Description
To achieve program objectives of ?Strengthened Rule of Law and Respect for Human Rights (ROL)? and ?More Transparent, Accountable and Effective Governance? (accountability/anti-corruption programs); technical Assistance, training and procurement agent support is required for the institutional strengthening of selected Nepal government and non-partisan civil society organizations. Strengthened Rule of Law objective assistance will be provided to: 1. Enhance Administration of Justice in Court, Prosecutor and Public Defense Organizations: - Update justice sector assessments; provide organizational strengthening assistance for Judiciary, Public Defense, Attorney General, Civil Society and Parliamentary Justice Reform Committees. - Expand quantity and improve quality of professional initial, refresher and in-service training available to government justice system actors (judges, prosecutors, public defenders) and their selected Nepal Bar Association and University Law School partners). - Enhance technical competency of judges, prosecutors and public defense/legal assistance officials through functional skills and substantive law training. - Procure and install technology/ administrative case management tools for modern, speedy and transparent administration of justice with training of judges, public defense officials and prosecutors on these systems. - Assess, design and develop initiatives leading to formation of a national Alternative Dispute Resolution (ADR) system. 2. Increase Access to Justice for the Poor and Disenfranchised: - Institutionalize a new national public defense service. - Provide for professional training for new Public Defense to enhance the quality and quantity of free legal assistance available to the poor and disenfranchised. - Support government and civil society programs to ensure citizens are well informed on legal rights, and on how to access state or private sector defense services. 3. Adequate Legal Frameworks for Justice Sector Reform: - Professional analysis and documentation of legislation requirements to strengthen rule of law and respect for human rights (State policy, planning, and reform legislation support) - Administer a USAID civil society grants program for NGOs advancing legal framework analysis and advocating for strengthened rule of law and respect for human rights. - Assist national processes for promotion of jurisprudence/court decisions protecting fundamental constitutional and civil rights. Organizations that benefit from this rule-of-law program assistance will include the Judiciary, Attorney General offices, Public Defense/legal defense system organizations, and a selection of non-partisan Nepal based civil society NGOs actively engaged in furthering program objectives. ?More Transparent, Accountable & Effective Governance? (Enhanced Anti-corruption system) objective assistance will be provided for purposes of: 1. Strengthened government integrity planning and implementation; 2. Improved performance of "accountability/anti-corruption systems" and key institutions contributing to combat corruption and promote accountability and good governance; - Strategic planning for government and civil society anti-corruption organizations - Strengthened investigative audit & prosecutorial capability for public sector corruption/financial fraud cases. 3. Improved legal frameworks and practices for good governance reform (Administer grants to selected civil society NGOs to: - Enhance civil society NGOs/coalition ability to assess requirements for anti-corruption legislation and state & private sector compliance with existing laws. - Improve civil society able to formulate technically sound proposals for anti-corruption legislation and government administration practices promoting transparency. - Support civil society in initiatives to educate and inform the public on how corruption impacts negatively on citizen well being. Organizations that will benefit from this anti-corruption program assistance will include the government?s semi-autonomous ?Commission for Investigation of Abuse of Authority? (CIAA); Judiciary?s Special (anti-corruption) Tribunal(s); Parliamentary ?Public Account Committee? (PAC), Revenue Investigation Department (RID), National Vigilance Center (NVC); Office of the Auditor General (OAG); Ministry of Finance, and selected non-partisan civil society organizations effectively engaged in advancing program objectives.
