- EXTEND THE DATE FOR RECEIPT OF PROPOSALS TO TUESDAY, DECEMBER 10, 2002, AT 3:00PM LOCAL TIME. This notice is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional iformation included in this notice. NAICS 541613. This announcement constitutes the only solicitation, proposals are being requested and a written solicitation will not be issued. This solicitation document incorporates provisions and clauses which are in effect rthought Federal Acquisition Circular 01-08. Applicable FAR clauses are incorporated by reference: Prompt Payment 52.-1 (4/84); Instructions to Offerors-Commercial Items 52.212-1; Evaluation-Commercial items 52.212-2 (10/97); Offeror Representations and Certifications 52.212-3 (10/98); Contract Terms and Conditions - Commercial Items 52.212-4 (05/01); Contract Terms and Conditions Required to Implement Statutes or Executive orders-Commercial Items 52.212.-5 (10/98). ALL RESPONSIBLE SOURCES MAY SUBMIT A PROPOSAL FOR CONSIDERATION. Simplified procedures will be used. Offers to include Tax Payer Identification Number, DUNS number and business size. BACKGROUND: The USDA Forest Service Cooperative Fire Prevention Program is a comprehensive information and education awareness program that uses Smokey Bear as the vehicle for forest fire prevention messages. The program uses a variety of techniques and approaches to stimulate active support and cooperation with other public agencies, educators, business industry and organizations in working to prevent human caused wildfires. Smokey Bear and prevention messages were introduced in 1944. By the 1950s, the icon and message were successful enough to warrant being protected by Federal law. The Smokey Bear Act. PL 82-359 and amended PL 93-318 were passed to provide protection for his image and use and allow for the collection of royalties. The law authorized the commercial use of Smokey Bear with permission of the USDA Forest Service, in consultation with the Ad Council and the National Association of State Foresters. It permitted the secretary of Agriculture to license the use of Smokey Bear and collect royalties and secure them in a fund to be used only for the prevention of forest fires. That authority has been delegated to the Forest Service. The current licensing program was established in 1952. A licensing contractor has managed the vendor licensing for the last ten years. Currently (2002) the program has 49 licensed vendors. This program has roughly maintained this number since 1997. The annual royalties are approximately $100,000. SCOPE OF REQUIREMENTS: The purpose of commercial licensing of Smokey Bear and his message is to increase awareness of human caused fires through message exposure and to generate royalties for fire prevention program initiatives. However, commercial licensing ventures must retain the original purpose of the symbol and his current message ?Only You Can Prevent Wildfires.? The Image and appearance of all licensee products must meet established guidelines and standards for quality control. This includes review and approval of all artwork, costume, association, context and presentation of the trademark symbol by the USDA Forest Service in consultation with the National Association of State Foresters and the Ad Council. Final approval of all proposals, products and licensing is the responsibility of the USDA Forest Service, Fire and Aviation Management, Fire Prevention Officer. Background on the Smokey Bear fire prevention campaigns can also be found on the web site smokeybear.com The objectives of the commercial licensing for Smokey Bear are to: Manage the licensing vendors, keeping applications current and reviewing new products and opportunities. Research and promote products that communicate a clear fire prevention message. Protect the image and integrity of the Smokey Bear as a fire prevention symbol. Encourage private enterprise. Provide income to be used for fire prevention programs. Maintain image and appearance of all licensee products within the intent of the Smokey Bear fire prevention program. The contractor must be capable of maintaining a web site containing the current listing of all licensed companies, providing forms on how to apply and contact information. The contractor must have the computer hardware, soft ware and telecommunication equipment to prepare contracts and send and receive electronic communications. RESULTS and OUTPUTs: The contractor must be capable of marketing the licensing program. They will participate in licensing events and prepare an annual proactive marketing plan. The contractor must be a member or join relevant associations. The contractor will seek new licensees and maintain the current licensees. The contractor will provide technical assistance and advice to licensees and the USDA Forest Service on marketing and licensing of Smokey Bear within the law and fire prevention goals of the symbol. Implications or Outcomes: The contractor shall demonstrate how each of the following will be achieved and will address each in the annual marketing plan: Reach and penetrate the target markets for children and adults; Increase Smokey Bear visibility with the public. Increase revenue via the royalties received from licensees. TASKS/DELIVERABLES: The contractor shall maintain records and prepare contracts for all licensees. contractor will prepare and maintain all contracts for licensees who are either renewing or submitting new contracts for approval. Completed contracts shall be submitted to the USDA Forest Service within fifteen days of approval. Contractor will maintain web site with listings of licensees and products and information about the licensing program including forms and contact information for licensees. Submit a quarterly report containing all revenues submitted by licensees and invoice for percent of revenue to the USDA Forest Service. The contactor shall demonstrate outreach and marketing accomplishments. he contractor will summit a quarterly contact log of marketing and outreach activities. The contractor will generate all letters of approval or denial to potential licensees, submitting copies to the USDA Forest Service. The contractor shall report, investigate and respond to companies producing Smokey Bear products without a license. The Contractor will respond to reports of Smokey Bear products on the market that are not licensed. The contractor will investigate the report, determine the source of the product and require them to submit products for license. Failing in obtaining a proper license the contractor will issue a letter to desist and refer the matter to the USDA Forest Service for further action. The contractor will maintain a log of reports and investigations and outcomes and submit quarterly to the USDA Forest Service. The contractor will conduct audits of Smokey Bear Licensees and advise the USDA Forest Service on any necessary remedial actions for any licensee in noncompliance with the royalties. FORMAT, CONTENT & SCHEDULE of DELIVERABLES: The contractor shall submit all documents electronically to USDA Forest Service Fire and Aviation, Fire Prevention Officer. Submit quarterly (March, June, September December) current Licensee List quarterly on a spread sheet including: Company, Contact name and phone, License Number and dates of contract, Products Licensed, and Status (reports submitted, agreements, royalty payments current)Submit quarterly revenues submitted from licensees; Submit quarterly Invoice for payment based on royalty percent. Summit a quarterly contact log of marketing and outreach activities. Submit a quarterly report on any investigations of unlicensed products and the outcome. Prepare an annual marketing plan by December1. Submit copies of correspondence of approval or rejection. Submit results of licensee audits. ACCEPTABLE DOCUMENTS: The Smokey Bear Act. Acceptance Criteria: Contractor progress will be monitored on a quarterly basis by the USDA Forest Service Fire and Aviation Management Fire prevention Officer. Program elements will be discussed with contractor on a quarterly basis. The process of inspection will include: Contractor submission of quarterly reports, maintenance of licensee listing and web page, prompt and accurate submission of contracts, outreach efforts, prompt and accurate correspondence and response to licensees. The USDA Forest Service will review quarterly and provide back in any areas of noncompliance. Areas of non-compliance and contractor feedback will be revisited within two weeks or at the next quarterly review. The Government will award a contract resulting from this solicitation to the responsible offeror whose offers conforms to specifications and will be the most advantage to the Government.
