- SIMPLIFIED ACQUISITION PROCEDURES DATE: JULY 8, 2004 REQUISITION NO: 04M000184 INTENDED SOURCE: NATIONAL CONFERENCE OF STATE LEGISLATURES PERIOD OF PERFORMANCE: DATE OF AWARD THROUGH TWELVE MONTHS PURPOSE: THE DEPARTMENT OF HEALTH AND HUMAN SERVICES, SUBSTANCE ABUSE AND MENTAL HEALTH SERVICES ADMINISTRATION (SAMHSA) , THROUGH THE PROGRAM SUPPORT CENTER, PLANS TO AWARD A SOLE SOURCE SIMPLIFIED ACQUISITION TO NATIONAL CONFERENCE OF STATE LEGISLATURES. CLOSING DATE IS JULY 23, 2004. THE SPECIFIC OBJECTIVE OF THIS PROCUREMENT IS: BACKGROUND: STATE LEGISLATORS WHO SERVE ON HEALTH, HUMAN SERVICES, CRIMINAL JUSTICE, APPROPRIATIONS, AND BUDGET COMMITTEES, THE LEGISLATIVE RESEARCH BUREAUS AND STAFF, AND THE LEGISLATIVE LEADERSHIP HAVE A DIRECT IMPACT ON THE WAY TREATMENT SERVICES FOR PERSONS DIAGNOSED WITH, OR AT RISK OF, SUBSTANCE RELATED DISORDERS ARE ORGANIZED, FINANCED, REGULATED, DELIVERED, AND EVALUATED IN STATES AND LOCAL COMMUNITIES. LEGISLATORS AND THEIR STAFFS ARE IN NEED OF TIMELY INFORMATION ON HOW NEW STATE INITIATIVES (OFTEN TIED TO FEDERAL INITIATIVES) ARE RELATED TO ALCOHOL AND DRUG TREATMENT. EXAMPLES OF THESE ISSUES MAY INCLUDE: WELFARE REFORM, AND ITS EFFECTS KEY POPULATIONS LIKE ADDICTED WOMEN AND THEIR CHILDREN; HEALTH CARE REFORM, AND CHANGES IN MEDICAID AND MEDICARE POLICY; CRIMINAL JUSTICE, AND EFFORTS TO RESTRICT DRUG TRAFFICKING AND DEVELOP ALTERNATIVES TO INCARCERATION FOR OFFENDERS WITH SUBSTANCE RELATED DISORDERS; MANAGED CARE; AND PERFORMANCE MEASUREMENT. SIMILARLY, THE DEVELOPMENT OF NEW TREATMENT TECHNOLOGIES (E.G., CHANGES IN PRACTICE TO INCLUDE EVIDENCE-BASED TREATMENT PROTOCOLS, NEW DRUGS FOR DETOXIFICATION, CRAVING REDUCTION, AND RELAPSE PREVENTION, MATCHING TO SPECIFIC PSYCHOSOCIAL TREATMENTS AND PHARMACOTHERAPIES) MAY GENERATE NEW FEDERAL AND STATE INITIATIVES. THE ACTIVITIES SUPPORTED BY THIS CONTRACT WILL ALLOW A DYNAMIC INTERPLAY AMONG THE ISSUES BEING RAISED AT STATE LEGISLATURE AND THE INFORMATION ON BEST PRACTICES AVAILABLE FROM OTHER STATES, THE FEDERAL GOVERNMENT, AND THE CLINICAL AND SERVICES RESEARCH EXPERTS. PURPOSE: THE CONTRACTOR SHALL PROVIDE BOTH TECHNICAL ASSISTANCE AND A CONTINUOUS AND A TARGETED FLOW OF INFORMATION TO STATE LEGISLATORS ON ISSUES RELATED TO FINANCING AND QUALITY OF TREATMENT OF SUBSTANCE RELATED DISORDERS. THE REPORTS WILL HIGHLIGHT THE LATEST INFORMATION ON ISSUES REGARDING COSTS ASSOCIATED WITH TREATMENT FOR SUBSTANCE-RELATED DISORDERS (SRD TREATMENT) AS IT RELATES TO STATE PARITY LEGISLATION; LEGISLATION AS IT AFFECTS THE TREATMENT FOR SUBSTANCE RELATED DISORDERS OF WOMEN WITH CHILDREN (E.G., PUNISHMENT VS. TREATMENT); LEGISLATION RELATED TO INCLUSION OF SCREENING AND ASSESSMENT, BRIEF INTERVENTION/BRIEF TREATMENT AND REFERRAL TO SPECIALIST TREATMENT FOR PERSONS SEEN IN COMMUNITY GENERALIST SETTINGS SUCH AS PRIMARY CARE CLINICS, EMERGENCY DEPARTMENTS AND SCHOOL-BASED HEALTH CARE PROGRAMS; LEGISLATION RELATING TO COVERAGE FOR SRD TREATMENT UNDER VARIOUS STATE FUNDING STREAMS SUCH AS STATE GENERAL FUND, MEDICAID, CHILDREN'S INSURANCE PROGRAM (CHIP), PREVENTIVE HEALTH AND HEALTH SERVICES BLOCK GRANT, COMMUNITY HEALTH CENTER GRANTS, COMMERCIAL INSURANCE, SUBSTANCE AND ABUSE PREVENTION AND TREATMENT BLOCK GRANT, TEMPORARY ASSISTANCE FOR NEEDY FAMILIES (TANF) BLOCK GRANT, CHILD CARE AND DEVELOPMENT (CCDF) BLOCK GRANT, MATERNAL AND CHILD HEALTH BLOCK GRANT. AREAS TO BE CONSIDERED AS PRIORITY FOR TRACKING STATE LEGISLATURE ACTIVITY AND PRODUCING REPORTS ON SUBSTANCE RELATED DISORDER (SRD) TREATMENT INCLUDE: PARITY FOR TREATMENT OF SRDS WITH TREATMENT OF PHYSICAL AND MENTAL DISORDERS; SCREENING, BRIEF INTERVENTION, BRIEF TREATMENT, ASSESSMENT, REFERRAL AND CASE MANAGEMENT IN COMMUNITY SETTINGS; CARE MANAGEMENT FOR PERSONS DIAGNOSED WITH SUBSTANCE USE DISORDERS; DEVELOPMENT OF INTEGRATED SPECTRUMS OF PREVENTION AND TREATMENT WITHIN STATES AND LOCAL COMMUNITIES; TREATMENT OF CHILDREN AND ADOLESCENTS; TREATMENT OF OFFENDERS IN EITHER DIVERSION OR CORRECTIONS PROGRAMS, INCLUDING DRUG COURTS; TREATMENT DELIVERED IN MANAGED CARE ORGANIZATIONS AND PERFORMANCE MEASUREMENT; PHARMACEUTICAL BENEFITS RELATED TO SUBSTANCE USE DISORDER TREATMENT (ESPECIALLY METHADONE, BUPENORPHINE, AND NALTREXONE); AND LEGISLATION RELATED TO SRD TREATMENT FOR PERSONS RECEIVING BENEFITS UNDER THE TEMPORARY ASSISTANCE TO NEEDY FAMILIES(TANF) PROGRAM. THE CONTRACTOR WILL REPORT THESE ACTIVITIES THOUGH SUMMARIES OF THE TECHNICAL ASSISTANCE PROVIDED. TASKS: TASK 1: THE CONTRACTOR SHALL MEET WITH THE GOVERNMENT PROJECT OFFICER (GPO) AND OTHER APPROPRIATE STAFF AT CSAT IDENTIFIED BY THE GPO, IN ORDER TO DETERMINE THE BEST APPROACH FOR ACCOMPLISHING THE TASKS COVERED BY THIS CONTRACT. THIS MEETING MAY TAKE PLACE EITHER IN PERSON OR VIA CONFERENCE CALL. TASK 2: BASED ON THE RESULTS OF TASK 1, THE CONTRACTOR SHALL PROVIDE CSAT WITH A DRAFT MONITORING AND TRACKING PLAN, AS WELL AS PLANS FOR TECHNICAL ASSISTANCE AND ANALYTIC REPORTS FOCUSED ON SPECIFIC ISSUES OF INTEREST TO CSAT, AND TIME LINES FOR APPROVAL. THIS DRAFT MONITORING PLAN WILL BE INCORPORATED INTO THE FORMAT FOR THE MONTHLY REPORT THAT WILL BE USED BY THE CONTRACTOR AND THE GOVERNMENT PROJECT OFFICER FOR TRACKING THE PROGRESS OF THIS CONTRACT. THE PLAN WILL INCLUDE PROGRESS ON ALL TASKS OF THIS CONTRACT. THE CSAT GPO WILL REVIEW AND APPROVE THIS PLAN, AND THE CONTRACTOR WILL SECURE THIS APPROVAL AND TRANSMIT APPROPRIATE DOCUMENTATION TO CSAT BEFORE INITIATING ACTIVITIES. TASK 3: THE CONTRACTOR SHALL BE RESPONSIBLE FOR CONVENING AN ADVISORY COMMITTEE TO ASSIST BOTH CSAT AND THE CONTRACTOR IN PRIORITIZING ISSUES FOR TECHNICAL ASSISTANCE, DEVELOPING INFORMATION ADVISORIES FOR LEGISLATORS, AND SUGGESTING INDIVIDUALS TO MEET SPECIAL TECHNICAL ASSISTANCE REQUESTS. THE ADVISORY COMMITTEE WILL BE COMPOSED OF AT LEAST SIX MEMBERS WITH BROAD KNOWLEDGE OF THE TREATMENT AND PREVENTION FIELD, AND THE LEGISLATIVE PROCESS. TASK 4: THE CONTRACTOR SHALL RESPOND TO REQUESTS FROM LEGISLATORS, LEGISLATIVE STAFF AND THE PUBLIC REGARDING TREATMENT OF ALCOHOL AND SUBSTANCE ABUSE. TASK 5: THE CONTRACTOR SHALL PLAN AND CONDUCT SIX TECHNICAL ASSISTANCE ASSIGNMENTS FOR STATE LEGISLATURES. THE GOAL OF THESE ASSIGNMENTS (WHICH MAY BE CONFERENCES, RESPONSES TO REQUESTS FOR TECHNICAL ASSISTANCE FROM EXPERT WITNESSES, INFORMATION PACKAGES, ETC.) WILL BE TO ENHANCE THE KNOWLEDGE AND UNDERSTANDING OF LEGISLATORS AND STAFF TO ENABLE THEM TO MAKE MORE INFORMED DECISIONS CONCERNING LEGISLATION AND FUNDING FOR SRD TREATMENT. THE FOCUS OF THE TECHNICAL ASSISTANCE WILL BE THE INTERSECTION OF LEGISLATION, SRD TREATMENT AND THE FINANCING AND COST OF TREATMENT (AS NOTED ABOVE). THE CONTRACTOR WILL PROPOSE TECHNICAL ASSISTANCE CONSULTANTS FOR CSAT APPROVAL. TASK 6: THE CONTRACTOR SHALL PROVIDE THE GPO TWO (2) COPIES OF THE REPORT THAT SUMMARIZES THE TECHNICAL ASSISTANCE PROVIDED TO STATE LEGISLATORS. TASK 7: THE CONTRACTOR WILL COLLABORATE WITH THE NATIONAL GOVERNORS ASSOCIATION, THE CONFERENCE OF MAYORS, AND OTHER SUCH ORGANIZATIONS ON ITS INTERESTS IN ADDRESSING ALCOHOLISM AND DRUG ADDICTION IN STATE AND COMMUNITIES. IN ADDITION, THE CONTRACTOR WILL PLAN AND CONDUCT CONCURRENT SESSIONS AT NCSL=S ANNUAL MEETING OR AT THEIR HEALTH POLICY MEETING ON SRD TREATMENT. TASK 8: THE CONTRACTOR SHALL PROVIDE CSAT WITH MONTHLY REPORTS (USING THE APPROVED MONITORING AND TRACKING FORMAT DESCRIBED IN TASK 2) ON INFORMATION GATHERING ACTIVITIES RELATED TO RELEVANT LEGISLATION AND ISSUES OF CONCERN TO STATE LEGISLATURES IN THE SPECIFIC AREAS IDENTIFIED BY THE ADVISORY COMMITTEE AND CSAT. THE MONTHLY REPORT WILL INCLUDE PROGRESS REPORTS ON UPDATES ON ANY ANALYTIC STUDIES THAT ARE UNDERWAY AND ON SUBSTANCE ABUSE TREATMENT LEGISLATION AND TECHNICAL ASSISTANCE NEEDS OF STATE LEGISLATURES. THE GPO WILL REVIEW AND COMMENT BEFORE FINAL REPORT APPROVAL. SOLE SOURCE DETERMINATION IS BASED UPON THE FOLLOWING: THE PURPOSE OF THIS PURCHASE ORDER IS TO PROVIDE THE CENTER FOR SUBSTANCE ABUSE TREATMENT (CSAT) WITH EXPERT INFORMATION ON ISSUES RELATED TO STATE LEGISLATIVE POLICY ISSUES AFFECTING THE QUALITY AND FINANCING OF TREATMENT OF ALCOHOL AND DRUG RELATED DISORDERS. SPECIFICALLY, CSAT IS INTERESTED IN BECOMING AWARE ON A TIMELY BASIS OF STATE TREATMENT LEGISLATION DEALING WITH TREATMENT OF SUBSTANCE-RELATED DISORDERS, PARTICULARLY LEGISLATION RELATED TO FINANCING AND COSTS; TREATMENT OF SPECIAL POPULATIONS (SUCH AS ADOLESCENTS, WOMEN, THE ELDERLY; OFFENDERS IN THE COMMUNITY AND INSTITUTIONAL CRIMINAL JUSTICE SYSTEM, WELFARE RECIPIENTS); AND IN PROVIDING A CONSISTENT AND RESPECTED CHANNEL FOR DISSEMINATING THAT INFORMATION AND ANALYSES BACK TO THE STATE LEGISLATIVE MEMBERS, LEADERSHIP, AND STAFFS THROUGH A TRUSTED AND VALUED ORGANIZATION. STATE LEGISLATIVE POLICY INFORMATION IS CRITICAL TO CSAT BEING ABLE TO CARRY OUT ITS MISSION. STATE LEGISLATIVE COMMITTEES, LEGISLATIVE RESEARCH BUREAUS, COMMITTEE STAFF, AND THE LEGISLATIVE LEADERSHIP HAVE A DIRECT EFFECT ON THE WAY TREATMENT SERVICES ARE ORGANIZED, FINANCED, REGULATED, AND DELIVERED THROUGH THE LEGISLATIVE ADOPTION AND BUDGET FORMULATION PROCESS. ADDITIONALLY, THIS PURCHASE ORDER IS TO PROVIDE CSAT WITH UPDATED, REFORMATTED MATERIALS ON SUBSTANCE ABUSE TREATMENT AND A VARIETY OF NEW STATE INITIATIVES THAT RELATED TO TREATMENT OF PERSONS WITH SUBSTANCE RELATED DISORDERS (E.G., WELFARE AND HEALTH CARE REFORMS, CHILDREN=S HEALTH INSURANCE PROGRAMS, MANAGED CARE, DRUG COURTS) FOR DISSEMINATION THROUGH VARIOUS MEDIA TO STATE LEGISLATORS INDIVIDUALLY AND IN THEIR ROLE ON KEY COMMITTEES, AND TO STAFF MEMBERS WORKING FOR THE INDIVIDUAL LEGISLATORS, COMMITTEES, AND OTHER LEGISLATIVE AGENCIES (E.G., AUDIT, DRAFTING). THE NATIONAL CONFERENCE OF STATE LEGISLATURES (NCSL) AS A BIPARTISAN ORGANIZATION HAS A UNIQUE AND ONGOING RELATIONSHIP WITH STATE LEGISLATIVE BODIES. MEMBER LEGISLATIVE BODIES ARE COMFORTABLE TURNING TO NCSL FOR TECHNICAL ASSISTANCE AND AS A FORUM FOR EXCHANGING INFORMATION ON PRESSING STATE POLICY ISSUES. BECAUSE OF THIS UNIQUE AND CONTINUING RELATIONSHIP WITH STATE LEGISLATIVE BODIES, NCSL IS UNIQUELY POSITIONED TO PROVIDE CSAT WITH MATERIALS AND TO ARRANGE FOR TECHNICAL ASSISTANCE ON SUBSTANCE ABUSE TREATMENT AND OTHER STATE INITIATIVES NECESSARY TO CARRYING OUT CSAT=S MISSION. THE NCSL IS THE ONLY SOURCE THAT CAN PROVIDE CSAT WITH THE ABILITY TO BOTH TRACK STATE LEGISLATIVE ISSUES RELATED TO SUBSTANCE ABUSE TREATMENT, AND TO PROVIDE TIMELY SCIENTIFIC INFORMATION ABOUT THE ORGANIZATION AND FINANCING OF SUBSTANCE ABUSE TREATMENT SERVICES AND RELATED STATE INITIATIVES TO THE STATE LEGISLATURES. NCSL WILL BE ABLE TO USE ALREADY ESTABLISHED AND VALUED MECHANISMS (I.E., THE NCSL ANNUAL MEETING; THE NCSL SEMI-ANNUAL MEETINGS OF HEALTH COMMITTEE CHAIRS; ISSUE BRIEFS TO ALL THE STATE; ANNUAL LEGISLATIVE CONFERENCE) TO DISSEMINATES SUCH SPECIALIZED MATERIALS TO LEGISLATORS AND THEIR STAFFS IN THE AREAS OF QUALITY OF CARE, PERFORMANCE MEASUREMENT, FINANCING AND MANAGED CARE, PARITY, TREATMENT MODALITIES, AND EXPENDITURES. NO OTHER SOURCE HAS THE ONGOING RELATIONSHIPS WITH THE STATE LEGISLATURES IN ORDER TO GAIN ACCESS TO THE INFORMATION NEEDED TO UPDATE THIS TYPE OF INFORMATION ACROSS THE STATES AND TO EXAMINE THE OTHER RELEVANT STATE ISSUES. NO OTHER ORGANIZATION IS SO SITUATED WITH STATE LEGISLATURES AND LEGISLATORS AS TO SUPPORT THE DISSEMINATION OF THIS TYPE OF INFORMATION TO STATE LEGISLATORS AND THEIR STAFFS. THE PROPOSED SIMPLIFIED ACQUISITION IS FOR SERVICES FOR WHICH THE GOVERNMENT INTENDS TO SOLICIT AND NEGOTIATE WITH ONLY ONE SOURCE (FAR 6.302-1). A DETERMINATION BY THE GOVERNMENT NOT TO COMPETE THIS PROPOSED SIMPLIFIED ACQUISITION BASED UPON RESPONSES TO THIS NOTICE IS SOLELY WITHIN THE DISCRETION OF THE GOVERNMENT. CONTRACTORS MAY FORWARD CAPABILITY STATEMENTS TO THE REFERENCED ADDRESS.
