Description
The USDA Forest Service, Region 5 (R5) California has a requirement for a contractor to provide Assistance for Negotiability and Unfair Labor Practice concerns, and Implementation of Negotiations for R5 Settlement Agreement, and other class complaints and subsequent Settlement Agreements. Selection of a firm or individual and subsequent award will be based on best value, price and other factors considered. The government will make one award. In order to be eligible for award, firm or individual must: be competitively priced, and have satisfactory past performance of similar work. Interested firms or individuals should submit a written response to the evaluation criteria below prior to 4:00 pm, April 16, 2002: USDA Forest Service, Attn. Don Bandur, 1323 Club Drive, Vallejo, CA. 94592. Reference Solicitation No. R5-02-20-018. No FAX or electronic submittals. Submit your response to the evaluation criteria along with your pricing structure. Overview: Region 5 resolved a Class Action EEO complaint lawsuit alleging sexual harassment and retaliation against female employees (Donnelly v Veneman) and is in the final stages of settling another class complaint, with two more pending. All Settlement Agreements have or will have a provision to fulfill our obligation to bargain with the Union. The Court approved the settlement agreement, which includes a requirement for Union negotiations prior to implementing any change in a condition of employment that might be required by, or pursuant to, the settlement agreement, and the negotiation of which is within the Union?s bargaining rights. There are significant differences between the Union and the Region as to the scope and extent of the bargaining obligation, which may be resolved by the Federal Labor Relations Authority (FLRA). Project Location: Consulting and training services will be provided either at: the Forest Service Regional Office in Mare Island, Vallejo, California - or at the site for negotiations which is usually in Sacramento, California - or remotely from the Contractor?s place of business. The Office of General Counsel (OGC) will provide the representation at any hearings before the FLRA and Federal Service Impasses Panel (FSIP) that arise out of implementation of the settlement agreement. The contractor may be requested to provide technical assistance to OGC in connection with any hearing before the FLRA. Description of Services: Assist agency in dealing with negotiability and bargaining obligation disputes, and Unfair Labor Practice allegations, regarding implementation of the R5 Settlement Agreement. This could include any or all of the following: 1) Review Union proposals and Management responses for negotiability concerns, suggest or evaluate negotiability arguments, and assist as to possible alternate approaches to address negotiability concerns with the Union acceptable to the agency. 2) Assist OGC in preparing or reviewing formal agency negotiability responses to the Union and the FLRA under 5 USC Chapter 71 and FLRA regulations in 5 CFR 2424. This could include the agency?s Written Allegation of Non-negotiability, the FLRA?s Post-Petition conference (attempt to resolve informally and/or to clarify issues for formal determination), the agency?s Statement of Position and Reply to the Union Response. 3) Assist OGC in responding to Union-filed Unfair Labor Practice charges regarding alleged unilateral implementation of various provisions of the R5 Settlement Agreement (e.g. the Monitoring Council), FLRA investigation and any attempts to resolve informally, responding to any FLRA Complaint or request for injunction, and preparing for and assisting with ULP hearings and any appeals of the ALJ?s Recommended Decision and Order to the full FLRA. 4) Assist OGC in responding to FLRA motions for compliance. 5) Assist OGC in preparing submissions to Federal Service Impasses Panel. 6) Train Regional managers and personnel staff in Labor Relations and EEO. Payment will be on a cost reimbursement basis for the type of work ordered. Please respond to the following five evaluation criteria. Limit your response to one page per criterion. 1. Past experience that would facilitate ability to assist the Agency before the Federal Labor Relations Authority (FLRA), including negotiability and unfair labor practice cases, and impasses before the Federal Service Impasses Panel (FSIP, an entity within the FLRA). 2. Providing training in Federal sector Labor Relations. 3. Experience in Federal sector EEO case law as it pertains to Labor Unions. 4. Experienced in developing and reviewing Federal EEO class action lawsuits and implementing Court-approved settlement agreements. 5. Price: $ ____ per hour for consulting. $ ____ per hour for assisting administrative staff with hearings (FLRA, etc). $ ____ per hour for training. $ ____ hour for travel within the San Francisco Bay Area. $ ____ hour for travel outside the San Francisco Bay Area. In addition to the hourly rate, travel & per diem rates shall be in accordance with the Joint Travel Regulations. For evaluation purposes: Price will be equal to the sum of the first four criteria. If the offeror identifies a specific individual and discusses the knowledge and experience of that individual in addressing the evaluation criteria, the offeror may not substitute another person for that individual during contract performance without the prior, written consent of the Contracting Officer. If the individual ceases to be employed by the offeror during contract performance, the Forest service may treat the contract as terminated by the offeror.
