Description
The USDA, Agricultural Research Service, Appalachian Farming Systems Research Center (AFSRC), 1224 Airport Road, Beaver, WV requires the Contractor to furnish and deliver Feeder Lambs (whethers) to the Research Farm site located approximately 12 miles from AFSRC, for grazing studies in accordance with the terms, conditions, and specifications contained in this document. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. A written solicitation is available at http://www.eps.gov. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 97-11. Solicitation 01-3615-03, Request for Quotation (RFQ) is unrestricted under NAICS 424520 with a business size of 500 employees. The Government contemplates awarding a Firm-Fixed Price-Economic Price Adjustment contract as a result this Solicitation. CONTRACT TYPE - The Government intends to award a Firm Fixed-Price with Economic Price Adjustment for the Base Period beginning April 1, 2003 through March 31, 2004 plus two (2) 12-month option periods. SCHEDULE OF ITEMS: The Base Period of Performance shall be April 1, 2003 through March 31, 2004; ITEM 01: Feeder lambs, whethers, 65 pounds average weight, QTY: 60 each; UNIT PRICE: $______; AMOUNT:$______. ITEM 01A: Feeder lambs, whethers,65 pounds average weight, QTY: 120 each; UNIT PRICE: $______; AMOUNT:$______. The First Option Period of Performance shall be April 1, 2004 through March 31, 2005; ITEM 02: Feeder lambs, whethers, 65 pounds average weight, QTY: 60 each; UNIT PRICE: $______; AMOUNT:$______. ITEM 02A: Feeder lambs, whethers,65 pounds average weight, QTY: 120 each; UNIT PRICE: : $______; AMOUNT:$______. The Second Option Period of Performance shall be April 1, 2005 through March 31, 2006; ITEM 03: Feeder lambs, whethers, 65 pounds average weight, QTY: 60 each; UNIT PRICE: $______; AMOUNT:$______. ITEM 03A: Feeder lambs, whethers,65 pounds average weight, QTY: 120 each; UNIT PRICE: $______; AMOUNT:$______. TOTAL CONTRACT COST FOR LINE ITEMS 01, O2 AND 03; $______; TOTAL CONTRACT COST FOR LINE ITEMS 01A, O2A AND 03A; $____. NOTE: ONLY 1 ITEM WILL BE SELECTED IN EACH PERIOD OF PERFORMANCE. THE GOVERNMENT RESERVES THE RIGHT TO MAKE A SINGLE OR MULTIPLE AWARDS TO OBTAIN THE NECESSARY QUANTITY. The cost of the animals acquired during option year period will be negotiated based on the livestock market prices published in the "USDA Livestock Market News" (West Virginia Department of Agriculture, Charleston, WV area) at the time the option is exercised. Exercising the Option period will be at the Government's sole discretion. CERTIFICATION STATEMENT FOR COMPLIANCE OF THE HUMANE SLAUGHTER ACT - The Contractor is required to provide the following statement with the offer: "The supplier agrees that livestock slaughtered outside the United States, its possessions, and Puerto Rico, conform to the requirements of the Humane Slaughter Act of 1958 (7 U.S.C. 1901-1906)." (Signature), (Date),(Company Name). SPECIFICATIONS - The Contractor shall furnish and deliver the Lambs with the following specifications: QUANTITY: Contractors must provide a minimum quantity of 60 animals and a maximum of 120 animals per performance period. Quantities for each performance period are expected to be the same, but may be adjusted due to weather conditions and research program changes. AGE: Not more than 5 months of age and with verification documentation. WEIGHT: Average weight of the Lambs must be not less than 60 pounds and not more than 75 pounds at time of delivery. Weights must be within a 10 lb. spread (i.e. if the average lamb weight is 65 lbs., then lambs must weigh between 60 and 70 lbs.) VACCINATIONS: An accredited veterinarian must give vaccinations/injections in accordance with state and federal regulations. Animals are required to have the following vaccinations: CD/T at approximately 2 weeks of age and CD booster at approximately three (3) weeks later. The Contractor is required to provide a copy of their active external and internal parasite control plan. ANIMAL CHARACTERISTICS: 1) Prefer all Male/whethers. Will consider ewe and whether lamb combinations if animals are in multiples of six (6). 2) Of like genetics, preferably from a single source/farm and not co-mingled with other one flock; or if from different flocks, must be identified and be in multiples of six animals of the same sex. Deviations may be considered and must be identified as such. Contractors are required to provide a description of the ewe and ram genetics with the offer. 3) If from different flocks, animal origin must be from within a one-hundred mile radius and similar environment to Beaver, West Virginia. 4) Must be castrated, docked and fully healed upon receipt. 5) The Contractor shall be responsible for weighing the animals on certified scales, tested by appropriate authority, at the Contractor's premises. 6) Animals are to be healthy, with no overt signs of disease, and free of injury, active lameness, respiratory disease, scars from injury or disease upon delivery. 7) Animals must be out of a flock with an active external and internal parasite control plan in effect. 8) The Contractor is required to follow standard industry practices regarding handling, identification (ear tag) of animals, health care, vaccination sites, and transportation that will ensure a safe delivery at the destination. 9) The Contractor shall deliver the animals within eight (8) hours of loading on the vehicles and may not be trucked more than 100 miles from place of origin to minimize shipping stress. 10) Animals shall be weighed on certified scales tested by appropriate authority at the Contractor's premises and documentation on the animal weight shall be provided with each shipment. 11) Animals must be weaned prior to transport and accustomed to eating hay and concentrate. Animals should not be over-conditioned from creep feeding. The Contractor shall: 1) allow the Government's screening committee the right to refuse any animal that does not meet the minimum criteria for frame, muscle, body conditions, or any animal deemed to unhealthy or have an undesirable disposition; 2) be required to remove nonconforming animals from government property in an expeditious manner; 3) replace the quantities for any nonconforming items within 7-10 days after the animal is rejected; and 4) comply with all requirements of the Animal Welfare Act. GOVERNMENT RESPONSIBILITIES - The Government shall: 1) Upon delivery: a) immediately inspect the animals for compliance with the terms and conditions of this contract; b) Not accept any (nonconforming) injured, dead, or diseased or with blemishes or active cases of pinkeye or scars resulting from Pinkeye, animals found in the shipment and will not be charged for the same; c) Allow the screening committee the right to refuse any animal that does not meet the minimum criteria, or any animal deemed to unhealthy or have an undesirable disposition. 2) Increase/decrease the quantities required for each performance period or not exercise an option due to a drought or a change in the research program. 3) Market the animals through local livestock services or slaughtered in accordance with Agency regulations. 4) Not be responsible for obtaining the required documentation for the Contractor. 5) Notify the Contractor not later than February 1st of the quantity required for each option period. 52.217-7 OPTION FOR INCREASED QUANTITY - SEPARATELY PRICED LINE ITEM is amended to include a (30) calendar day notice to the Contractor. 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT is amended to include: (30) days prior to Contractor expiration with intent to extend at least (30) days prior to the Contractor. The total duration of this contract, including the exercise of any options under this clause, shall not exceed three (3) years. PACKING AND SHIPPING - The Contractor shall comply with all requirements of the Animal Welfare Act. Animals shall be shipped in proper enclosures to protect from weather elements and in a manner that will insure a safe delivery at destination. The Contractor shall ship the animals in accordance with standard commercial practices that will ensure a safe delivery at the destination. Animals must not be trucked more than eight (8) hours from the original place of origin to minimize stress on the animal. Containers and closures shall comply with the International Commerce Commission regulations, Uniform Freight Classification Rules, or regulations of other carriers, as applicable to the cargo and the mode of transportation. The animals and documentation to be furnished shall be delivered, all transportation charges paid by the Contractor. DELIVERY - The animals and required documentation shall be delivered on or after April 15, 2003 through April 30, 2003 for the base performance period and for each option year performance period, as mutually agreed upon in writing by both parties. Deliveries are not to be split. Additional deliveries may be required for increased quantity in accordance with FAR Clause 52.217-7. Additional delivery dates will be subject to written agreement by both parties. Delivery shall be made in accordance with FAR Clause 52.247-34, F.O.B. Destination clause to: USDA, ARS, NAA, Appalachian Farming Systems Research Center, Research Farm site (exit #133 off 64 E. from Beckley, WV) located approximately 12 miles from the AFSRC, 1224 Airport Road, Beaver, WV 25813-9423. The Contractor is required to follow standard industry practices regarding handling, identification (ear tag) of animals, health care, vaccination sites, and transportation that will ensure a safe delivery at the destination. The Contractor shall arrange with the COR a delivery date/time and obtain specific driving instructions to the USDA, ARS, AFSRC. Delivery shall be made within the hours of 8:00 a.m. to 3:30 p.m., Monday through Friday, excluding Federal holidays and shall be coordinated with the COR. DOCUMENTATION - 1) The Contractor shall provide with their offer the following documentation: a) Items identified in Addenda to FAR Clause 52.212-1 (1). 2) The Contractor shall provide upon delivery the following documentation: (a) The purchase order number; (b) The individual Animal Identification Number, age, genetic background; weight at delivery; health care provided, date(s) and administration of vaccination type(s); parasite control plan (including deworming, and lice control, etc.); Route of administration (SubQ, IM, nasal, oral, or external-pour-on) and the specific Product Name and Lot Number; and (c) All standard reports with each shipment in accordance with industry practices. ADDITIONAL QUOTATION INFORMATION - Facsimiled offers are not acceptable. PROVISION FAR 52.212-1, INSTRUCTIONS TO OFFERORS - COMMERCIAL ITEMS applies to this acquisition. ADDENDA TO FAR CLAUSE 52.212-1 - 1. Item (b) Submission of Offers is amended to include the following: a) A copy of the State Department of Agriculture Livestock License; b) A list of the type of animal breed(s); c) A list of the description of the ewe and ram genetics, animal origins and environment of the flock that will be offered; d) A copy of the active external and internal parasite control plan and vaccinations; e) Submit your offer (pages 1 through 3)-Complete Blocks 12, 17a, 17b, 30a, 30b, and 30c; f) Acknowledgement of amendments (if any); g) Section A.2, Pricing (pages 4 and 5); h) Section A.3, Certification Statement for Compliance of the Humane Slaughter Act (page 5); i) Section D.4, Evaluation Criteria (pages 27 and 28); j) Section D.5, Representations and Certifications (pages 29 to 37). The offer shall be mailed to the attention of the Contracting Officer at USDA, ARS, 600 East Mermaid Lane, Wyndmoor, PA 19038-8598, and received by 3:30 p.m. (local time) on January 29, 2003. FAR CLAUSE 52.212-2 EVALUATION - COMMERCIAL ITEMS - (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: (1) Technical capability of the item offered to meet the Government requirement; (2) Past performance; and (3) Price. Technical and past performance, when combined, are equal, when compared to price. Both Technical and Past Performance shall be rated on a PASS/FAIL basis. (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. ADDENDUM TO FAR CLAUSE 52.212-2 - A. Item D.3(b) is revised to "Options will be evaluated based on quoted prices without the EPA." B. EVALUATION FACTORS FOR AWARD-FAILURE TO PROVIDE THE INFORMATION RELATIVE TO EACH EVALUATION FACTOR MAY RENDER YOUR OFFER NON-RESPONSIVE. OFFERS SUBMITTED ON THE BASIS OTHER THAN F.O.B. DESTINATION WILL BE REJECTED AS NONRESPONSIVE. The Government intends to make an award based on the technically acceptable offer with the lowest evaluated price offering the best value to the Government, price and other factors considered. Listed below are all the factors that will be considered. 1) TECHNICAL CAPABILITY OF THE FIRM - will be based on submission of the following: Each offeror is required to submit: 1) one copy of the company's State Department of Agriculture Livestock License, 2) Humane Slaughter Act statement and certification, any other documentation for the item to show how the offered product meets or exceeds the requirements as specified in the Specifications; and 3) Deviations may be considered and must be identified as such; 4) Contractors are required to provide a description of the ewe and ram genetics; 5) Provide a list of the type of animal breed(s) that will be offered, animal origins and environment of the flock in accordance with the Specifications. 2) PAST PERFORMANCE - Past performance history may be based on the Contracting Officer's knowledge of any previous history of this type of work, customer surveys or any other verifiable information available to the Contracting Officer. In order to be considered for a contract award, Contractors shall provide a list of five (5) contracts of a similar nature and complexity that the were awarded within the past three (3) years or that is/are currently in force. This information must be submitted with your offer. For each contract, list the following: 1) Name, address, and telephone number of the contracting organization, the Project Officer and Contracting Officer. 2. Contract number, type, description and dollar value. 3. Date of contract and period of performance. 4. List any contract(s) terminated for convenience or default (partial or complete) within the past three (3) years. Include the contract number, name, address, and telephone number of the terminating officer. 3) PRICE - Price includes all costs (i.e., animals, vaccinations, transportation, discount terms, etc.) Offers shall be evaluated based on lowest quoted prices inclusive of all option periods without the EPA. The overall lowest cost shall be determined by totalling items 01, 02, and 03 and totalling items 01a, 02a, and 03A. After award, the cost of the livestock during the option periods will be redetermined based on the livestock market prices published in the "USDA Livestock Market News" and the EPA clause. CLAUSE FAR 52.212-3, OFFERORS REPRESENTATIONS AND CERTIFICATIONS - COMMERCIAL ITEMS is included by reference. The Contractor must complete and submit the entire clause with the offer. Item (g) Invoice is amended to include the following: a) The invoice shall be submitted in an original and one copy after delivery and acceptance of each shipment. Invoices shall be returned if the following information is missing: 1) The purchase order number; 2) The VID number from block 10 on the purchase order placed directly under the Remit To Address; 3) an identification by the purchase order line item, description, amount, shipping and transportation costs, and other charges (listed separately). The invoice shall be mailed to: USDA, ARS, North Atlantic Area (NAA), Appalachian Farming Systems Research Center (AFSRC), 1224 Airport Road, Beaver, WV 25813-9423, Attn: Iris Lilly. 3. Item (g) (1) (x) (A) is amended to include: The Contractor must call USDA-NFC at 1-800-421-0323 to enroll in EFT. b) Invoices may be paid by a Visa Credit Card in accordance with FAR 52.232-36.
