General Information Document Type: Presolicitaion Notice Solicitation Number NAAD-1000-3-00091 POSTED DATE: OCTOBER 24, 2002 ARCHIVE DATE: NOVEMBER 8, 2002 CURRENT RESPONSE DATE: NOVEMBER 8, 2002 Classification Code: Legal CONTRACTING OFFICE ADDRESS Department of Commerce, National Oceanic and Atmospheric Administration (NOAA), Acquisition and Grants Office, SSMC4 - Room 7601/OFA61 1305 East West Highway, 7th Floor, Silver Spring, MD 20910 The U.S. Department of Commerce/National Oceanic Atmospheric Administration/Office of General Counsel - GCEL has a requirement to procure contract services to assist in the maintenance of NOAA General Counsel (GC) for Enforcement and Litigations and NOAA Finance's (Finance) civil monetary penalty collection program. The Contractor will be responsible for providing a wide range of functions to ensure that GC's nationwide collection program goals are attained. These functions include the evaluating, monitoring, and collecting of legally enforceable debts. The Contractor will: (1) Demonstrate knowledge and expertise with legislation, regulations, and guidelines pertaining to civil monetary penalties and collections. This includes independently conducting legal and factual research regarding these areas. Advise the Collections Analyst contractor of any changes to these areas; (2) Identify cases that appear to have a legally enforceable debt, but have not been sent to Finance. Work with the enforcement attorneys to determine if the cases are ready to be sent to Finance. Advise the Collections Analyst contractor of such cases; (3) Monitor payment of cases that have been sent to Finance. Advise the Collections Analyst contractor of those cases that have not been paid, including those cases with permits issued in them; (4) Updates Enforcement Management Information System (EMIS) to include payment information regarding Treasury cases returned to GC through Finance. Advise the GCEL paralegal in GC's Silver Spring office if cases are subject to write-off (i.e., EMIS reflects a balance due), and (5) Assist with other case processing requirements and/or duties, as determined by the Assistant General Counsel for Enforcement and Litigation. The overall goals of this requirement is to reconcile EMIS to reflect the amount of debt as supported by the accounting system, provide legal and financial information necessary for the Collections Analyst contractor to take appropriate action on collection cases. Evaluation will be based on the candidates knowledge of legal terms and references; knowledge of financial terms and applications as they relate to Government; knowledge of collections procedures and terminologies, skills with computer software and applications; and oral, written and organizational skills. The Government reserves the right to require oral presentations. Interested parties should provide their response for meeting each of the technical requirements set forth above.
