Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6. The PTO plans to award a commercial item contract utilizing simplified acquisition procedures to the offeror that provides the best value to the government considering price, quality, warranty and past performance factors. Due to the proprietary nature of the manufacturer?s software, only the software manufacturer, Altiris, Inc., 588 West 400 South, Suite 300, Lindon, Utah 84042, or one of the manufacturer?s officially authorized software maintenance resellers is qualified to receive award of the commercial item contract under this requirement. All qualified vendors should submit a price proposal for the following items under the following terms and conditions: Item 0001 ? Altiris Client Management Suite (no Carbon Copy) Annual Upgrade Protection (manufacturer?s part number 44121-04) quantity of 9,875; Item 0002 ? Altiris Asset Management Suite Annual Upgrade Protection (concurrent users) (manufacturer?s part number 46221-01) quantity of 10. This announcement constitutes the RFP and is the only solicitation that will be issued. This solicitation incorporates all of the applicable provisions of FAR clause 52.212-1. Offerors must include a completed copy of the provision at 52.212-3, OFFEROR REPRESENTATIONS AND CERTIFICATIONS ? COMMERCIAL ITEMS, with its offer. The successful offeror will be awarded a firm fixed price commercial item contract for the above requirement using simplified procedures. The commercial item contract will contain the terms and conditions of FAR clause 52.212-4 CONTRACT TERMS AND CONDITIONS ? COMERCIAL ITEMS, the applicable terms and conditions of FAR clause 52.212-5, CONTRACT TERMS AND CONDITIONS REQUIRED TO IMPLEMENT STATUTES OR EXECUTIVE ORDERS ? COMMERCIAL ITEMS and the following Section 508 clause ?Section 508 Compliance - In accordance with Section 508, the USPTO requires that all Electronic Information Technology (?EIT?), as that term is defined at FAR ?2.101, delivered under the contract comply with the applicable EIT accessibility standards issued by the Architectural and Transportation Barriers Compliance Board set forth at 36 CFR part 1194?. Any qualified vendor wishing to propose on the above requirement should submit a firm fixed price proposal, responsive to the requirements of this combined synopsis/solicitation, to the Patent and Trademark Office, Office of Procurement, via E-Mail to Chris.Hannah@USPTO.GOV no later than 4:00 P.M.
