Description
The purposes of this amendment are (a) to clarify that this procurement is NOT being conducted as a small business set aside (it is being conducted on an unrestricted, competitive basis) and (b) to publish questions received to date for this RFQ and answers to those questions for all potential offers to consider. QUESTION 1: What are the fastest achievable payment terms? ANSWER TO QUESTION 1: Invoice(s) for the awarded PO will be handled in accordance with the Prompt Payment Act, 31 USC § 3903, and Office of Management and Budget (OMB) Circular A-125, Prompt Payment. Generally, that means that invoice(s) can only be considered proper if they are submitted after NIST acceptance for the billed items has previously occurred and, by law, the proper invoice(s) must be paid within 30 days of receipt of a proper invoice, as a proper invoice is defined in that law. (The invoice would need to contain everything requested in FAR clause 52.212-4(g), Invoice, to be considered proper.) Discounts for prompt payment may be offered in the invoice. QUESTION 2: May training be offered as two separate line items, each with a different focus: Answer: Yes. For Line item 0002, as with the equipment, it must be firm-fixed-price in a commercial item environment. Therefore, it would only be billed at the end of the training, and not fractionally, if one training course is offered. If more than one training course are offered, both of which will be provided, then two separate training CLIN's should be offered (0002 and 0003), one for each course, and then billed after completion of each one. Multiple (i.e., alternate) offers are encouraged, as noted in provision 52.212-1(e) as long as each offer is firm-fixed-price and addresses all RFQ requirements.
