- Description
- The Securities and Exchange Commission intends to award a fixed-price contract to provide Broad Mind Software License and Web-based Software Maintenance to SEC Headquarters in Washington, DC. Parties interested in and capable of providing this product shall submit their proposal (demonstrated technical capabilities and price) on or before January 15, 2003, 3:00pm EST. The North American Industry Classification System (NAICS) for this software is 541511. Please identify whether or not you are a small business based upon this NAICS. This announcement is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR 12.6 as supplemented with additional information included in this notice. SEC Reference Number 03-02-DC is being issued as a Request for Quote (RFQ). The Government will not issue a separate written RFQ as all items are identified under this notice. Interested parties may identify their interest and capability by submitting a written Capabilities Statement with price, technical capabilities, and past performance included to the US Securities and Exchange Commission, attention Debby Chapman. Electronic quote submission is encouraged at chapmand@sec.gov, but the quote may be faxed to (703) 914-9226. All quotes shall be marked ?Quote? to the attention of Debra Chapman, and include the SEC Reference number clearly on the first page. This solicitation document and incorporated FAR provisions and clauses are those in effect through Federal Acquisition Circular 2001-10 issued 22Nov02. Offerors must also demonstrate the ability to meet the following minimum, mandatory performance requirements for Line Item 001: Annual Software License and Web-based Software Maintenance. The period of performance is for 12 months. The SEC has a requirement to purchase software and maintenance to serve as an answer tool for the public who contact the SEC with investor questions. This software is to eliminate staff time spent issuing duplicative responses to investor questions. This software shall allow members of the public to ask questions through the ?Fast Answers? section of the SEC?s website and receive a menu of relevant answers instantly. The answers shall be retrieved by the software based upon the words chosen by the member of the public in his or her typed question. The user shall be allowed to send an email to the SEC if the search results do not answer the question, or if the user wants to ask other questions. This software shall allow the SEC to serve thousands of investors without a corresponding increase in the number of emails the SEC receives. The software shall also provide a research tool and Question and Answer (Q&A) database for SEC?s Investor Specialists. The SEC shall be able to add new questions and answers to the ?Frequently Asked Questions? database. The software shall allow the SEC to customize email responses to its customers and shall allow the SEC to edit and delete existing questions from the database. The software shall have an unlimited number of categories and topics within a single Q&A knowledge base. The software product shall permit the SEC to build and connect multiple knowledge bases across various offices or divisions within the SEC. Service shall begin ASAP after receipt of order. The Government?s award decision will be based on a best value evaluation of all proposals received in accordance with the following FAR clauses and provisions that apply to this acquisition and may be obtained from the web site http://www.arnet.gov/far/: FAR 52.212-1, Instructions to Offerors, Commercial; FAR 52.212-3, Offeror Representations and Certifications-Commercial Items (Offerors must submit a completed copy with their offers); FAR 52.212-4, Contract Terms and Conditions required to Implement Statutes or Executive Orders ? Specifically, the following clauses cited are applicable to this solicitation: 52.203-3 Gratuities, 52.203-6 Restriction on Subcontractor Sales to the Government; 52.203-7 Anti-Kickback Procedures; 52.222-3Convict Labor; 52.222-26 Equal Opportunity; 52.222-36;Affirmative Action for Handicapped Workers; 52.222-41Service Contract Act of 1965; 52.223-6 Drug Free Workplace; 52.225-3 Buy American Act-Supplies; 52.227-3 Patent Indemnity; 52.232-1 Payments; 52.232-8Discounts for Prompt Payment; 52.232-33 Payment by Electronic Funds Transfer--Central Contractor Registration; 52.233-1 Disputes; 52.233-3 Protest After Award; 52.243-1 Changes-Fixed Price; 52.249-1 Termination for Convenience of the Government (Fixed Price) (Short Form); FAR 52.212-2, Evaluation Commercial Items: (a) The Government will award a contract resulting from this solicitation to the responsible and technically acceptable offeror whose offer conforming to the solicitation will be the most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers; (1) technical capability of the item offered to meet the Government requirement as specified in this synopsis/solicitation; (2) price; (3) past performance. Offerors shall submit 5 references to include products that meet the requirements of this RFQ. Items (1) and (3) are more important than (2), however the closer items (1) and (3) become technically, the more important (2) becomes. (b)The Government reserves the right to award a contract to a technically superior offeror who is higher in cost. When technical proposals are evaluated as essentially equal, cost may be the deciding factor. (c) The Government reserves the right to make an award on the initial quote without discussions. (d) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time frame for acceptance specified in the offer shall result in a binding contract without further action by either party.
