- SUBJECT: PERFORMANCE DECISION OF A STREAMLINED COMPETITION STUDY UNDER THE REVISED OMB CIRCULAR A-76, DEPARTMENT OF HEALTH AND HUMAN SERVICES, PROGRAM SUPPORT CENTER In accordance with the procedures specified in the revised OMB Circular A-76 (Attachment B, B.1), dated May 29, 2003, public notification was made on October 16, 2003, to announce the streamlined competition study of the DHHS/PSC/HRS/DCP/MAB Beneficiary Medical Program (BMP) commercial activity, consisting of four (4) incumbent government FTEs located in Rockville, Maryland. On December 2, 2003, the appropriate agency officials certified the streamlined competition form signifying a performance decision and end date of the competition. Also on this date and consistent with the procurement integrity, ethics, and standards of conduct rules, including the restrictions of 18 U.S.C. 208, the Medical Affairs Branch Chief reviewed the streamlined competition form. Under this formal notification, the responsible Contracting Officer announces the performance decision that the low-cost private sector providers should perform the medical and dental claims processing functions of the BMP. The performance of the medical claims processing functions shall be provided by TRICARE and the dental claims processing functions shall be provided by United Concordia. Based on this decision, the Contracting Officer shall award a contract to United Concordia for the dental claims processing functions in accordance with the FAR and shall implement FAR 7.305(c), the right of first refusal and the administration of the Uniformed Services Medical Entitlement shall be transferred to TRICARE. In accordance with Attachment B, Section F.2, of the revised OMB Circular A-76, dated May 29, 2003, no party may contest any aspect of a streamlined competition. Upon request, the streamlined competition form shall be made available to the public.
