- The Bureau of Land Management (BLM) and the National Business Center intends to negotiate with only one source under the authority of FAR 6.302-1, using the Commercial Item procedures to acquire Quarterly Updates for Mine and Mill Cost Estimation Data for use in Mining Claim Patent and Validity Examinations and Other Mineral Related Public Land Administration Actions. Preparation of accurate and reliable cost estimates require a timely, precise, and dependable sources of cost information as a product that can be cited as regionally applicable and accepted by the mining industry. The products available to estimate mine and mill cost data are "Mine and Mill Equipment" and "Mining Cost Services" guides, which include comprehensive quarterly updates. These guides are typically used together to develop BLM mine and mill cost estimates, which are closely scrutinized by Congress, the Secretary of the Interior, the Office of Inspector General, and environmental groups. The mining and milling cost data, obtained by BLM, must be a compilation of information that is industry recognized as a reliable cost data source. Industry data along with proprietary data must be compiled into a useful format, which includes but not limited to, information from railroads, electric companies, rural cooperatives, propane suppliers, State tax board, trucking and freight, labor unions, metal smelter and refiners, heavy equipment suppliers, manufacturer or importer of mining equipment, North American supplier of explosives and detonators, and suppliers of milling and reagents and equipment. Western Mine Engineering compiles proprietary data from large and small mining companies along with maintaining trade secrets to produce industry-recognized cost data. For nearly 20 years, BLM has used mining and milling cost information complied by Western Mine Engineering. Their products have been widely used as the industry standard by federal, state, and private organizations with interest in mining and milling data. No request for proposals (RFP) will be issued and no response will be made to letter or telephone requests for a copy of a solicitation. This is not a request for competitive proposals, but serves as a procurement notice to fulfill public posting requirements in accordance with FAR 5.101(a)(1). This requirement is set aside for small business and the NAICS Code 514199 applies. Responsible firms are encouraged to identify themselves and give written notification to the Contracting Officer. They must, however, provide supporting evidence that they can furnish the requested items at a cost that will not exceed that total intended transaction cost. All responses will be fully considered. If no affirmative responses are received by March 27, 2003 to the effect that a comparable source exists, a contract will be placed with Western Mine Engineering, Inc., for the requirements stated herein.
