Description
In accordance with 15 U.S.C. 631 and 10 U.S.C. 2304(c)(5), the United States Special Operations Command (USSOCOM) intends to negotiate on a sole source basis with Stidd Systems of Greenport, NY, as a certified HUBZone contractor for the USSOCOM MK V advanced shock mitigation seats and a full logistics support package. The appropriation language restricts USSOCOM to procure only the advanced version of the current shock-mitigating MK V SOC seats. The reason justifying the lack of competition is twofold. First, 15 U.S.C. 631 and 10 U.S.C. 2304(c)(5) specifically permit a Government agency, such as the USSOCOM, to enter into a contract with a certified HUBZone contractor as long as the conditions in FAR 19.1306(a) are met. The USSOCOM has determined that all the conditions set forth in FAR 19.1306(a) exist. Second, since Stidd manufactured the current shock mitigating MK V SOC seats, they are the only company with an advanced version of the current shock mitigating MK V SOC seats. The USSOCOM is unaware of any other advanced version of the current shock mitigating MK V SOC seats. USSOCOM anticipates either a base plus four option year period or a five year ordering period indefinite delivery, indefinite quantity contract with a contract maximum of $3 million. For clarification of the five year ordering period, for the advanced shock mitigating seats and other necessary equipment, the ordering period is three months after award of the contract. For the logistic support, the ordering period is the entire five year period. It is planned that this contract shall contain the advanced version of the current shock mitigating seats for the USSOCOM MK V SOC; support brackets; all other necessary equipment; and logistics support to include installation; integration; sustaining engineering, a warranty, preventive and corrective maintenance, refurbishment capability, spares, over and above repair support as defined in DFARS 217.77, and all other necessary services. Note 22 applies. In addition, any challenging HUBZone company must comply with FAR 19.1303(d), which states in part that "any HUBZone small business concern (nonmanufacturer) proposing to furnish a product that it did not itself manufacture must furnish the product of a HUBZone small business concern manufacturer to receive a benefit under this subpart."
