- Description
- The General Services Administration intends to issue a contract to American Science & Engineering, Inc. (AS&E) of Billerica, MA on behalf of Thunder Mountain Evaluation Center in Ft Huachuca, AZ through solicitation no. SN-45, pursuant to the authority of FAR Parts 12 and 13.501(a) ?Sole Source Acquisitions?. MobileSearch is a commercial, self-contained, mobile x-ray inspection system which was previously procured and employed by the subject Government activity for the purpose of efficiently, effectively and safely scanning trucks, cars and ISO containers, for the purpose of contraband detection and shipping manifest verification. This proposed action is to procure system design improvements, thereby enhancing effectiveness and longevity, plus two important additional system capabilities, ?Backscatter Only Mode? (BOM) and Radioactive Threat Detection (RTD). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2002-12. The proposed contract action is for supplies or services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 13.501. The Government has concluded that there is only one responsible source and no other supplies or services will satisfy agency requirements. AS&E is the sole provider of MobileSearch and has patent and intellectual property rights for the product for implementation under this follow-on implementation. A justification for Other than Full and Open Competition has been prepared in support of this acquisition. The provision at FAR 52.212-1, Instructions to Offerors, applies to this acquisition to the extent consistent with a sole source acquisition. AS&E shall include a completed copy of the provision at FAR 52.212-3, Offeror Representations and Certifications-Commercial Items, with its offer. The clause at FAR 52.212-4, Contract terms and Conditions-Commercial Items, applies to this acquisition. The clause at FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items, applies to this acquisition. This notice is not a request for competitive proposals. All interested parties must submit a capability statement that sufficiently describes their qualifications, capabilities, and previous experience related to fulfilling a similar requirement via email to fred.hersom@gsa.gov by 4:00 p.m., PST, February 27, 2003. A determination by the Government not to compete this proposed contract based on responses to this notice is solely within the discretion of the government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.
