Description
This announcement is in accordance with the provisions of FAR 13.5 test program for commercial items. The U. S. Coast Guard (USCG) intends to negotiate a sole source procurement with Martin Associates, Lancaster, Pennsylvania. The USCG is seeking technical and management support services for an economic impact analysis of a proposed Great Lakes Pilotage rate adjustment. The USCG Office of Great Lakes Pilotage (G-LPO) is responsible for the oversight of the Great Lakes pilotage program. This includes the responsibility for auditing financial records of the pilot associations and calculating pilotage rates. G-LPO accomplishes this objective by following the guidelines and ratemaking procedures contained in Title 46 Code of Federal Regulations, Chapter 404. A notice of proposed rulemaking was published proposing to adjust the rates charged in all pilotage areas by an average of 26%. Due to the magnitude of the rate adjustment and the possibility that it could have an adverse effect on the economy of the Great Lakes basin, the USCG has concluded that a full economic evaluation is necessary to measure the proposed rule?s impact on the economy generally, and more specifically, the local or regional economy with reference to productivity, competition, jobs, state and local taxes, and tribal governments or communities. Martin Associates was selected for this negotiation because of their unique expertise and past experience with evaluating the impacts of Great Lakes ports activity and the economic impact of the marine transportation system on the Great Lakes. Martin Associates is in a unique position to most effectively and efficiently provide this service, in that it is the only source for proprietary economic models they developed for the Great Lakes region and ports. Martin Associates has a unique understanding of the requirements imposed upon the USCG by Executive Order 12866. Contracting with Martin Associates will avoid a substantial duplication of cost necessary to develop the required economic databases to conduct an economic analysis of the proposed rate increase, which duplication is not expected to be recovered through competition. Furthermore, no other company is able to provide the required economic analysis to enable the USCG to prepare for December 12, 2003 litigation. The proposed contract action is for services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 13.501. This notice of intent is not a request for competitive proposals. However, the Government will consider all proposals received from responsible sources by 4:00 P.M. Eastern Daylight Time, September 10, 2003 at Commandant G-ACS-2B/ef, USCG Headquarters, 2100 Second St., S.W., Washington, DC 20593-0001. A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government.
