Description
NASA/DFRC plans to issue Call Order No. NND04AB12D under Minarik Corporation BPA No. E05652D for customized "Electrical Control Modules (ECM?s)." These modules are based upon the approved ?Proto-type Modules? previously procured under the BPA. This requirement is for manufacture of the customized production units. The ECM?s are to be utilized for the operation and control of the existing Central Hydraulic System. NASA/DFRC intends to purchase the ECM?s directly from Minarik Corporation, Orange, CA under the terms and conditions of BPA No. E05652D. The authority for other than full and open competition is 10 USC 2304(c)(1) "Only one responsible source and no other supplies or services will satisfy agency requirements." Justification is based upon the fact that all initial design work and other non-recurring costs for the pre-production proto-type units have already been incurred; and that these incurred costs would not be recovered through competition. Additionally, redesigning and revalidating a different ECM will result in additional costs and unacceptable delays in fulfilling the Agency's requirements The Government does not intend to acquire a commercial item using FAR Part 12. Interested organizations may submit their capabilities and qualifications to perform the effort in writing to the identified point of contact not later than 4:30 p.m. local time on February 12, 2004. Such capabilities/qualifications will be evaluated solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. A determination by the Government not to compete this proposed effort on a full and open competition basis, based upon responses to this notice, is solely within the discretion of the government. Oral communications are not acceptable in response to this notice. An Ombudsman has been appointed. See NASA Specific Note "B".
