- The purpose of this amendment is to : a. Provide answers to questions received concerning the solicitation b. EXTEND THE DATE FOR RECEIPT OF PROPOSALS TO TUESDAY, DECEMBER 10,2002, AT 3:00PM LOCAL TIME. c. Clarify the number of proposals that need to be submitted as follows: one original and one copy. RESPONSE TO QUESTIONS: 1. Are there any particular categories of products that you wish to target in the coming year with the Smokey Bear licensing program? RESPONSE: No, it will be the purview of the contractor to solicit and suggest marketing opportunities. An upcoming event is the 60th birthday of Smokey Bear in 2004 and the expectation is that some new products may be developed for the event. 2. When is the proposal due? The original announcement contains no due date.12/02-2002 RESPONSE: It has been extended to December 10, 2002, 3:00pm, local time. 3. Who approves licensing deals and products submitted for approval ? the USDA Forest Service, the Ad Council, the National Association of State Foresters ? or all three in combination? RESPONSE: It depends on the nature and the extent of the product and how it may impact the overall prevention program. The Cooperative Forest Fire Prevention Committee (CFFP) is the formal venue for the three associations provided in the Federal Law, however, they do not meet and consider each product. Communications are usually electronic when necessary. The extent of the review will depend on the nature of the request. The FINAL approval remains with the USDA Forest Service, Fire and Aviation Management. Is there an approval process? RESPONSE: YES Does it consist of a committee? It could, depends on the nature of the proposal. A single person? RESPONSE: Usually more than one person will review the product the FINAL decision rests with the USDA Forest Service. 4. Who are the current licensees (i.e.licensed vendors)? RESPONSE: Posted on web at www.ccc-mcclean.com Are the deals ?Exclusive? or ?Non-exclusive??. RESPONSE: Generally non-exclusive for products unless the licensee has trademarks or patents on their specific products. However, in the interest of a perspective licensee it may be good to inform them that the market has been covered with a specific type of product such as coffee mugs or T-shirts. 5. Has the program ever had more than 49 licensed vendors? RESPONSE: YES (b) If so, what was the largest number and in what year? RESPONSE: The number varies as vendors drop out and others are added, however, the number in recent years at any one time has been in the high 40s and low 50s. The contracts are staggered and different ones come due at different times creating a difference in the total numbers at any one time. 7. How is the current licensing contractor paid? Is it a percentage of royalties? RESPONSE: YES; If so, what percent? RESPONSE: Do include the rate you propose as a percentage in your proposal. 8. Does the licensing contractor collect the royalties? RESPONSE: No, they are sent directly to the USDA Forest Service and the contractor prepares accounts and bills quarterly. See Statement of Work for details. 9. What associations must the licensing contractor be a member of? RESPONSE: No ?must? list exists, however, it is expected that the contractor is active in those associations that promote marketing and licensing of products. Include such a list of memberships or associations in your proposal. 11. How would a licensing contractor be evaluated by the party(ies) responsible for maintaining the Smokey Bear licensing program? RESPONSE: Performance Based Contract. See the Statement of work. 12. Please describe the audit process for licensees. Is every licensee audited every year? Are the audits conducted by the licensing contractor or by subcontractors local to each licensee? In fact, are the audits conducted in person or is there simply a document request? Who pays for the cost of auditing? RESPONSE: There is currently not a satisfactory system in place. You should consider the best auditing process and make it part of your proposal. The cost will be part of the contractor's responsibility.
