Description

NA Sole Source Commercial Item for Non-Discarding SABOT Technology (NDS) testing. The United States Army Yuma Proving Ground (USAYPG), AZ intends to negotiate a new contract on a non-competitive basis with Laser II, LLC, 21620 Graybill St., Chugiak, Alaska fo r NDS Technology testing, test support and performance data. SIC Code is 3482/NAICS 332992, 1000 employees or less. Due to proprietary data rights on their physical interlock system (Non-discarding SABOT Technology), no technical data package exists, no wr itten solicitation will be issued and this acquisition will be awarded as a modified commercial item under the provisions of FAR Part 12. Laser II LLC is the only firm capable of conducting the testing due to proprietary data rights on the NDS technology. Deliverables: Physical testing and support may be performed at both at United States Army Yuma Proving Ground in Yuma, Arizona and at Cold Regions Test Center (Delta Junction, Alaska). The scope of the contract shall consist of the development and delivery of test plans for the NDS Technology testing, involve testing of no less than 300 projectiles using patented system, on-site test support for government testing, and formulation of final test data by March 2004. FAR and DFARS Clauses/provisions through FA C 2001-13 and DCN 20030331 edition are applicable to the subsequent award. Clauses/provisions are: 52.212-1 Instructions to Offeror Commercial Items; 52.212-3 Offeror Representations and Certifications-Commercial Items; 52.212-4 Contract Terms and Conditio ns-Commercial Items, 52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders – Commercial Items; 252.212-7000 Offeror Representations and Certifications--Commercial Items; 252.212-7001 Contract Terms and Conditions Require d to Implement Statutes or Executive Orders Applicable to Defense Acquisition of Commercial Items. USAYPG intends to make award to Laser II, LLC no later than 2 May 2003. If your firm possesses the capability and access to such data rights to use and condu ct non-discarding SABOT technology testing, your firm must provide written evidence of rights to the proprietary data, resumes’ and capability of personnel to conduct such testing, pricing information, legal company name, mailing address, POC, phone/fax, E mail address, business size, DUNS number, CAGE code, Tax ID number and Contractor Certifications IAW commercial items clause above. All written proposals, addressing RFP No. DABK41-03-R-0101 and all items above received no later than 12:00 PM, MST on 1 May 2003 will be considered. Proposals received after that date and time shall not be considered.
