Description
This is a notice of intent to award, on a sole source basis to LHL Realty c/o CB Richard Ellis, 555 11th Street, NW, Washington, DC 20004, for commercial items prepared in accordance with Simplified Acquisition Procedures and within the format identified in Subpart 12. This announcement constitutes the only solicitation; the Department of Justice, subject to the availability of funds, has a need for the continued preventative maintenance of various supplemental air conditioning units located throughout the building located @ 601 D Street, NW, Wash., DC for the balance of the fiscal year. The units are an intricate part of the lessor?s electrical and mechanical plants. This order consists of a proposed base period and (2) option years as follows: Base Period ? November 19, 2003 through September 30, 2004, Option Period I - October 1, 2004 through September 30, 2005, and Option Period II - October 1, 2005 through September 30, 2006. The provision 52.212-1 Instructions to Offerors?Commercial Items applies to this acquisition. Provision 52.212-2 Evaluation?Commercial Items applies. OPTION TO EXTEND THE TERM OF THIS AWARD will be in keeping with FAR 52.216-2 Economic Price Adjustment establishing a 10 percent limit on aggregate increases should option periods be exercised. (a) The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government shall give the Contractor a preliminary written notice of its intent to extend at least 60 days before the award expires. The preliminary notice does not commit the Government to an extension. (b) If the Government exercises this option, the extended order shall be considered to include this option provision. The total duration of this order, including the exercise of any options under this clause, shall not exceed 36 months. Quotes are not being request and a written solicitation will not be issued. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 16 [effective as of October 31, 2003]. No contract award will be made on the basis of offers/quotations received in response to this notice. Responses received as a result of this notice of intent shall be considered solely for the purpose of determining whether to conduct a competitive procurement. A determination by the Government not to open this requirement to competition, based upon the written responses [only] to this notice, is solely within the discretion of the Government.
