contractor shall verify that the equipment is listed on the equipment list provided with purchase order at time of award. If Contractor performs maintenance/repair on any equipment not listed on this agreement, Contractor will bear the expense for any and all repair costs. 8) The Contractor shall supervise all Contractor personnel and make work assignments. 5. GOVERNMENT RESOURCES For the period of this contract, the IBWC shall provide the Contractor with the following information: 1) Details of outages or malfunctions of equipment covered by this contract. 2) Details of additions and deletions of equipment from the inventory. 3) Where possible, provide access to any government owned information (books, manuals and guides) that may aid the contractor in performing maintenance of the equipment. 4) Names of Contracting Officer Representative and IBWC contacts, by letter, after award of purchase order. The Government may add/delete up to 25% of the inventory. Additions or deletions of up to 25% of the inventory will be at no additional cost to the Government. The Government will provide the Contractor a list of addition/deletions quarterly.
