Description
This announcement is a modification of a previous announcement advertised under SP0450-02-R-4965, posted on May 10, 2002. The solicitation number has changed to SP0450-03-R-0759. This is a Commercial CONUS Closed-Loop Re-Refined Oil Program Fixed Price/EPA Requirements Type Corporate Contract Solicitation, intended to put in place a follow-on contract to the current contract SP0450-98-D-4043 [due to expire 07Feb03]. PURPOSE: The purpose of this Closed-Loop Re-Refined Oil Program is to assist U.S. Federal and Military installations in complying with EO 12873 and the Resource Conservation and Recovery Act (RCRA) with regards to the use, recycling, and disposal of Re-Refined Oil. This Closed-Loop Re-Refined Oil Program will be accomplished by supplying re-refined oil to installations (one of the Affirmative Procurement Program Items under RCRA) and providing for pick-up and re-refining of Used Oil. RE-REFINED OIL PRODUCT: The Offeror must provide the following grades of Engine Oil, produced from re-refined base stock, in accordance with (IAW) the corresponding documents: SAE 10W30 IAW A-A-52039B; SAE 15W40 IAW A-A-52306A; 15W40 IAW MIL-PRF-2104G; SAE 80W90 AIW MIL-PRF-2105E. The Offeror must furnish proof that all Engine Oil provided contains a minimum of 25% re-refined base stock. The Offeror, in addition and in accordance with CIDs A-A-52039B and A-A-52306A, must also submit proof that the Mobility Technology Center-Belvoir, Fort Belvoir, VA, has approved their product for use; they must also submit proof that they are on the applicable QPL list of providers IAW MIL-PRF-2104G and MIL-PRF-2105E. Invoicing should be based on standardized F.O. B. unit prices delivered to destination and should include cost for on-site pick up of Used Oil. Offeror must be able to deliver bulk, 55-gallon drums, 5-gallon containers, 5-gallon metal cans, and cased of 12 one-quart plastic bottles, to various requesting facilities in the Continental United States (CONUS). CLOSED-LOOP RE-REFINED OIL PROGRAM: Definition of program: The Contractor shall be responsible for providing all materials, vehicles, equipment, permits, transportation, and any other items/services necessary for the purpose of supporting this Closed-Loop Re-Refined Oil Program at various Federal and Military locations within the Continental United States (CONUS). The successful contractor must be able to both supply Re-Refined Oil and pick up Used Oil for re-refining purposes. The contractor shall also responsible for coordinating the collection of Used Oil with the delivery of bulk shipments to the proper customer point of contact, as designated by the base, camp, or station. This Closed-Loop Program consists of a customer order placement for specific NSNs, pickup of Used Oil (at no additional cost from Contractor) from said customer, re-refinement of Used Oil received, and disposal of contaminated oil IAW environmental rules and regulations. The quantity oil for pick up may vary significantly from the amount of new oil ordered. For quantities of 55 gallons or more, the customer would simply call the nearest contractor location at least 48 hours in advance of needed pick-up. The contractor will then pick up the Used Oil within this 48-hour time frame. The oil will subsequently be returned to the successful re-refined oil contractor for re-refining purposes. The contractor must dispose of all excess oil that is incapable of being re-refined in accordance with (IAW) all Environmental Laws and Regulations. Offeror must be able to recover the Used Oil from underground storage tanks, above ground storage tanks, and 55-gallon drums. Frequency of Used Oil collection shall be on an as needed basis. All collection, re-refining, and disposal of product by the contractor shall be performed at no additional cost to the customer. The Contractor is required to compile and submit quarterly reports to the COR (contracting Officers Representative). These reports shall provide information on the delivery of Re-Refined Oil and pick-up of Used Oil during the said quarterly period. This information shall be broken down by location and quantity in order to facilitate environmental tracking requirements. The Contractor shall agree to assume all liability, under the applicable environmental statutes, arising from the improper disposal, use, or sale of the used motor oil picked up from the participating facilities, pursuant to the terms and conditions of the contract. Contractor shall assume complete and total responsibility for all Used Oil, from commencement of oil pumping (in the Contractor?s possession), through final disposition of the Used Oil. Complete and total responsibility includes full and complete compliance with all EPA, Federal, State, and Local Laws, Codes, Regulations, and Requirements of this Statement of Work (SOW), whether incorporated by reference or specified elsewhere in this SOW or contract document. The prime contractor shall be responsible to completely absolve the Government, including the contracting activity named in a contract award and/or the designated military using activity named in a delivery order and/or contract call requiring delivery and/or pick-up services, from any and all costs attributable to the prime contractor?s and/or its sub-contractor?s (s?) failure to fully and completely comply with all SOW (Statement of Work) and contract requirements. The contractor shall develop a plan that provides a way to add customers nationwide to this program without having to modify the contract. All Federal entities within CONUS are eligible as a customer to participate in the program without further contractual changes. The Contractor shall be responsible for developing the appropriate point of contact at each customer site. PERMIT AND LICENSE: It shall be the sole responsibility of the Contractor to acquire any and all permits, licenses, and/or other required authorizations prior to the commencement of any work/services associated with the Contract. CONTRACTOR PERSONNEL: All workers shall have up-to-date hazardous material and hazardous waste training. The Contractor shall have in place and maintain liability coverage for all on and off-site oil spills as well as subsequent oil spill cleanups. Contractor shall have drug-free workers, a transportation contingency plan, and an EPA I.D. Number. Contractor personnel shall wear clearly visible identification badges for easy recognition/identification and shall also present a neat appearance at all times. This may be accomplished by the wearing of distinctive clothing that bears the company name or by wearing of appropriate uniforms. The Contractor and Sub-Contractors employees must be able to read, write, speak, and comprehend the English language. The Contractor and/or Sub-Contractor must be able to provide sufficient personnel to perform the services required in the contract. They shall also not enlist the aid of personnel not specifically employed by the Contractor and/or Sub-Contractor for the express purpose of performing these services. The Contractor shall be solely responsible for leaving the installation premises as clean as when the services were provided and/or supplies were delivered. The Contractor shall be solely responsible for any and all clean-ups occurring during said process and for proper handling and disposal of all used cleaning materials. Contractor personnel (or any representative of the Contractor) during the performance of the contract, shall abide by all security regulations and requirements of the installation and shall be subject to such checks as may be deemed necessary. The Government reserves the right to direct the removal of any Contractor employee from f any participating base for misconduct for security reasons. Removal of Contractors employees for the above stated reasons does not relieve the Contractor form the responsibility of performance. ELIGIBILITY FOR SERVICES: All CONUS Federal and Limitary activities generating Used Oil in conjunction with the use of re-refined oil products herein described may participate in this program; however, only those who use Used Oil recovered from vehicles/facility equipment shall be eligible. Used Oil presented by participating facilities for the purpose of recycling may contain various grades of use oil, gear oil, and hydraulic oil. The contents of the water and antifreeze, however, must be minimized. Absolutely NO solvents of any type are permitted. If solvents are found in the Used Oil, the Contractor may refuse to pick up such oil. If the Contractor refuses to pick up oil due to above described contamination, the contractor shall immediately notify the appropriate base point of contact. Successful offeror must be capable of providing Re-Refined Oil to Federal and Military Customers anywhere in the Continental United States, pick up Used Oil at no extra cost to the customer or Government, re-refine the Used Oil for use again, and dispose of contaminated Oil IAW EPA and other Federal Laws and Regulations. It is the intent to put into place a Requirements Type Corporate Contract that contains one base and four option terms, all of which will be two years in length.
