- Description
- This is a sole source, combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, and the test program outlined in FAR 13.6 as well as supplemental information provided herein. This non-competitive action will be processed in accordance with FAR 6.301-1 (Only one responsible source and no other supplies or services will satisfy agency requirements). The Patent and Trademark Office plans to award this commercial item procurement as a purchase order utilizing simplified acquisition procedures in accordance with FAR 13.6. The purchase order will be awarded to Open Text Inc., Bannockburn, IL for a base year with three option periods to extend PTO's site license and software maintenance, allowing unlimited utilization of BRS, Net Answer, DW II Publisher, CD Author, and CD Answer software as well as the following software modules QBE Server, Classification Server and Categorization Server. Open Text procured the proprietary rights of the products listed above from Dataware, Inc. in 2001. Open Text Inc. is the sole source for this proprietary software product as well as the only source authorized to provide maintenance for the products included in this site license agreement. BRS as well as all of the other software products listed above are critical to the daily operations at the U. S. Patent and Trademark Office. This announcement constitutes the RFP and is the only solicitation that will be issued. A sole source proposal is being requested pursuant to this announcement. This solicitation incorporates all of the applicable provisions and clauses in effect through FAC 01-12 as if stated in full text, as well as the terms and conditions of FAR 52.212-1. A firm fixed priced purchase order will be issued as a result of this proccurement. A proposal shall be delivered to the Patent and Trademark Office, Office of Procurement, 2011 Crystal Drive, CPK 1, Suite 810, Arlington, VA 22202, Attention: Ms. Joan Hanicak, no later than 2:00 PM (EST), Feb. 07, 2003 with an award anticipated by Feb. 10, 2003.
