- This document is for commercial items and is prepared in accordance with the format in Subpart 12.6, as supplemented with additional information contained in this notice. This document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2001-11. The NAICS code is 541611 with a small business size standard of $5.0 million It is the intent of the National Library of Medicine (NLM), under the National Institutes of Health (NIH), to continue to procure the professional acquisition support services from Dennis E. Black, Ph.D., 3 Locust Drive, Thurmont, Maryland 21788. Dr. Black will continue to accomplish the following tasks: (1) review and edit intellectual property transactions to ensure compliance with the Federal Acquisition Regulation (FAR) and other Federal law, including reviewing and editing software license agreements to protect NLM?s interests, and coordinating revisions to commercial licenses; (2) provide instruction and training to NLM program and acquisition staffs in reviewing terms and conditions under commercial license agreements; (3) conduct studies and analyses in monitoring NLM?s acquisition function; (4) prepare draft acquisition-related documentation; (5) perform acquisition and related business support tasks for the NLM acquisition function, and (6) perform other acquisition and related business support tasks as required by the Project Officer. NLM has determined that Dr. Black?s previous experience, as well as his knowledge, skills, and understanding of NLM?s acquisition function uniquely qualify him as the only source capable of successfully providing the necessary technical services. In addition, he will not require orientation to NLM?s acquisition activities. This notice of intent is not a Request for Quotation (RFQ), nor is an RFQ available. However, all responsible sources may submit a response in a timely manner, which will be considered by NLM. Sources interested in responding to this notice must be able to provide convincing evidence that it can provide the services as specified above. A determination by the Government not to compete this proposed acquisition will be based upon responses to this notice and is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. The contractor shall comply with all applicable Federal, State, and local laws, executive orders, rules and regulations applicable to its performance under this order.
