- (i) THIS IS A COMBINED SYNOPSIS/SOLICITATION FOR COMMERCIAL ITEMS PREPARED IN ACCORDANCE WITH THE FORMAT IN FAR SUBPART 12.6, AS SUPPLEMENTED WITH ADDITIONAL INFORMATION INCLUDED IN THIS NOTICE. THIS ANNOUNCEMENT CONSTITUTES THE ONLY SOLICITATION; PROPOSALS ARE BEING REQUESTED AND A WRITTEN SOLICITATION WILL NOT BE ISSUED. (ii) SOLICITATION NO. BBGCON3604S5418 IS ISSUED AS A REQUEST FOR PROPOSAL (RFP) AND A CONTRACT WILL BE AWARDED USING THE CONTRACTING BY NEGOTIATION PROCEDURES. (iii) This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2001-17, dated October 31, 2003. (iv) This is a full and open procurement for satellite transponder capacity on the AsiaSat-2 Satellite under NAICS 517410, Satellite Telecommunications. (v) The Broadcasting Board of Governors (BBG), International Broadcasting Bureau (IBB) has a requirement, contingent upon the availability of funding, for a Contractor to provide 36 MHz of satellite transponder capacity on AsiaSat-2 as described in the Statement of Work herein at a firm-fixed annual fee for the following period(s): CLIN 1: Base Year - April 1, 2004 through March 31, 2005; CLIN 2: Option Year 1 - April 1, 2005 through March 31, 2006; CLIN 3: Option Year 2 - April 1, 2006 through March 31, 2007; CLIN 4: Option Year 3 - April 1, 2007 through March 31, 2008; CLIN 5: Option Year 4 - April 1, 2008 through March 31, 2009; CLIN 6: Option Year 5 - April 1, 2009 through March 31, 2010; and CLIN 7: Option Year 6 - April 1, 2010 through March 31, 2011. (vi) STATEMENT OF WORK: Contractor to provide 36 MHz of Satellite Transponder capacity on AsiaSat-2, to be utilized 24 hours/day, 365 days/year to facilitate video and audio transmission of IBB programming in a compressed digital and DVB complaint format beginning April 1, 2004. IBB will uplink the source programs from it's own satellite earth station facility in Kuwait and a backup facility in the Philippines. SPACE SEGMENT REQUIREMENTS: The current AsiaSat-2 uplink parameters, for the existing lease with AsiaSat, are identified herein. The contractor shall provide same or equivalent service on AsiaSat-2 Satellite. Satellite: AsiaSat-2 (100.5? E); Transponder: 2B; Polarization: Linear; Footprint edge EIRP: 31dBw or better; Carrier Type: Digital; Service Classification: MCPC; Modulation Technique: QPSK; U/L Frequency: 6105 MHz; D/L Frequency: 3880 MHz; FEC: ?; Symbol Rate: 20.4 MS/sec; D/L Polarization: Horizontal; and Video Format: PAL. SEGMENT AVAILABILITY REQUIREMENTS: Satellite space segment capacity shall be available 99.9999% of the time. NOTIFICATION OF SATELLIE OUTAGES: Contractor shall be responsible for monitoring IBB transmission and shall notify IBB Network Control Center (NCC), in Washington D.C., in case of an emergency. The Contractor shall notify and coordinate planned down times with the NCC at least five (5) business days prior to the downtime. Contractor shall also notify NCC, immediately upon discovery of any unplanned interruptions in the IBB broadcasts. The appropriate telephone & facsimile numbers and Email addresses to the IBB Network Control Center will be provided to the Contractor after contract award. CATASTROPHIC FAILURE: In the event of a catastrophic transponder or satellite failure, the Contractor shall provide another transponder or Satellite C-Band assignment that meets or exceeds foot print and downlink EIRP requirements of the failed service, as stated in "Space Segment Requirements" above. In the event the Transponder should fail to operate and the Contractor fails to provide identical capacity and service on another AsiaSat transponder or satellite, and as a result IBB Video and Audio services are suspended or cancelled for at least two (2) continuous weeks, the Contracting Officer shall have the right to terminate this Contract. In the event of termination, any prepaid payment shall be refunded to the Bureau within fourteen (14) days of the date for termination. INTERRUPTION OF SERVICE: The IBB shall be compensated by the Contractor for any interruption in service longer than one (1) minute, to include planned downtimes, and will result in a refund of a portion of the yearly payment directly proportional to the time of the outage. This refund is to be credited to the IBB on the next quarterly invoice for the following billing period. (vii) The contract term shall be from April 1, 2004 through March 31, 2005 with six (6) one-year options to extend the contract term; (viii) The provision at FAR 52.212-1, Instructions to Offerors--Commercial Items apply to this solicitation. Interested contractors who are capable of providing these services should submit a capability statement (consisting of separate technical and price proposals) as noted below. The contractor shall have demonstrated ability and experience in providing the required services. (ix) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: [1] Mandatory: Offeror's proposed capacity meets, or exceeds, the existing capacity parameters at a minimum. Failing to meet the existing minimum requirements will result in offeror's proposal being rejected in total without regard to other factors. [2] Offeror's technical proposal that demonstrates the offeror has previously and successfully delivered similar services. [3] Detailed information on Offeror's past performance and relevant contracts for similar services and a minimum of three (3) references including contract numbers, points of contact with telephone numbers, email and other relevant information. [4] Offeror's organization qualifications and background, and [5] Offeror's proposed price. When combined, technical and price proposals will be approximately equal. The following factors and possible points shall be used to evaluate proposals: a. Mandatory: proposed satellite capacity (20 points ) b. Successful delivery of similar services (10 points) c. Past Performance (10 points); d. organization qualifications and background (10 points) and e. Price (50 points). (x) Offerors shall include a completed copy of the provisions at FAR 51.212-3, Offeror Representations and Certifications--Commercial Items with its offer. Proposals must also include Contractor's DUNS Number, prompt payment terms and correct remittance address, if different from mailing address. Provide a list of escalation procedures, names and 24-hour contact numbers with the proposal. Proposals shall be signed by an official authorized to bind your organization. Submit to the Contracting Officer, two (2) copies of technical and two (2) copies of price proposal, bound separately. An award may be made without discussion. (xi) The clause at 52.212-4, Contract Terms and Conditions--Commercial Items applies to this acquisition with no addenda to the clause. (xii) FAR clause 52.212-5, Contract Terms and Conditions Required to Implement Statues or Executive Orders--Commercial Items, including subparagraphs (b) (3,6,7,8 and 9) applies to this acquisition as well as the following clauses contained within FAR Clause 52.212-5: 52.222-21, Prohibition of Segregated Facilities; 52.222-26, Equal Opportunity (E.O. 11246); 52.222-35, Affirmative Action for Disabilities (29 U.S.C. 793); 52.222-37, Employment Reports on Disabled Veterans and Veterans of the Vietnam Era (38 U.S.C. 4212); 52.232-33, Payment by Electronic Funds Transfer--Central Contractor Registration (31 U.S.C. 3332). (xiii) FAR Clauses 52.232-18, Availability of Funds; 52.217-9 Option To Extend The Term of The Contract, and FAR Clause 52.237-3 Continuity of Services applies to this procurement. There are no additional contract requirements necessary for this acquisition other than those consistent with customary commercial practices. (xiv) The Defense Priorities and Allocations System (DPAS) and assigned rating is not applicable to this acquisition; (xv) There are no CBD numbered notes which apply to this procurement. (xvi) Failure to provide any of the above required items may result in the rejection of your proposal.
