- OMBUDSMAN NOTICE NOTICE FOR FILING AGENCY PROTESTS It is the policy of the Coast Guard to issue solicitations and make contract awards in a fair and timely manner. The Ombudsman Program for Agency Protests (OPAP) was established to investigate agency protest issues and resolve them without expensive and time-consuming litigation. OPAP is an independent reviewing authority that is empowered to grant a prevailing protester essentially the same relief as the General Accounting Office (GAO). Interested parties are encouraged to seek resolution of their concerns within the Coast Guard as an Alternative Dispute Resolution (ADR) forum, rather than filing a protest with the GAO or some external forum. Interested parties may seek resolution of their concerns informally or opt to file a formal agency protest with the contracting officer or Ombudsman. Informal forum with the Ombudsman. Interested parties who believe that a Coast Guard procurement is unfair or otherwise defective should first direct their concerns to the cognizant contracting officer. If the contracting officer is unable to satisfy the concerns, the interested party is encouraged to contact the Coast Guard Ombudsman for Agency Protests. Under this informal process, the agency is not required to suspend contract award performance. Use of an informal forum does not suspend any time requirement for filing a protest with the agency or other forum. In order to ensure a timely response, interested parties should provide the following information to the Ombudsman: solicitation/contract number, contracting office, contracting officer, and solicitation closing date (if applicable). Formal Agency Protest with the Ombudsman. Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the contracting officer through open and frank discussions. If the protester?s concerns are unresolved, an independent review is available by the Ombudsman. The protester may file a formal agency protest to either the contracting officer or as an alternative to that, the Ombudsman under the OPAP program. Contract award or performance will be suspended during the protest period unless contract award or performance is justified, in writing, for urgent and compelling reasons or is determined in writing to be in the best interest of the Government. The agency?s goal is to resolve protests in less than 35 calendar days from the date of filing. Protests shall include the information set forth at FAR 33.103(d)(2). If the protester fails to submit the required information, resolution of the protest may be delayed or the protest may be dismissed. This will not preclude re-filing of the protest to meet the requirement. To be timely, protests must be filed within the period specified in FAR 33.103(e). C. 20593 Telephone (202) 267-2285 Fax: (202) 267-4011 United States Coast Guard, Maintenance & Logistics Command, Pacific intends to issue a Firm fixed-Price Contract for Allied Systems Company Marine Crane Davits, Model No. D-5700-CT, in accordance with the Federal Acquisition Regulation (FAR) Part 12, Acquisition of Commercial Items, and FAR Subpart 13-5, Test Program for Certain Commercial Items. This requirement is being solicited on a Brand Name or Equal basis under the authority of 10 U.S.C. 2304?(1) and FAR Subpart 6.302-1. This is a combined synopsis/solicitation. This announcement constitutes the only solicitation. Proposals are being requested and a written solicitation will not be issued. Solicitation Number: DTCG85-03-R-625997. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 01-01. The NAICS code for this acquisition is 333923 and the small business size standard is 1000. This procurement is issued in accordance with the SBCDP. A list of contract line item number(s) and quantities are as listed below. Line Item CLIN 0001 - (3) D-5700-CT davits (Brand name or equal), price for each. Davits will be delivered to Bldg 42, Coast Guard Island, Alameda, CA 94501. The Allied Systems Company, Model D-5700-CT davit is replacing the Model D-5000-CT Davit, and is the only known equipment that will satisfy form, fit and function requirements without major modification to the existing equipment configuration. Salient characteristics are as follows: (1) Rated capacity: 4,500 lbs @ 14-6-maximum reach (6.0 safety factor): (2) Static Overturn Moment: 87,000 lb. ft.: (Gross Weight: 4,500 lbs: (4) Load Line Winch: Constant Tension Winch M0del: CT-5. Performance: 34 GPM @ 2500 PSI, Bare Drum: 85 fpm, 8,000 lbs, Full Drum: 100 fpm, 1,000 lbs; Constant Tension Winch Enabled: Performance: 34 GPM @ 1000 PSI, Line Pull: 0 to 450 lbs., Line Speed: 0 to 550 ft/min; (5) Standard Reeving: 75 ft. 5/8-Dia 6 x 37 EIPS IWRC Wire Rope with open spelter socket on hook end and automatic release hook; (6) Boom: two piece with swinging sheave cage, Rated at 12 GPM @ 2500 PSI, Hoist time 6 deg/sec; 97) Davit, Mounting: davit swing bearing will mount to existing installed pedestal and provided with bolts for installation; (8) Turret and Controls: Dual swing drive with spring applies automatic brakes. Adjustable 180 to 300 deg. Rotation on a shear type ball bearing controlled by adjustable swing stops with deceleration valves. Remote control console with stainless cover controls. Levers spring loaded to neutral for each crane function; (9) Slewing Performance:Rated:18 GPM @ 250 PSI; Swing Speed 0 to 1.0 RPM; (10) Hydraulics: one lift cylinder: heavy lifting, double acting with load hold valve and stainless steel cylinder rod, Stainless steel hydraulics plumbing and fittings, Emergency lowering Back up hand pump with tank, Compatible with existing D-5000-CT hydraulic power unit; (11) Construction: Design safety factor of 6 based on ultimate strength of components, High tensile steel construction: Turret tube and boom ASTM A514B. Stainless steel fasteners except high strength swing bolts. Corrosion resistant stainless steel pins at pivot points. Offerors are required to submit a written proposal that contains at a minimum the following information: A. Pricing for CLIN 0001. Include any commercial pricing literature. B. Past Performance information consistent with FAR 52.212-1(b)(10). C. Technical information that (i) demonstrates contractors ability to meet the requirements, (ii) demonstrates proposed commercial products performance factors. (iii) demonstrates evidence of compatibility with existing Coast Guard systems. (iv) provides warranty of product. Award will be made to the offeror whose proposal provides the best value to the Government. All evaluation factors other than price, when combined are approximately equal to price.
