Description
NAICS Code: 926150. The U.S. Environmental Protection Agency (USEPA), Region V (MCC-10J), 77 West Jackson Boulevard, Chicago IL 60604 intends to award a sole source fixed-price service contract to the State of Illinois, Illinois Department of Agriculture, State Fair Grounds, P.O. Box 19281, Springfield, Illinois 62794-9281. The State of Illinois will conduct approximately 500 to 800 Risk Management Plan inspections of anhydrous ammonia fertilizer facilities within the State of Illinois as required under the accidental release prevention provisions of Section 112(r) of the Clean Air Act (CAA). The inspections will require a detailed review of the facilities risk management program, which includes the hazard assessment, including off-site consequence analysis data, the prevention program and emergency response program. In the increase awareness of homeland security, Congress passed the Chemical Safety Information, Site Security and Fuels Regulatory Relief Act: Public Distribution of Off-Site Consequence Analysis Information which governs access to, and dissemination of information about the potential off-site consequences of accidental chemical releases from facilities handling hazardous substances, including anhydrous ammonia. According to this law, only covered persons are allowed access to this information. State agencies fall under the auspices of covered persons. Distribution of the information in a manner inconsistent with the provisions of the rule is illegal and is punishable under this federal law. Therefore, it is USEPA's intent to award this contract as a sole source to the State of Illinois. Notwithstanding, any firm who believes it is capable of USEPA's requirement as stated herein may submit a response, which, if received within 15 calendar days of this announcement, will be considered. Responses to this posting must be in writing. A determination to compete the proposed contract based upon the responses to this notice is solely within the discretion of the Government.
