- NA The Seattle District, Corps of Engineers intends to negotiate on a sole source basis with the Colville Confederated Tribe of Indians of Nespelem, Washington under authority 10 USC 2304 ? (1) for Cultural Resource Management Assistance. This service is to s upply technical expertise unique to the Colville Confederated tribe for Cultural Resource Management task at the Chief Joseph Dam and Woods Lake Project. The Project is entirely within the Colville Confederation Tribe?s ceded lands and the north half of th e project is within the Reservation of the Colville Confederation Tribe. The Colville confederation Tribe is the sole tribe for NAGPRA action in that area and with respect to those sites. The tribe also has assumed the duties of State Historic Preservation Officer for NHPA compliance activity on those lands. There is no other source of expertise in tribal cultural resource interest in that area. Pursuant to the Programmatic Agreement of 27 November 1991 concerning cultural resource management pursuant to th e Intertie Development and use Environmental Impact Statement of April 1988 (IDU PA) and other Acts and Memoranda referenced herein, the Corps of Engineers has special, inviolable trust relationship with Indian tribes whose burial lands or ceded lands are in project areas, particularly with respect to Native American Graves protection and Repatriation Act of 1990 (NAGPRA ? Public Law 101-601 and 43 CFR Part 10, Dept. Of Interior NAGPRA Regulations) and National Historic Preservation Act of 1966, as amended and the Reservoir Salvage Act of 1960, as amended. Action is also pursuant to ER1130-2-438, Collections Management and Curation of Archaeological and Historical Data. This action is also pursuant to Design Memorandum 28, Cultural Resources, Operations and Maintenance Cultural Resources Management Plan. Collected cultural materials will be owned by the Government, but held in trust for the Colville Confederated Tribe. There is no other source of expertise in tribal cultural resource interest in that area. Proposed procurement will result in Firm Fix Price Contract. The North American Industry Classification System (NAICS) Code is 54199 and the Standard Industry Classification Code (SIC) is 7389 with size standard of $6 million. This solicitation will be issued as a Electronic Bid Set (EBS) on Seattle District U.S. A rmy Corps of Engineers Contracting Web page in electronic format only. No disks will be mailed.
