- Section 2801 of the National Defense Authorization Act for Fiscal Year 1996, Public Law 104-106, 110 Stat. 186 (10 U.S.C. 2871-2885), as amended by the National Defense Authorization Act for Fiscal Years 2001, 2002, and 2003 provides a series of powerful authorities that allow the Department of Defense (DOD) and the military services to work with the private sector, nationwide, to build and renovate family housing and ancillary facilities in key areas of need. The Department of Navy (DON) intends to utilize the unique powers and authorities provided under the legislation to ensure that safe, good quality, energy efficient, well-managed, affordable housing will be available to military families, as needed, over the long term at Halsey Terrace, Radford Terrace, Moanalua Terrace, Hokulani, and McGrew Point, Oahu, Hawaii. Accordingly, the DON intends to become a partner in a public-private partnership or a similar business entity to provide such housing. Subject to the limitations of the authorities provided, the DON will contribute up to $25.0 million, up to 2,003 existing units of DON-owned and DON-occupied family housing, renovation of 942 units, demolition of 961 units, replacement of 906 units, for an end state of up to 1948 units. The DON envisions the private partner (managing member) securing debt and/or contributing equity, as needed, over the long term to carry out the project. Acting on behalf of the partnership, the private partner will own, operate, manage and maintain the existing inventory of DON-owned family housing units, and any new and replacement units constructed, including site infrastructure, for a term of 50 years. In addition, the DON will reserve the right, as noted in the solicitation and stated in the business agreements to be executed, to utilize the business entity to be established via this program to address the privatization of additional family housing units at Navy Region Hawaii, Pacific Missile Range Facility (PMRF) Kauai, Marine Corps Base Hawaii (MCBH) Kaneohe, Camp Smith, Manana or other areas subject to prior Congressional approval. This acquisition will be conducted by the Commanding Officer, Pacific Division, Naval Facilities Engineering Command, Pearl Harbor, Hawaii. In Step 1 Request for Qualifications (RFQ), interested parties shall submit a Statement of Qualifications, in conformance with the outline contained in the RFQ, describing their concept for development and approach to operate and manage the project; past performance with regard to developments of a similar nature, scope and scale; and financial capabilities and capacities. Based on its evaluation of the RFQ submittals, the DON will invite not more than 4 offerors judged best qualified, to respond to the Step 2 Request for Proposals (RFP). THE STATEMENT OF QUALIFICATIONS WILL BE DUE ON 21 FEB 2003 AT 2:00 PM HAWAII STANDARD TIME. This solicitation will be conducted in accordance with the terms and conditions contained in Section 2801 of the National Defense Authorization Act for Fiscal Year 1996, Public Law 104-106, 110 Stat. 186 (10 U.S.C. 2871-2885). The Government intends to issue this solicitation exclusively through the Internet. It is anticipated that the RFQ/RFP will be available on or about 17 January 2003 as Solicitation N62742-02-RP-00001 on the Internet at http://esol.navfac.navy.mil. Prospective offerors are encouraged to register themselves on the web site. The official plan holders' list, a list of all parties who have registered and requested a copy of the RFQ/P will be maintained and can be printed from the web site. Amendments will be posted on the web site for downloading. This will normally be the only method of distributing amendments; therefore, IT IS THE OFFEROR?S RESPONSIBILITY TO CHECK THE WEB SITE PERIODICALLY FOR ANY AMENDMENTS TO THIS SOLICITATION.
