- BACKGROUND: Section 521 of the Benefit Improvement and Protection Act 2000 (BIPA) revised section 1869 of the Social Security Act to mandate that the Secretary develop a revised process for carrying out appeals of Medicare fee-for-service claims. The BIPA requires, among other things, the establishment of new entities known as Qualified Independent Contractors (QICs) to conduct the second level of appeal, and establishment of stringent timeframes which require the QICs to conduct reconsiderations within 30 days. The introduction of QICs creates an additional appeals level for Part A claim determinations and replaces the Part B hearing level of appeal. The establishment of Qualified Independent Contractors (QICs) is an effort envisioned by CMS as an important step in implementing the revised second level appeals process as mandated by the Benefits Improvement and Protection Act Section 521. This procurement will allow CMS to implement two major components of the BIPA 521second level appeals process. The QICs will adjudicate reconsiderations and expedited reconsiderations of redeterminations made by fiscal intermediaries, carriers, or quality improvement organizations, using established protocols. In addition, the QICs will collect and transmit information regarding the receipt and disposition of reconsiderations and expedited reconsiderations via the Medicare Appeals System (MAS). The second component will be an Administrative QIC or AdQIC. The AdQIC will provide technical support for the MAS, collect, track, and distribute information regarding the receipt, processing, and disposition of reconsiderations and expedited reconsiderations, develop and update protocols, and conduct training. CMS anticipates awarding multiple Indefinite Delivery Indefinite Quantity contracts, which will have a base period with multiple option periods.
