- A. INTRODUCTION The Regents of the University of California ("University") on behalf of the Lawrence Berkeley National Laboratory ("LBNL") will be soliciting proposals from general contractors interested in becoming Job Order Contracting Subcontractors for LBNL. This project is hereinafter referred to as the "project." LBNL is a multi-program national laboratory with a mission to perform leading multidisciplinary research in the energy sciences, general sciences, and life sciences. The Laboratory is operated by the Regents of the University of California (University) for the United States Department of Energy (DOE). LBNL is an independent academic unit of the UC system and is located adjacent to the UC Berkeley campus. The Laboratory's research makes use of multidisciplinary collaboration and advanced engineering, computation, communications, fabrication, and other support facilities characteristic of a national laboratory. The Laboratory's facilities are planned, constructed, and maintained to directly support the research programs and scientific goals, while maintaining compatibility with the University community and the physical setting. B. PROJECT DESCRIPTION A Job Order Contract is an indefinite quantity contract pursuant to which the Subcontractor will perform a series of individual projects at different University facilities. The Request for Proposal will include a Construction Task Catalog containing over 150,000 construction tasks with preset unit prices. All unit prices are based on local labor, material and equipment prices including the current prevailing wages. The Request for Proposal also includes Technical Specifications, which set forth the quality of workmanship and quality of materials required for the construction tasks. This Subcontract, if awarded, will be awarded on the basis of a Best Value Source Selection. Subcontractors will propose two Adjustment Factors to be applied to the Construction Task Catalog. These Adjustment Factors will apply to each unit price in the Construction Task Catalog. One Adjustment Factor will be for work performed during normal working hours and the other Adjustment Factor will be for work performed during other than normal working hours. The Request for Proposal will also request information regarding the Offerors' qualifications, proposed staffing, and management approach. As Work is identified, the selected Subcontractor will participate in a Joint Scope Meeting, at which the scope of work for the individual project will be explained to the Subcontractor and the Subcontractor will be provided an opportunity to ask questions and inspect the site. The University will then prepare a Detailed Scope of Work and issue a Request for Proposal to the Subcontractor. The Subcontractor will prepare a Price Proposal Package for the project including, among other items, a Price Proposal and a schedule. In general, the Price Proposal will be prepared by identifying the proper construction tasks from the Construction Task Catalog and multiplying the pre-set unit prices by the quantity required and by the appropriate Multiplier. The University will review the Price Proposal Package and may request changes. Once an acceptable Price Proposal Package has been submitted, the University will issue a Job Order for the project. A separate Job Order will be issued for each project. A Job Order will contain a Detailed Scope of Work, the Project Completion Time, and the price to be paid for the work. The Job Order price shall be a lump sum, fixed price for the completion of the Detailed Scope of Work. C. MINIMUM QUALIFICATIONS Interested firms must meet the following minimum requirements in order qualify for award of a Subcontract: 1. This is a small business set aside. The prime subcontractor must be a small business. The NAICS code is 236220 and the size standard is $28.5 million. 2. The firm must have a valid contractor license appropriate for their work. The license must not have been suspended or revoked for any reason. 3. The firm's Workers Compensation Experience Modification Rating must be 1.0 or better in each of the last three years. 4. The firm must have a written safety program that complies with CAL/OSHA requirements. 5. The firm must not have been disqualified or debarred by the University of California, the U.S. Government or by any other public agency at any level of government. 6. The firm must never have entered into a contract that had to be completed by their surety. D. PRE-PROPOSAL CONFERENCE An information meeting for prospective Subcontractors will be held at LBNL, 1 Cyclotron Rd, Berkeley, CA, 94720 on August 22, 2003, at 1:00 p.m., Building 54 Perseverance Hall Conference Room. Confirm attendance and reserve site access permission and site parking by calling Sarah Morgan at 510-486-7297 not later than August 18, 2003. At this meeting, the University will explain the Project and give an overview of the Job Order Contracting system and how it will be implemented at the University. The Request for Proposals will be distributed subsequent to the meeting.
