- Solicitation No. R5-04-20-011 Description of Required Employee Relations Services Firms may submit quotes for one or both items: Item One: One individual to work a dedicated 40 hours a week at the Forest Service Regional Office in Vallejo, CA. for up to one year (from date of award). The Government will provide office space and a P.C. The individual must be MS Word compatible. Item Two: One individual to work approximately 24 hours a week, part time, on-call, as needed at the Forest Service Regional Office in Vallejo, CA. for up to one year (from date of award). The Government will provide office space and a P.C. The individual must be MS Word compatible. The ?start work? date for each item is flexible. Based on the mutual agreement of both parties, successful awardees may commence work between December 8, 2003 and January 2, 2004 for a one year period. Method for responding to this solicitation: 1. Respond to each of the four Evaluation Criteria. 2. Complete the Schedule of Prices. Don Bandur, 1323 Club Drive, Vallejo, CA. (reference Solicitation R5-04-20-011) 3. All responses are due by Midnight, November 30, 2003. Statement of Work Each individual will provide advisory services to Regional Staff Directors, Forest Supervisors, Managers, and Supervisors, including Field Unit Human Resources Officers, and Employee Relations Specialists in the process, evaluation, and execution of disciplinary/adverse actions for conduct and unsatisfactory performance. Advice is consistent with statutes, established Department and Forest Service (FS) procedures and policies, regulations, and MSPB, EEOC, and FLRA precedents. Integrates solutions to problems with other personnel program areas. Advises management with regard to interpretation and administration of disciplinary cases and adverse actions as well as alternative discipline. Assists management in mediating workplace disputes, resolving grievances filed under the administrative grievance procedure and/or the negotiated grievance procedure. Performs case analyses, engages in discussions/meetings with appropriate parties, prepares recommendations and decisions for the Supervisor of Workforce Relations. Provides advice/guidance and performs technical review of all proposed adverse actions. May prepare disciplinary and non-disciplinary notices to employees to be issued by management officials. Conducts research of statutes, policies, regulations, precedent cases and other authoritative sources bearing on the issues involved in a case. Prepares memoranda or reports outlining the facts and issues, analyzing the factual and issues involved, explaining the application of federal human resource employee relations principles and precedents, and justifying recommendations or conclusions. Under the Supervisor of Workforce Relations acts as the agency technical representative in mediating, resolving and settling controversial cases (between management and the appellant/complainant) before proceeding to third-party hearing. Prepares the necessary settlement agreement (contractual) and other appropriate documents. When the agency enters into contractual relations (settlement agreements), negotiates the contract with attorneys and provides advisory services to the Counselor-Mediators or EIP Program Manager. Reviews negotiated settlement agreements for sufficiency as well as justification statements/analyses that must be included to satisfy internal agency and departmental requirements. May serve as agency technical representative at mediations where high level agency staff or SES Cadre members are resolving officials. EVALUATION CRITERIA In order of descending importance: 1) Price. Please provide the fully loaded hourly wage rate(s) within the following ?SCHEDULE OF PRICES?. 2) Demonstrated experience of federal employee relations? theories, principles, applicable laws and regulations, practices and techniques sufficient to analyze problems, advise management, work with employees and supervisors to resolve problems and develop appropriate material for use by supervisors and employees. 3) Demonstrated experience of federal personnel administration, organizations, organization structure, functions, basic policies, missions, operating programs, and current issues facing these organizations; and their relationship to organizations in the Federal government as a whole in order to provide expert advice in problem identification and resolution. 4) Demonstrated experience in mediation, alternative dispute resolution concepts and techniques, interest-based bargaining and other non-adversarial problem-solving approaches. Price is more important than any individual evaluation criterion. However, when combined, the technical criteria are cumulatively more important than price. And the technical criteria (criteria 2 through 4) are in order of descending importance. Firms may submit quotes for one or both items. Separate Schedule of Prices and resumes are required for each work item. For each work item, please provide a resume of the individual proposed that demonstrates the above technical skills. Within this resume, discuss each of the three the technical criterion. Firms should also include references and readily available phone numbers. Each resume is limited to three pages, single sided, size 12 font. The Government may award one purchase order to one firm for both Items, or divide the two items between two firms. For each item, award will be based on best over all value to the Government, price and other factors considered. Award is contingent upon available funding. SCHEDULE OF PRICES for Employee Relations Services Firms may submit quotes for one or both items: Item One: Full time, 40 hrs per week $ _____________ per hour Item Two: Part time, approx. 24 hrs per week $ _____________ per hour All hourly labor rates are to be fully loaded, inclusive of direct costs, indirect costs, overhead or GA, profit, incidental materials costs, ?tools of the trade?, travel, supervision and management of personnel. The Contractor?s on-site employees must, at all times perform his/her duties in a manner which the Forest Service finds to be suitable and proper. The employee?s conduct shall also be suitable and proper. If the Contracting Officer notifies the contractor that an employee?s performance or conduct is not suitable and proper, the contractor shall remove the employee immediately from the government site and provide a replacement. The Forest Service will not be responsible for any termination or relocation cost incurred by the contractor.
