Description
The U.S. Army Engineering and Support Center, Huntsville, AL, will be issuing a Request for Quotation for the impending procurement of the Environmental Laws and Regulations course for FY 04 and the possibility of four one-year option periods. The c ourse session length is 36 hours (4-1/2 days), and the session schedule is as follows: Huntsville, AL, 29 Mar ?????? 2 Apr 2004 Sacramento, CA, 10-14 May 2004 Dallas/Ft Worth, TX, 7-11 Jun 2004 Atlanta, GA, 21-25 Jun 2004 Denver, CO, 12-16 Jul 2004 Cincinnati, OH, 26-30 Jul 2004 Dates and locations for possible option years will be annotated in the forthcoming solicitation. Class size is 35 students. The contractor will provide two teams of instructors during the weeks when two sessions are scheduled concurrently. A team will c onsist of two instructors, a principal instructor and one assistant instructor, present during the full 36 hours of instruction. The Government will provide classroom space, government forms, and all training equipment and materials. The contractor will provide all services, personnel, materials (other than those provided by the Government), audio-visual aids, travel and lodging for contractor personnel. This course lists major Federal statutes designed to protect the environment; summarizes the major provisions of each major Federal environmental law and relationship to activities of the Corps of Engineers; finds the Federal and State environmental statut es and regulations pertinent to a specific Corps activity, (given access to a reference library); and identifies and states legal requirements for environmental protection related to a specified Corps activity. This is a general survey course designed for non-attorneys, or for attorneys with limited background in environmental law. Topics include Federal laws and regulations for environmental protection; pollution standards and variances; Congressional and judicial developments; economic and technical dif ficulties in meeting standards; relationship of the Corps of Engineers to State and Federal agencies in meeting standards and enforcing laws; methods of monitoring pollution; legal penalties; litigation techniques; the Rivers and Harbors Act of 1899; the N ational Environmental Policy Act (NEPA); Executive Order 11514; the NEPA regulations of the Council on Environmental Quality; the Federal Clean Water Act; The Federal Clean Air Act; the Resource Conservation and Recovery Act; the Toxic Substances Control A ct; the Endangered Species Act; the Fish and Wildlife Coordination Act; the National Historic Preservation Act; the Noise Control Act; the Federal Environmental Pesticide Control Act; the Coastal Zone Management Act; regulations of the EPA, state laws and regulations. A combination of lecture, follow-on discussion, group exercises, and case studies will be utilized to reinforce learning objectives and to encourage student involvement. The contractor will attend a one-day post award review and a one-day dry run at the contractor??????s facility. The contractor will also develop/revise/update the student course materials and instructor teaching materials for the Base Year only. Revised course materials will be used for subsequent years of the contract. Materials requiring revision include Schedule of Instruction, Instructor Lesson Plan, Pre/Post Test, Student Course Manual, and audiovisuals. The contractor will provide each student wit h the text ??????Selected Environmental Law Statutes??????, educational edition, published by West Publishing Company, or provide the students with a web site or any other text that has the same statutory coverage. Principal instructors shall have five or more years of post law school experience working as environmental lawyers and hold J.D. The assistant instructor shall have three or more years of post law school experience working as environmental lawyer and hold a J.D. The principal instructor shall have 80 or more hours of traini ng/teaching experience with adult learners during the past 3 years, and the assistant instructor should have 40 or more hours of training/teaching experience with adult learners during the past three years. These experiences shall have focused on environm ental law. All responsible sources may submit a bid, proposal, or quotation, which shall be considered by the agency.
