- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The National American Industry Classification Code is 333220 with a Business Size Standard of 500 employees. This solicitation is issued as a total small business set-aside. This notification is published for informational purposes only. Interested persons may identify their interest and capability to respond to the requirement. All responsible sources may submit a quote which shall be considered. The Federal Bureau of Investigation (FBI) intends to negotiate on a sole-source basis with 3D Systems, Inc. for a SLA5000 Stereolithography Apparatus and a PCA Large-UV Post-Curing Apparatus for Large Frame SLA Systems. This contract is for a one time buy. Requirements of system include: 1) Must operate using the Buildstation 5.4 or better software, from 3D Systems, Inc.; 2) Must use .bff format build files produced by Lightyear 1.4 or better part preparation software; 3) Must operate on 208 volt, single-phase, AC power; 4) Must interface with a TCP/IP network via a 100base-T connection and must be able to operate independent of any connection to the internet; 5) must have a build envelope of no less than W20" x D20" x H23"; and 6) Machine must be no larger than W75" x D48" x H54". The above listed characteristics are intended to be descriptive, but not restrictive. The evaluation of quotations and the determination as to equality of the product shall be the responsibility of the Government and will be based on information furnished by the vendor. The purchasing activity is not responsible for locating or securing any information which is not identified in the quotation and reasonably available to the purchasing activity. To ensure that sufficient information is available the vendor must furnish as a part of his/her quotation all descriptive material (such as cuts, illustrations, drawings, or other information) necessary for the purchasing activity to determine whether the product meets the minimum salient characteristics. If the vendor proposes to modify a product to make it conform to the requirements of this announcement he/she shall include a clear description of such proposed modifications and clearly mark any descriptive material to show the proposed modifications. The government reserves the right to request product samples which can be tested for compatibility. Standard Commercial warranty is one year. All compliant quotes received within thirty (30) days after date of publication will be considered by the government. Delivery of the items shall be sixty (60) days after receipt of order. The delivery shall be FOB Destination to FBI, ERF Bldg 27958A, Quantico, VA 22135. All quotes shall be submitted to FBI Academy, Hogan?s Alley, Building 15, Quantico, VA 22135, Attn: Gary Hopkins, no later than 3:00 PM, EST, May 21, 2004. Quotes must clearly be marked with RFQ 865786. Bidders are hereby notified that if your quote is not received by the date/time and location specified in this announcement, it will not be considered. Offerors are to include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications - Commercial Items, with their offer. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of whether to conduct a competitive procurement. Incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2001-22. The provision at 52.212-1, Instructions to Offerors - Commercial, applies to this acquisition. The provisions of 52.212-2, Evaluation - Commercial Items, are applicable. The clause at 52.212-4, Contract Terms and Conditions - Commercial Items, applies to this acquisition. Clause 52.212-4, add 52.233-2 Service of Protest (AUG 1996), Department of Justice (DOJ), Justice Acquisition Regulation (JAR) Clauses, 2852.233-70 Protests Filed Directly with the Department of Justice (JAN 1998), and 2852-201-70 Contracting Officers Technical Representative (COTR) (JAN 1985), Mr. Anthony Baumann, Chief Contracting Officer, Federal Bureau of Investigation, 935 Pennsylvania Ave., NW, Washington, DC 20535-0001, shall serve as the FBI?s contact in accordance with 52.233-3 Protest After Award. Addendum to Clause 52.252-5 Authorized Deviations in Clauses (APR 1984), is incorporated by reference and applies to FAR 9.104-1. Addendum to 52.212-2 (a) Award will be based on Best Value to the Government, technical compliance with stated salient characteristics, past performance and price. Technical and past performance when combined are significantly more important than cost or price. However, as quotes become more equal in their product merit and past performance, the evaluated cost or price becomes the determining factor. Past Performance will be based on telephonic performance evaluations received from previous contracts provided in the quote. Any vendor not having government or commercial experience will be rates as ?Neutral?. The evaluation of this RFQ will be in accordance with Parts 12, 13, and 15 of the FAR. Offerors must acquaint themselves with the new regulations concerning Commercial Item acquisition contained in FAR Subpart 12 and must ensure that all Representations and Certifications (located on the Internet) are executed and returned as required in this synopsis/solicitation.
