Description
The following question was asked by a potential offeror. The answer is being made available to all offerors.***QUESTION: Why is Part 135 being required? It does not seem to apply to this scope of work because we would not be transporting people and/or cargo for hire. Would this not be a flight services contract under Part 91? Please advise if NOAA is adamant about Part 135 certification. ***ANSWER: NOAA does not require that Offerors hold 14 CFR part 125 or 135 certificates for this solicitation. As stated in the evaluation criteria, "It is desirable that the Offeror meet or exceed the requirements for aircraft, pilot, and operations safety as described in 14 CFR Parts 125 or 135 to the maximum extent possible,...". It is understood that it may be difficult to meet the part 135 standard while modifying an aircraft to meet the lidar requirements and that there are Offerors that adhere to high safety standards without having received the part 125 or 135 certificates. Therefore, the evaluation criteria and solicitation do not require part 125 or 135 certification of the Offerors, but do encourage and reward Offerors that achieve higher standards for safety. The solicitation does reference components of the 14 CFR 135 standards in order to more clearly specify the particular safety requirements that do need to be met for this contract.
