- POC: Duane F. Schumacher, VA Contracting Specialist (528A7/2-90NCA) 315-425-4845. DESC: This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The North American Industry Classification System (NAICS) Code applicable to this solicitation is 421450, Medical, Dental and Hospital Equipment and Supplies Wholesalers, and the small business size standard is 100 employees. This is a full and open competition (unrestricted). The VA Healthcare Network Upstate New York at Syracuse, NY intends to purchase a METRx MicroDiscectomy Surgical System, from Medtronic Sofamor Danek Inc., 1800 Pyramid Place, Memphis, TN 38132. See Attachment A for a complete listing of items to be acquired. All proposed components and configurations must be FDA approved. This solicitation document incorporates Federal Acquisition Regulation (FAR) provisions and clauses in effect through Federal Acquisition Circular 01-15 and VA Acquisition Regulation (VAAR) clauses as follows: 52.211-6 Brand Name or Equal; 52.212-1 Instructions to Offerors Commercial Items; 52.212-3 Offeror Representations and Certifications _ Commercial Items; 52.212-4 Contract Terms and Conditions _ Commercial Items; 52-212-5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders Commercial Items with (b)(13), (14), (15), (16), (17), (18), (19), (21), (24), (25) and (30) checked; and VAAR 852.270-4 Commercial Advertising. Offers to include completed copy of 52.212-3 Offeror Representations and Certifications _ Commercial Items. The provision at 52.212-2, Evaluation of Commercial Items, applies to this acquisition. The evaluation criteria stated in paragraph (a) of this provision is as follows. (1) Technical capability of the item offered to meet the government requirement and (2) price. The system offered must meet all the salient characteristics specified as follows, a) minimally invasive muscle splitting microdiscectomy, b) various tube size heights and widths, c) sequential dialation, d) outpatient surgery, e) utilized via a microscope or an endoscope, f) black, glare resistant, ceramic coated instruments, g) bayoneted instruments to optimize visualization, to be considered for award.
