Description
This synopsis/solicitation is for commercial items prepared in accordance with the format in FAR Subpart 12.603, as supplemented with additional information included in this notice. This announcement requests a detailed technical quote in addition to a price quote and constitutes the only solicitation; a paper solicitation will not be issued. Request for Quotation (RFQ) number SECHQ1-04-Q-0030 shall be referenced on any technical quote and price quote. This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC-20 for full and open competition (this competition is unrestricted). All future information about this acquisition including solicitation amendments will also be distributed solely through this site. Interested parties are responsible for monitoring this site to ensure that they have the most up-to-date information about this acquisition. The U.S. Securities and Exchange Commission?s (SEC), Division of Enforcement and Office of Information Technology (OIT), requires web based litigation support software for a minimum of 1,200 concurrent users, software maintenance for up to 5 years, and professional services for implementation support and knowledge transfer. The SEC currently uses Dataflight?s Concordance as it litigation support software. The new web based software shall be able to import Concordance databases and support very large document collections. The software shall be able to use an Open Data Base Connection (ODBC) compliant repository for documents and images, and shall be able to import existing SEC data from Concordance databases. The software shall work with Netscape, Internet Explorer, and Macintosh web browsers. The software shall have the ability to integrate and export to other industry standard software packages that the SEC currently owns (CaseMap, Sanction, LiveNote). The litigation support software shall have a customizable web portal interface. The software shall perform common litigation support functions, including: searching, organizing documents into folders, editing, reporting, annotating documents, highlighting documents, and viewing images of documents. The software shall have the ability to track other items in a case beyond documents, for example, calendar events, deposition schedules, contacts, and research links. The software shall support ?branding of images? with information in headers and footers. The software shall have the ability to create a collection of documents from the repository. An end user will have the capability to add or delete documents from a collection. The software shall have the ability to burn a collection of documents to a CD, and package the documents on the CD with a runtime copy of the software. An end user on a non-networked computer will have the capability to run the software from the CD to view only the documents in the collection. The software shall be able to create Adobe PDF files from data base records for transmission to other groups. The software shall generate reports that can be exported or cut/pasted to Microsoft Office programs such as Excel or Word for editing. The software shall be able to support 2,500 active cases with 100 million pages of documents. The software shall include a utility to convert existing Concordance databases and associated files (folders, redactions, saved searches, saved templates) for use with the software. The utility shall be packaged with a graphical user interface (GUI) that shall allow the conversion of databases contained in subdirectories. The database conversion utility shall create a log/error report for Administrative review after conversion. The software shall include a utility that will allow auto setup of databases created in the SEC Testimony Transcription System (TTS). The utility shall integrate into either current TTS or Concordance Menu and auto direct/link to the new database setup screen. The TTS interface utility shall create a log/error report for Administrative review after conversion. The software shall include a utility that will automatically import data, OCR text and image cross-reference files from an SEC server into the new software repository. The software shall be capable of handling files that may be as large as 350,000 images/records per day and loads that may be as large as 14 GB. The software shall be capable of handling single page TIF images and accept data in a pre-defined format including a Concordance database and/or DAT file. This software utility shall be server based (not a web/html GUI). The utility shall create a log/error report for records rejected. The software shall adhere to Section 508 of the Rehabilitation Act of 1973 (29 U.S.C. 794d), all EIT supplies and services provided under this contract shall comply with the applicable accessibility standards issued by the Architectural and Transportation Barriers Compliance Board at 36 CFR Part 1194 (see FAR Subpart 39.2). Electronic and information technology (EIT) is defined at FAR 2.101. The software shall meet Security standards that have been analyzed and accepted by other Enforcement Agencies (Department of Justice, California/Arizona/New York/Colorado Attorney General?s Offices) such as, DEFENSE INFORMATION SYSTEM AGENCY (DISA) STIG v2r1 Appendix: G Section 53-55. The vendor shall provide hands-on training on the litigation support software. The Government furnished equipment to conduct the training will include laptops and mice for both the students and trainer, and a projector. The vendor shall provide training documentation for both User and Administration training. The user training shall require the vendor to train multiple days in multiple cities, with training often occurring simultaneously in multiple cities. Classes shall be provided during normal business hours. Regular work hours will be 9:00am to 5:00 pm. The following chart is to be filled in by vendors to outline their draft schedule including number of training days, number of training sessions, number of classes and estimated number of students per class. The equipment outlined in the User training shall also be provided for the Administration training. The total number of Administration students shall not exceed 15. Contractor shall propose a date for Administration training to be scheduled prior to User training. CONTRACTOR PERSONNEL BACKGROUND CHECK - The SEC shall conduct a thorough check including a background investigation for each prospective contractor employee under this Contract who will have access to SEC buildings or non-public information in order to determine suitability for work under this Contract based on the sensitivity of the information that the prospective Contract employee will access while performing the job. For each prospective Contractor employee, the Contractor shall complete OPM Form 85P and submit it to the COTR. OPM Form 85P is available at http://www.opm.gov/forms. The Government reserves the right of final approval for prospective Contract employees. CONTENT OF THE CONTRACTOR PERSONNEL BACKGROUND CHECK - The contractor personnel background check shall include, but not be limited to the following: 1. CRIMINAL HISTORY CHECK - The SEC will contact local jurisdictions including the Virginia State Police, Maryland State Police, and the Washington Metropolitan Police Department to determine the criminal history of each prospective Contract employee. For prospective Contract employees who have resided in local jurisdictions for less than six months, the SEC will pursue criminal history checks from the city or county of the prospective Contract employee?s most recent residency. The SEC will also obtain a national criminal history report from the Federal Bureau of Investigation (FBI). 2. CREDIT HISTORY CHECK The SEC will seek evidence that the prospective Contract employee is responsible with credit obligations. A prospective Contract employee who receives an unfavorable credit rating shall be approved by the OAPM Security Specialist before acceptance under this Contract. The prospective Contract employee shall address the circumstances surrounding the unfavorable credit rating in writing and shall submit the explanation to the OHRAS Security Specialist through the COTR or other designated official for approval before assignment under this Contract. The following factors which are in descending order of importance, shall be used to evaluate quotes: (1) technical acceptability (i.e., ability to interface, integrate and export to other standard software packages that the SEC currently owns), (2) User and Administration training, (3) past performance for requirements that are similar to the SEC?s Statement of Objectives (offerors shall provide complete client contact information so that reference checks may be conducted), and (4) price. If options are awarded, the Government will evaluate offers for award purposes by adding the total price of all options to the total price of the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). This evaluation shall be based on information provided by the contractor. The Government is not responsible for locating or securing any information, which is not identified in the Capabilities Statement or quotation, but may do so at its discretion. Only authorized representatives shall submit quotes. Please carefully review the commercial item FAR clauses for information about requirements and instructions for submitting a quotation. Capabilities Statements that do not include prices for all items will not be considered. The following provisions and clauses apply to this procurement: Federal Acquisition Regulation (FAR) provision 52.212-1, Instructions to Offeror- Commercial Items (OCT 2000); FAR provision 52.212-2, Evaluation-Commercial Items (JAN 1999) - Award shall be made to the responsible offeror whose offer is considered to be most advantageous to the Government, considering technical acceptability, user training, past performance, and price. The Government reserves the right to award without discussions; therefore, it is critical that each quote be fully responsive. However, the SEC also reserves the right to conduct discussions, if later determined to be necessary, with offerors making the competitive range (i.e., the most highly rated proposals, unless the range is further reduced for the purposes of efficiency). FAR provision 52.212-3, Offeror Representations and Certification-Commercial Items (JAN 1999) - all offerors shall include a completed copy of this provision with their quote; FAR clause 52-212-4, Contract Terms and Conditions- Commercial Items (FEB 2002); FAR clause 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items (APR 2003) - in paragraph (b) the following clauses apply; 52.203-6 Alternate I, 52.222-3, 52.222-19, 52.222-21, 52.222-26, 52.222-35, 52.222-36, 52.222-37, 52.222-41, 52.222-43, 52.222-44, 52.232-33, 52.232-36, 52.239-1. 52.217-9 Option to Extend the Term of the Contract (Mar 2000) also applies. Clauses incorporated by reference may be accessed in full text at www.arnet.gov. All technical quotes and price quotes from responsible sources will be considered. Questions may be submitted on or before April 6, 2004 at 1:00 PM EST. The price quote shall be submitted as a completely separate document from the technical quote. Two (2) copies of each technical quote and two (2) copies of each price quote shall be submitted to Lynda M. Theisen. Proposals shall be clearly marked with RFQ no. SECHQ1-04-Q-0030. Proposals may be either hand delivered or sent via U.S. Mail to the Securities and Exchange Commission, 6432 General Green Way, MS O-20, Alexandria VA 22312, or to Theisenl@sec.gov no later than 12:00 Noon EST, April 9, 2004. No other methods of submission will be accepted.
